The Commissioner, on the recommendation of the Minister, under section 50 of the Public Health Act and every enabling power, makes the Disease Surveillance Regulations.
Interpretation
In these regulations,
"health care number" means an identifying number, symbol or other particular assigned to a person in respect of health services or health information; (numéro de soins de santé)
"health facility" means a facility that provides health services pursuant to the Hospital Insurance and Health and Social Services Administration Act; (établissement de santé)
"outbreak" means an increase in the number of cases of a disease above the expected rate; (éclosion)
"register" means a register established by the Chief Public Health Officer under subsection 24(1) of the Act. (registre) R-075-2016,s.2; R-073-2023,s.2.
Notifiable Diseases and Conditions
The diseases and conditions that are listed or referred to in Schedule 1 are prescribed as notifiable diseases or conditions.
(1) If a health care professional diagnoses a notifiable disease or condition in a person, or is of the opinion, on reasonable grounds, that a person who the health care professional examines or treats has a notifiable disease or condition, the health care professional shall provide the following information to the Chief Public Health Officer:
(a) the name, place of residence, place of birth, date of birth, ethnicity, sex assigned at birth and health care number of the person;
(b) in the case of a notifiable disease or condition listed in Part 2 of Schedule 1, the name, place of residence, place of birth, date of birth, ethnicity and health care number of each biological parent of the person;
(c) the name of the notifiable disease or condition;
(d) the clinical and epidemiological details relevant to the diagnosis and treatment;
(e) the name and profession of, and the contact information for
(i) the health care professional who made the diagnosis or formed the opinion, and
(ii) the person providing the information, if other than the health care professional;
(f) any additional information the Chief Public Health Officer requires in respect of the person or the notifiable disease or condition, for the purposes of public health surveillance and health promotion.
(2) A requirement to provide any of the information referred to in subsection (1) does not apply if the Chief Public Health Officer determines that the information is not required in respect of a particular notifiable disease or condition.
(3) The information referred to in this section must be provided within three months after the day the diagnosis is made or the opinion is formed, in a form and manner approved by the Chief Public Health Officer. R-073-2023,s.3.
Notifiable Tests
The tests listed in Schedule 2 for notifiable diseases or conditions are prescribed as notifiable tests.
(1) If a health care professional performs a notifiable test, or causes a notifiable test to be performed, the health care professional shall provide the following information to the Chief Public Health Officer:
(a) the name, place of residence, place of birth, date of birth, ethnicity, sex assigned at birth and health care number of the person in respect of whom the test is conducted;
(b) the result of the test;
(c) the name and profession of, and the contact information for
(i) the health care professional who performed the test or caused the test to be performed, and
(ii) the person providing the information, if other than the health care professional;
(d) any additional information the Chief Public Health Officer requires in respect of the test or the person being tested, for the purposes of public health surveillance and health promotion.
(2) A requirement to provide any of the information referred to in subsection (1) does not apply if the Chief Public Health Officer determines that the information is not required
(a) in respect of a particular notifiable test; or
(b) for a negative result in respect of a particular notifiable test.
(3) The information referred to in this section must be provided within three months after the day the result is obtained, in a form and manner approved by the Chief Public Health Officer. R-073-2023,s.4.
Reportable Diseases
The communicable diseases and other health conditions listed in Schedule 3 are prescribed as reportable diseases.
(1) In this section and section 8, "Communicable Disease Manual" means the NWT Communicable Disease Manual, established by the Chief Public Health Officer, as amended from time to time.
(2) If a health care professional diagnoses a reportable disease or condition in a person, or is of the opinion, on reasonable grounds, that a person who the health care professional examines or treats has a reportable disease or condition, the health care professional shall, in accordance with this section and unless otherwise directed by the Chief Public Health Officer, provide the Chief Public Health Officer with the information required by the Communicable Disease Manual for that disease or condition.
(3) If the health care professional diagnoses or forms an opinion that a person is infected with a disease listed in Part 1 of Schedule 3, the health care professional shall
(a) immediately notify the Chief Public Health Officer by telephone of the diagnosis or opinion; and
(b) provide the information referred to in subsection (2) within 24 hours after the diagnosis is made or the opinion is formed, in the form and manner set out in the Communicable Disease Manual, unless otherwise directed by the Chief Public Health Officer.
(4) If the health care professional diagnoses or forms an opinion that a person is infected with a disease listed in Part 2 of Schedule 3, the information referred to in subsection (2) must be provided within 24 hours after the diagnosis is made or the opinion is formed, in the form and manner set out in the Communicable Disease Manual, unless otherwise directed by the Chief Public Health Officer.
