The Commissioner, on the recommendation of the Minister, under section 98 of the Wildlife Act and every enabling power, makes the Big Game Hunting Regulations.

Interpretation

1.

(1) In these regulations,

"Aboriginal harvester" means a person harvesting wildlife in accordance with section 17 of the Act; (récoltant autochtone)

"area" means a portion of a wildlife management zone subdivided into a wildlife management area, under subsection 88(2) of the Act, by the Wildlife Management Zones and Areas Regulations; (région)

"commercial tag" means a tag issued under the Sale of Wildlife Regulations; (étiquette commerciale)

"conservation area" means a conservation area designated under subsection 89(1) of the Act; (aire de conservation)

"cub" means

(a) a young black bear,

(i) that is less than 1.2 m in length, measured from the tip of the nose in a straight line to the tip of the last vertebra in the tail,

(ii) the hide of which is less than 1.2 m in length, measured from the tip of the nose in a straight line to the tip of the skin of the tail, before being stretched and dried, or

(iii) the hide of which is less than 1.6 m in length, measured from the tip of the nose in a straight line to the tip of the skin of the tail, after being stretched and dried;

(b) a young grizzly bear

(i) that is less than 1.4 m in length, measured from the tip of the nose in a straight line to the tip of the last vertebra in the tail,

(ii) the hide of which is less than 1.4 m in length, measured from the tip of the nose in a straight line to the tip of the skin of the tail, before being stretched and dried, or

(iii) the hide of which is less than 1.6 m in length, measured from the tip of the nose in a straight line to the tip of the skin of the tail, after being stretched and dried; and

(c) a young polar bear, including a cub-of-the-year and a yearling,

(i) that is less than 1.5 m in length, measured from the tip of the nose in a straight line to the tip of the last vertebra in the tail,

(ii) the hide of which is less than 1.5 m in length, measured from the tip of the nose in a straight line to the tip of the skin of the tail, before being stretched and dried, or

(iii) the hide of which is less than 1.8 m in length, measured from the tip of the nose in a straight line to the tip of the skin of the tail, after being stretched and dried; (ourson)

"GHL" means General Hunting Licence; (PCG)

"HTC" means Hunters and Trappers Committee; (CCT)

"IFA" means the Agreement between the Committee for Original Peoples’ Entitlement, representing the Inuvialuit of the Inuvialuit Settlement Region, and the Government of Canada, dated June 5, 1984 and tabled in the House of Commons of Canada on June 19, 1984, and recorded as document number 322-7/20; (CDI)

"LHC outfitter" means a local harvesting committee that is the holder of an outfitter licence issued under the Wildlife Business Regulations; (pourvoyeur CLR)

"limit" means, subject to an existing quota, the number of animals a hunter may kill in a season; (limite)

"male adult Dall’s sheep" means a male Dall’s sheep bearing at least one horn that is three-quarter curl or larger, determined on the basis of a straight line drawn from the anterior aspect of the base of the horn to the tip of the horn, and when viewed from the side,

(a) if the straight line passes in front of the posterior aspect of the eye socket, that horn shall be deemed to be a three-quarter curl horn, and

(b) where the horn is broken, worn or incomplete, it shall be deemed to be a three-quarter curl horn if the straight line, when drawn to the logically projected tip of the horn, would pass in front of the posterior aspect of the eye socket; (mouflon de Dall mâle adulte)

"non-LHC outfitter" means a holder, other than a local harvesting committee, of an outfitter licence issued under the Wildlife Business Regulations; (pourvoyeur autre qu’un CLR)

"NR" means Non-Resident Hunting Licence; (NR)

"NRA" means Non-Resident Alien Hunting Licence; (ENR)

"quota" means the total number of tags for a specific animal which may be issued for all licence types within a given zone or area; (quota)

"SHL" means special harvester licence; (PSR)

"RES" means a Resident Hunting Licence; (RES)

"two year old polar bear" means a polar bear that is two years of age or older but is younger than three years of age; (ours polaire de deux ans)

"yearling polar bear" means a polar bear that is one year of age or older but is younger than two years of age; (ours polaire d’un an)

"zone" means a wildlife management zone designated, under subsection 88(1) of the Act, by the Wildlife Management Zones and Areas Regulations. (zone)

(2) A reference to a zone or area is a reference to that zone or area as described

(a) in the Wildlife Management Zones and Areas Regulations; or

(b) in the case of the Mobile Core Bathurst Caribou Management Zone, in the Mobile Core Bathurst Caribou Management Zone Regulations.

