The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows:
INTERPRETATION AND
APPLICATION
Lands and waters in the Northwest Territories
1.This Act applies to all lands and waters in the Northwest Territories other than lands under the administration and control of Her Majesty in right of Canada.
Conflict or inconsistency
2.This Act and the regulations prevail over other enactments to the extent of any inconsistency unless specifically stated otherwise.
SEIZURES
Seizure by peace officer
3.A peace officer who believes, on reasonable grounds, that any object, specimen or document has been removed, taken, shipped, had in possession or otherwise dealt with contrary to this Act or regulations may, in the Northwest Territories, without a warrant, effect seizure.
Report of seizure
4.Every seizure made under section 3 must be reported as soon as practicable to a justice of the peace who may, if satisfied that the object, specimen or document was removed, taken, shipped, had in possession or otherwise dealt with contrary to the regulations, declare it to be forfeited to the Government of the Northwest Territories and on that declaration it is forfeited.
OFFENCE AND PUNISHMENT
Offence and punishment
5.Every person who contravenes a section of this Act or the regulations is guilty of an offence and liable on summary conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding one year or to both.
REGULATIONS
Regulations
6.The Commissioner in Executive Council may make regulations
(a) for the protection, care and preservation of sites, works, objects and specimens of archaeological, ethnological or historical importance, interest or significant and explorers’ cairns and explorers’ documents;
(b) respecting the issuance of permits;
(c) respecting reports in relation to permits; and
(d) that the Commissioner in Executive Council considers necessary for carrying out the purposes and provisions of this Act.
TRANSITIONAL
Matters governed by Northwest Territories Act
7.This Act applies to all matters in respect of archaeological sites and artifacts that were governed by the Northwest Territories Act (Canada) and the Northwest Territories Archaeological Sites Regulations (Canada) before the coming into force of this Act.
Permits continued
8.Permits that were issued and were in force under the Northwest Territories Archaeological Sites Regulations (Canada) immediately before the coming into force of this Act, continue in force as if they had been issued in accordance with this Act.

Coming into force
9.This Act comes into force April 1, 2014.