(5) If the health care professional diagnoses or forms an opinion that a person is infected with a disease listed in Part 3 of Schedule 3, the information referred to in subsection (2) must be provided within seven days after the diagnosis is made or the opinion is formed, in the form and manner set out in the Communicable Disease Manual, unless otherwise directed by the Chief Public Health Officer.
(6) A person in charge of a health facility where a person with a reportable disease or suspected reportable disease is examined, tested or treated shall take the necessary measures to ensure that the information referred to in subsection (2) is provided to the Chief Public Health Officer in accordance with these regulations, and shall provide the Chief Public Health Officer with the required information within the required time if circumstances prevent a health care professional from doing so. (1) If a health care professional performs or interprets a diagnostic imaging test or other medical diagnostic test in a health facility or medical laboratory, and is of the opinion, on reasonable grounds, that the result indicates that the subject of the test has a reportable disease, the health care professional shall, in accordance with this section and unless otherwise directed by the Chief Public Health Officer, provide the Chief Public Health Officer with the information required by the Communicable Disease Manual for that disease or condition.
(2) If the health care professional is of the opinion that the test result indicates that the subject has a reportable disease listed in Part 1 of Schedule 3, the health care professional shall
(a) immediately notify the Chief Public Health Officer by telephone of the test result and opinion; and
(b) provide the information referred to in subsection (1) within 24 hours after the opinion is formed, in the form and manner set out in the Communicable Disease Manual, unless otherwise directed by the Chief Public Health Officer.
(3) If the health care professional is of the opinion that the test result indicates that the subject has a reportable disease listed in Part 2 of Schedule 3, the information referred to in subsection (1) must be provided within 24 hours after the opinion is formed, in the form and manner set out in the Communicable Disease Manual, unless otherwise directed by the Chief Public Health Officer.
(4) If the health care professional is of the opinion that the test result indicates that the subject has a reportable disease listed in Part 3 of Schedule 3, the information referred to in subsection (1) must be provided within seven days after the opinion is formed, in the form and manner set out in the Communicable Disease Manual, unless otherwise directed by the Chief Public Health Officer. Reportable Tests
The tests listed in Schedule 4 for reportable diseases are prescribed as reportable tests.
(1) If a health care professional performs a reportable test, or causes a reportable test to be performed, the health care professional shall provide the following information to the Chief Public Health Officer:
(a) the name, place of residence, place of birth, date of birth, ethnicity, sex assigned at birth and health care number of the person in respect of whom the test is conducted;
(b) the result of the test;
(c) the name and profession of, and the contact information for
(i) the health care professional who performed the test or caused the test to be performed, and
(ii) the person providing the information, if other than the health care professional;
(d) any additional information the Chief Public Health Officer requires in respect of the test or the person being tested, for the purposes of public health surveillance and health protection.
(2) A requirement to provide any of the information referred to in subsection (1) does not apply if the Chief Public Health Officer determines that the information is not required
(a) in respect of a particular reportable test; or
(b) for a negative result in respect of a particular reportable test.
(3) The information referred to in this section must be provided within three months after the day the result is obtained, in a form and manner approved by the Chief Public Health Officer. R-073-2023,s.6.
If the Chief Public Health Officer is of the opinion that there has been an outbreak of a reportable disease that does not have a reportable test, the Chief Public Health Officer may, with respect to that disease, require health care professionals to report disease test numbers and results to the Chief Public Health Officer
(a) immediately after a test result is confirmed; and
(b) in a form and manner approved by the Chief Public Health Officer.
Registers
(1) The following registers, established by the Chief Public Health Officer, must be maintained in a form satisfactory to the Chief Public Health Officer:
(a) the Cancer Register;
(b) the Cancer Screening Register;
(c) the Congenital Anomalies Register;
(d) the Chronic Disease Register;
(e) the Reportable Diseases Register;
(f) any other register established by the Chief Public Health Officer under section 24 of the Act.
(2) The Chief Public Health Officer shall ensure that registers are updated regularly to include information provided in respect of
(a) notifiable diseases or conditions;
(b) notifiable tests;
(c) reportable diseases; and
(d) reportable tests.

Food Establishment Workers
(1) A food establishment worker, as defined in the Food Establishment Safety Regulations, who is infected with or has been exposed to a disease listed in Schedule 5, shall not perform any function in a food establishment that involves contact with food, food contact surfaces, equipment, utensils, other food establishment workers who perform such functions or clients.
(2) The prohibition set out in subsection (1) terminates in respect of a food establishment worker upon
(a) written confirmation from a medical practitioner that the worker is not infected with the disease;
(b) proof of a valid negative test result for the disease, performed on the worker after the date the worker was infected with or exposed to the disease; or
(c) written authorization from the Chief Public Health Officer.