(3) A reference to a conservation area is a reference to that area as described in the Conservation Area Regulations. 1.01.

A reference to regulations without a citation is a reference to regulations made under the Wildlife Act. R-151-96,s.4.

Application

1.1.

Sections 2, 14 and 22 of these regulations do not apply to bison killed under the Nuisance Bison Control Regulations. R-115-93,s.2; R-116-2014,s.3.

1.2.

Where these regulations conflict with the terms of the following regulations, the following regulations shall have priority:

(a) Inuvialuit Settlement Region Tuktoyaktuk Hunters and Trappers Committee Regulations;

(b) Inuvialuit Settlement Region Aklavik Hunters and Trappers Committee Regulations;

(c) Inuvialuit Settlement Region Paulatuk Hunters and Trappers Committee Regulations;

(d) Inuvialuit Settlement Region Inuvik Hunters and Trappers Committee Regulations;

(e) Inuvialuit Settlement Region Sachs Harbour Hunters and Trappers Committee Regulations;

(f) Inuvialuit Settlement Region Olokhatomuit Hunters and Trappers Committee Regulations.

1.3.

Section 5, subsection 8(1.1),and sections 12, 17, 18 and Parts 1, 6 to 10, 12 and 13 of the Schedule do not apply to Aboriginal harvesters harvesting within their traditional area. R-116-2014,s.4.

General

2.

Tags may be obtained from a vendor by paying the fee set out in the Wildlife Fees Regulations. R-116-2014,s.6.

4.

(1) The parts that evidence the age, species and sex of big game are,

(a) in the case of muskox, the testicles or scrotum;

(b) in the case of Dall’s sheep, the horns attached to the head with the eye sockets intact;

(c) in the case of moose, the head, testicles or scrotum;

(d) in the case of caribou, the testicles or scrotum;

(e) in the case of wood bison, the testicles or scrotum;

(f) in the case of polar bear, the baculum of the male polar bear; and

(g) in the case of grizzly bear, the baculum of the male grizzly bear.

5.

(1) No person shall use ammunition of

(a) less than .222 calibre to hunt wolf and wolverine; or

(b) less than .243 calibre to hunt big game other than wolf and wolverine.

(2) No person shall use ammunition of less than .30 calibre to hunt wood bison.

(3) No person shall use ammunition that produces less than 2,800 joules of energy at the muzzle of the firearm to hunt polar bear.

(4) No person hunting big game shall use

(a) rimfire ammunition; or

(b) ammunition containing non-expanding or steel-jacketed bullets.

(5) No person hunting big game shall use

(a) a bow having less than 20 kg of draw weight at 700 mm; or

(b) an arrow other than one having a broadhead point width of at least 25 mm or an unbarbed three-bladed bodkin head.

(6) No person hunting big game shall use

(a) a crossbow having less than 68 kg of draw weight at 700 mm;

(b) a bolt (quarrel) weighing less than 16.2 g; or

(c) a bolt with a broadhead of less than a 2.2 cm cutting diameter.

8.

(1) The type of licence, the limit, quota and other restrictions applicable to the harvesting of big game animals in a zone or area, or where applicable, conservation area are set out in the Part or Parts of the Schedule pertaining to the animal.

(1.1) No person shall hunt a big game animal in a zone or area that is not set out in Column II or III of a Part of the Schedule pertaining to the animal.

(1.2) For greater certainty, a type of licence that is set out in Column II of an item in a Part of the Schedule pertaining to a big game animal does not authorize the hunting of the animal in any zone or area that is not set out in Column III of that item.

(2) Where no restriction appears in these regulations, there is no restriction of number, sex, size, location or limit with respect to the hunting of big game.

