The Commissioner, on the recommendation of the Minister, under section 11 of the Court Security Act and every enabling power, makes the Court Security Regulations.
Court Areas
The following buildings, parts of buildings and spaces are designated as court areas:
(a) the building located at 25 Portage Avenue, Fort Smith;
(b) in respect of the building located at 201-8 Capital Drive, Hay River, the second floor and the entries, stairways, elevators and passageways to the second floor except an entry or part of an entry that also provides access to the offices on the first floor;
(c) in respect of the building located at 151 Mackenzie Road, Inuvik, the third floor space allocated to the Department of Justice for the exclusive use of the courts;
(d) in respect of the building known as the Yellowknife Court House located at 4903- 49th Street, Yellowknife, the first, second and third floors.
Weapons
The following persons may possess a weapon in a court area:
(a) a security officer;
(b) a participant in a court proceeding who is
(i) required to possess the weapon for the purpose of the proceeding, or
(ii) authorized by the presiding judge to possess the weapon for the purpose of the proceeding;
(c) an employee of the Department of Justice who possesses the weapon in the course of his or her employment.
A security officer may use the following search methods to screen a person for weapons:
(a) scanning the person’s body with an electronic metal-detector;
(b) requiring the person to pass through an electronic metal-detector;
(c) using a fluoroscope to view the exterior and interior of clothing or of any bag, briefcase or other thing carried by the person, but not attached to his or her body;
(d) requiring the person to empty the contents of his or her pockets, or of any bag, briefcase or other thing carried by the person, and examining the contents.
Restricted Personnel Zone
(1) A part of a court area that has its entrance marked with a sign described in subsection (2) is designated as a restricted personnel zone.
(2) A sign identifying an entrance to a restricted personnel zone must read "Authorized Personnel Only/Réservé au personnel autorisé".
(3) A sign referred to in subsection (1) may also include the required information in another language.
The following persons may enter restricted personnel zones:
(a) a judge, justice of the peace, judicial officer or member of the judicial support staff;
(b) a security officer;
(c) a juror, if the restricted personnel zone is a jury room or a passageway or other area for the use of jurors;
(d) a person authorized to enter a restricted personnel zone by a person referred to in paragraph (a) or (b).
Restricted Equipment Zone
(1) A part of a court area designated in section 1 is also designated as a restricted equipment zone if it is so identified by a sign described in subsection (2).
(2) A sign referred to in subsection (1) must
(a) be in English and French;
(b) be posted at each public entrance to the restricted equipment zone; and
(c) state that the use of the following is prohibited:
(i) cameras,
(ii) cell phones,
(iii) recording devices.
(3) A sign described in subsection (2) may also include
(a) the required information in another language; and
(b) symbols indicating that the equipment referred to in paragraph (2)(c) may not be used.
(1) A part of a court area that is not designated as a court area in section 1, is designated as a restricted equipment zone if it is so identified on a sign described in subsection (2).
(2) A sign referred to in subsection (1) must
(a) be in English and French;
(b) be posted at each public entrance to the restricted equipment zone; and
(c) state that the use of the following is prohibited:
(i) cameras,
(ii) cell phones,
(iii) recording devices.
(3) A sign described in subsection (2) may also include
(a) the required information in another language; and
(b) symbols indicating that the equipment referred to in paragraph (2)(c) may not be used.
The following persons may use cameras, cell phones and recording devices in a restricted equipment zone:
(a) a judge, judicial officer or justice of the peace;
(b) a security officer;
(c) a person authorized to use a camera, cell phone or recording device in the zone by a person referred to in paragraph (a) or (b).
