The Commissioner in Executive Council, under section 11 of the Archives Act and every enabling power, makes the Archives Regulations.
(1) A government body may develop a plan respecting the preservation and destruction of public records held by it, or under its control, which must
(a) include a comprehensive description of each class of public records;
(b) specify the criteria for determining whether a class of public records should be preserved or destroyed; and
(c) specify the minimum period during which the government body must retain each class of public records that it intends to destroy.
(2) If the Archivist approves a plan developed under subsection (1), the government body may destroy public records in accordance with the plan.
(3) Subsection (2) does not authorize the destruction of a public record by a government body on or after the date for transfer to the Archivist set out in section 5 of the Act.
(1) Subject to subsection (2), the fee payable for the production of a copy of a record in the Archives is set out in the Schedule.
(2) The Archivist may waive the fee, or a portion of the fee, for the production of a copy of a record, if he or she is of the opinion
(a) that the applicant cannot afford the payment; or
(b) that it would be reasonable in the circumstances to do so.
If the Archivist is of the opinion that the physical integrity of a public record would be jeopardized by access to it, or by the production of a copy of it, he or she may impose the conditions on access or copying that are necessary, in his or her opinion, to preserve the record.
These regulations come into force on the day on which An Act to Amend the Archives Act, S.N.W.T. 2007, c.2, comes into force.