(3) Where a quota for a big game animal is established in the Schedule, a hunter shall be subject to the quota, notwithstanding that the limit for that hunter may be unrestricted.

(4) Where a holder of a non-resident hunting licence or non-resident alien hunting licence wishes to export big game that he or she has harvested, the holder shall obtain and comply with a wildlife export permit issued under the Wildlife Licences and Permits Regulations. Black Bear

9.

No person shall hunt a black bear cub or a black bear that is accompanied by a cub. R-029-93,s.7; R-050-94,s.5.

Grizzly Bear

9.1.

(1) No person shall hunt a grizzly bear cub or a grizzly bear that is accompanied by a cub.

(2) No person shall hunt a grizzly bear that is in a den. R-050-94,s.5; R-151-96,s.6.

Polar Bear

9.2.

(1) No person shall hunt a polar bear cub or a polar bear that is accompanied by a cub.

(2) No person shall hunt a female polar bear that is in a den or is constructing a den.

(4) No person, other than the holder of a GHL, shall hunt polar bear by means other than with a dog team or on foot. R-006-97,s.3; R-081-98,s.4; R-057-99,s.4; R-116-2014,s.11.

11.

Where a hunter fails to return an unused tag under subsection 19(8), the hunter shall be deemed to have killed a bear.

12.

A person who kills a bear shall provide to an officer, the lower jaw of the bear and the information that officer requires, as soon as practicable after the bear is killed.

12.1.

(1) A person who kills a polar bear shall provide the following to an officer as soon as practicable after the bear is killed:

(a) the person’s name;

(b) the person’s hunting licence number and tag number;

(c) the date and location where the bear was killed;

(d) the lower jaw or undamaged post-canine tooth and, when present, lip tattoos and ear tags;

(e) evidence of the sex of the bear;

(f) any other information required by an officer.

(2) Where the evidence of the sex of a bear killed is not provided under subsection (1), and the officer has not verified the sex of a bear, the bear shall be deemed to have been female. R-029-93,s.8; R-151-96,s.7

Moose

12.2.

(1) No person other than the following shall hunt moose in G/MO/01:

(a) a person eligible to be enrolled as a participant in the Gwich’in Comprehensive Land Claim Agreement;

(b) a person holding an SHL and hunting with the permission of the applicable Gwich’in local harvesting committee;

(c) a person holding a GHL and hunting with the permission of the applicable Gwich’in local harvesting committee;

(d) a person holding an RES and hunting with the permission of the applicable Gwich’in local harvesting committee.

(2) No person other than the following shall hunt moose in S/MO/01:

(a) a person eligible to be enrolled as a participant in the Sahtu Dene and Metis Comprehensive Land Claim Agreement;

(b) a person holding an SHL and hunting with the permission of the applicable Sahtu Dene and Métis local harvesting committee;

(c) a person holding a GHL and hunting with the permission of the applicable Sahtu Dene and Métis local harvesting committee;

(d) a person holding an RES and hunting with the permission of the applicable Sahtu Dene and Métis local harvesting committee.

Muskox

13.

(1) No person, other than an Aboriginal harvester or the holder of a GHL, shall knowingly approach, in or on a vehicle, as defined in section 105 of the Act, 1.5. km of a muskox for the purpose of hunting the muskox.

(2) Subsection (1) does not apply to a person

(a) who is approaching a muskox already killed for the purpose of recovering the carcass; or

(b) in or on a vehicle on a highway, defined in the Motor Vehicles Act.

13.1.

(1) Every year the following tags shall be available to residents through draws:

(a) a tag entitling residents to hunt one muskox in Wildlife Management Muskox Area S/MX/01;

(b) a tag entitling residents to hunt one muskox in Wildlife Management Muskox Area U/MX/01.

(2) The draws will be subject to the following conditions:

(a) subject to subsection (3), residents may participate once in each yearly draw;

(b) applications for the yearly draws may be obtained from the office of a wildlife officer after April 1;

(c) applications must be postmarked before May 15 and received before the draw date;

(d) the draws shall take place no later than June 1;

(e) once one application has been drawn, one alternate application shall be drawn;

(f) in order to receive a tag, a successful applicant must pay the prescribed fee before June 30;

(f.1) where an applicant is successful in both draws, the applicant may purchase only one tag for the Wildlife Management Muskox Area of his or her choice;

(g) where a successful applicant refuses a tag or is not permitted to purchase a tag in the circumstances referred to in paragraph (f.1), the tag shall be offered to the alternate;

(h) the alternate must pay the prescribed fee within five days;

(i) where the alternate refuses the tag or fails to pay the prescribed fee within five days, the tag shall not be used that year.

(3) No person shall apply for a tag under subsection (1) and no tag shall be allocated to a person where that person has received a tag under this section for any of the previous four seasons. R-029-93,s.9; R-079-94,s.2,3; R-081-98,s.5.

13.2.

The Superintendent shall allocate a total of 30 tags for the hunting of muskox in Wildlife Management Muskox Area U/MX/01 to NR or NRA holders who have engaged the services of an outfitter. R-011-2021,s.3.

Wood Bison

14.

(1) An officer who issues a tag to hunt wood bison may require the holder of the tag, if he or she kills a wood bison, to provide

(a) any part of the wood bison required by the officer for purposes of identification; and

(b) any other requested information.

(2) The holder of a tag to hunt wood bison who is required to provide a part of a wood bison or other information under subsection (1) shall do so in accordance with the instructions provided by the officer. R-096-92,s.2; R-029-93,s.10; R-080-97,s.2; R-061-2011,s.3.

15.

(1) Each year four tags shall be available to residents through a draw, entitling residents to hunt wood bison in Wood Bison Management Areas D/W/06 and R.

(2) The draw will be subject to the following conditions:

(a) residents may participate once in each yearly draw;

(b) applications for the yearly draw may be obtained from the office of a wildlife officer after May 1;

(c) a maximum of two people may apply for one tag each on each application;

(d) applications must be post-marked before June 15 and received before the draw date;

(e) the draw shall take place no later than June 30;

(f) where 14 tags have been allocated and an application bearing two names is drawn, the applicants may choose which one of them will receive the tag;

(g) once 15 applications have been drawn, alternate applications shall be drawn and placed on a waiting list;

(h) in order to receive a tag, a successful applicant must pay the prescribed fee before July 31;

(i) where a successful applicant refuses a tag, the tag shall be offered to the next person on the waiting list;

(j) persons on the waiting list who are offered tags must pay the prescribed fee within five days.

(3) No person shall apply for a tag under subsection (1) and no tag shall be allocated to a person where that person has received a tag for any of the previous two seasons.

(4) Prior to any tags being available to residents under subsection (1), each year up to four tags shall be available to tag recipients from the 2012 draw under that subsection, provided that those former recipients continue to be eligible for a tag.

(5) Tags may be made available to residents in accordance with subsection (1) beginning the year that fewer than four tags are available to former recipients in accordance with subsection (4), however the total number of tags available under this section in any year shall not exceed four.

Caribou

16.

Where a quota for caribou is established in the Schedule, a quota is established for commercial tags under the Sale of Wildlife Regulations and the local harvesting committee responsible for the zone or area holds an outfitter licence issued under the Wildlife Business Regulations, the local harvesting committee may request the Minister to change the division of the quota between the commercial tags and the big game tags. 16.1.

No person other than the following shall hunt caribou in G/BC/03:

(a) a person eligible to be enrolled as a participant in the Gwich’in Comprehensive Land Claim Agreement;

(b) a person holding an SHL and hunting with the permission of the applicable Gwich’in local harvesting committee.

Aircraft

17.

(1) No person shall hunt caribou in Wildlife Management Barren-Ground Caribou Area R/BC/01 within 12 hours of landing in the area by means of an aircraft, including a helicopter.

(2) No person shall hunt big game in the following outfitter areas within 12 hours of landing in any of the areas by means of an aircraft, including a helicopter:

(a) D/OT/01;

(b) D/OT/02;

(c) G/OT/01;

(d) S/OT/01;

(e) S/OT/02;

(f) S/OT/03;

(g) S/OT/04;

(h) S/OT/05.

(2.1) No person shall hunt big game in Wildlife Management Muskox Area S/MX/01 within 12 hours of landing in the area by means of helicopter.

(3) Subsections (1), (2) and (2.1) do not apply to a guide who is preparing for a hunt. R-081-98,s.8; R-057-99,s.5; R-063-2007,s.4.

18.

(1) No person shall, except in an emergency, use a helicopter for transporting persons or things for the purpose of hunting or facilitating hunting or carrying wildlife in or suspended from a helicopter in Wildlife Management Barren-Ground Caribou Area R/BC/01 or U/BC/01. R-081-98,s.9; R-057-99,s.7; R-116-2014, s.17.

(2) Repealed, R-116-2014,s.17.

Tags

19.

(1) Subject to subsection (3), where a tag is required, the vendor of the hunting licence shall, when issuing the tag, record the number of the tag on the licence.

(2) Repealed, R-116-2014,s.18(2).

(3) A local harvesting committee may issue tags for the hunting of grizzly bear, polar bear, muskox, barren-ground caribou and wood bison for the area which the local harvesting committee serves.

(4) Where a local harvesting committee does not wish to issue tags under subsection (3), an officer shall issue tags for the areas indicated in the Schedule.

(5) Where a tag is issued under subsection (3) or (4) to the holder of a GHL or RES in respect of wildlife that is subject to a quota under these regulations, the issuer may stipulate a date in the open season before which the holder must use the tag, and, if the holder fails to use the tag before the stipulated date, the holder shall return the tag to the issuer and the issuer may allocate the tag to another holder of a GHL or RES.

(6) Where a tag is returned and not reissued or is unused at the end of the season, the person in possession of the tag at the end of the season shall give the tag to an officer.

(7) Repealed, R-058-2024,s.2(1).

(7.1) Where the holder of a tag for the hunting of grizzly bear or polar bear does not use the tag during a hunt, the holder of the tag shall return the unused tag to the issuer immediately following the hunt or within 15 days after the close of the season, whichever is earlier.

(8) Where the holder of a RES receives a tag for the hunting of grizzly bear in any of the following wildlife management areas and does not use the tag before the end of the season, the holder shall return the unused tag to the issuer within 15 days after the close of the season:

(a) Grizzly Bear Management Area I/GB/01, I/GB/02, I/GB/03, I/GB/04, I/GB/05 or I/GB/06;

(b) Wildlife Management Outfitter Area D/OT/01, D/OT/02, G/OT/01, S/OT/01, S/OT/02, S/OT/03, S/OT/04 or S/OT/05.

(9) The holder of a tag ceases to have any rights or privileges under the tag on the earliest of the following:

(a) if subsection (5) applies, on the date stipulated under that subsection;

(b) if subsection (7.1) applies and the hunt ends before the end of the season, immediately following the hunt;

(c) if the holder returns the tag to an issuer or gives the tag to an officer, on that date;

(d) at the close of the season.

20.

(1) The maximum number of tags that may be allocated for distribution to LHC outfitters according to this section is zero.

(2) An officer shall allocate a maximum of zero tags to the Tłı̨chǫ Government for distribution to LHC outfitters for the outfitting of barren-ground caribou hunts in Wildlife Management Barren-Ground Caribou Area R/BC/01 for the holders of non-resident and non- resident alien hunting licences.

(3) An officer shall allocate a maximum of zero tags to the local harvesting committee serving Ndilo and Dettah for distribution to LHC outfitters in Ndilo and Dettah for the outfitting of barren-ground caribou hunts in Wildlife Management Barren-Ground Caribou Area R/BC/01 for the holders of non-resident and non-resident alien hunting licences. 21.

(1) An officer shall set aside zero tags each year for the purpose of issuing tags to non-residents or non-resident aliens who have engaged the services of a non-LHC outfitter to hunt barren-ground caribou in Wildlife Management Barren-Ground Caribou Area R/BC/01 in the next season.

(2) A non-resident or non-resident alien hunter may not request more than zero tags.

(3) The maximum number of tags that may be reserved for an outfitter licence held by a non-LHC outfitter for one season is zero. 21.1.

(1) Before May 15 each year, an officer shall set aside, for allocation in accordance with subsection (2), zero tags for each outfitter licence held by a non-LHC outfitter for the purpose of issuing tags to non-residents or non-resident aliens who have engaged the services of the outfitter to hunt barren-ground caribou in Wildlife Management Barren-Ground Caribou Area R/BC/01 in the next season.

(2) Subject to subsection 21(2), on May 15 of the relevant year, if a non-LHC outfitter demonstrates to the satisfaction of an officer that he or she will be providing outfitting services to a non-resident alien to hunt barren-ground caribou in the next season, the officer shall, from the zero tags set aside for the outfitter licence under subsection (1), reserve, in the name of the outfitter who holds that licence, the appropriate number of tags requested by each of the hunters for whom the outfitter will be providing outfitting services in the next season.

(3) An officer shall hold all remaining unreserved tags under subsection 21(1) and subsection (2) of this section for allocation in accordance with section 21.2 or 21.3. 21.2.

Subject to subsections 21(2) and (3), as soon as the first reservation of tags under subsection 21.1(2) is completed, an officer shall, in respect of requests received by the officer before that day, reserve on a one by one basis any remaining unreserved tags for outfitter licences held by those non-LHC outfitters who demonstrate to the satisfaction of the officer that they will be providing outfitting services to a non-resident or a non-resident alien to hunt barren-ground caribou in the next season. 21.3.

Subject to subsections 21(2) and (3), if after tags have been allocated under subsection 21.1(2) and section 21.2 there are unreserved tags still remaining and a non-LHC outfitter demonstrates to the satisfaction of an officer that he or she will be providing outfitting services to a non-resident or a non-resident alien to hunt barren-ground caribou in the relevant season, the officer shall, on a first come first served basis, reserve additional tags for an outfitter licence held by the outfitter. 22.

(1) A person who kills a big game animal for which a tag is required shall, as soon as practicable after killing the animal and subject to subsection (3), attach the tag in a manner so that the tag cannot be reused,

(a) in the case of a bear, wolf, wolverine or muskox, to the hide;

(b) in the case of a big game animal other than those listed in paragraph (a), which was

(i) killed by an Aboriginal harvester or the holder of a GHL, SHL or RES, to the carcass, or

(ii) killed by the holder an NR or NRA, one to the horns, antlers, head or cape and one to the carcass.

(1.1) Notwithstanding paragraph 22(1)(a), a person who harvests, for its meat, a bear for which a tag is required shall, as soon as practicable after killing the animal and subject to subsection (3), attach the tag to the carcass in a manner so that the tag cannot be reused.

(2) Where applicable, the licence holder shall record such information on the tag as is required at the time the tag is attached to the animal.

(3) Where the tag is for a polar bear or muskox, and the person who killed the animal is an Aboriginal harvester or the holder of a GHL, the person may postpone compliance with subsection (1) until the hide has been cleaned, stretched and dried but the person shall produce the tag to an officer on request.

(4) No person shall remove a tag attached pursuant to this section until the animal is consumed or a process is commenced to produce a manufactured product from the animal.

(5) Subject to the Sale of Wildlife Regulations, no person shall traffic or possess big game that is required to be tagged if that big game is not tagged.

(6) Subsection (5) does not apply to the gifting of big game made in accordance with the Wildlife General Regulations. R-029-93,s.17; R-116-2014,s.22; R-001-2017,s.6; R-111-2018,s.3.

CONDITIONS

1. Tag required.

2. The limit is the number specified on the licence.

3. The hunter may hunt in any of the seasons established for this class of licence, but may take only one wolverine each year.

4. A vendor shall not issue a tag to a hunter unless the hunter provides the vendor with the written permission of each applicable HTC for the hunter to hunt wolverine in the area. For the purposes of this condition, "applicable HTC" means an HTC that has responsibility in the area in which the hunter will be hunting.
