The Minister, under subsection 7(1) and section 34 of the Agricultural Products Marketing Act and every enabling power, makes the Egg Marketing Plan Establishment Regulations.

ESTABLISHMENT REGULATIONS

1.

In these regulations,

"Act" means the Agricultural Products Marketing Act; (Loi)

"eggs" means eggs of a domestic hen, excluding hatching eggs, produced in the Territories; (oeufs)

"hatching eggs" means eggs of a hen produced in the Territories for the purpose of hatching into chicks not intended to be grown into broiler chickens or roaster chickens; (oeufs d’incubation)

"hen" means a hen belonging to the species gallus domesticus; (poule)

"plan" means the Northwest Territories Egg Producers’ Plan established by section 2; (plan)

"producer" means a person who produces or who has demonstrated an intention to produce eggs; (producteur)

"producer board" means the Northwest Territories Egg Producers established by section 3. (organisation des producteurs)

(1) The Northwest Territories Egg Producers’ Plan is hereby established for the regulation of the marketing of eggs in the Territories.

(2) Eggs are designated as the agricultural product to be regulated under the plan.

A producer board known as the Northwest Territories Egg Producers is hereby established as a corporation with the following powers, which it may exercise to enable it to perform its functions under the Act and the regulations made under the Act:

(a) to acquire and to exercise any licence, power, authority, concession, right or privilege that any government or authority or any corporation or other public body may be empowered to grant and to contribute towards carrying it into effect and to assume any liabilities or obligations incidental to it and notwithstanding the generality of the foregoing, to implement the plan and the regulations made under the Act;

(b) to enter into co-operative arrangements with a marketing board in any province or territory and with the Canadian Egg Marketing Agency to benefit the producer board in carrying out the purposes of the plan, including the acceptance of delegated authorities from the Canadian Egg Marketing Agency, co-operating in the delegation of similar authority from the Government of the Northwest Territories and entering into and carrying out the provisions of any service agreements relating to the delegation of authority;

(c) to purchase, lease, contract for or otherwise acquire any personal property and any rights or privileges that the producer board considers necessary or convenient for the purposes of the plan;

(d) to take, hold and alienate real and personal property that has been mortgaged to the producer board by way of security for or conveyed to it in satisfaction of debts or other obligations;

(e) to draw, make, accept, endorse, discount, execute and issue bills of exchange, promissory notes, bills of lading, warrants and other negotiable or transferable instruments;

(f) to sell, lease, exchange or otherwise dispose of all or substantially all the property of the producer board for such consideration as the producer board thinks fit;

(g) to pay all costs and expenses of or incidental to the establishment, organization and administration of the producer board;

(h) to invest and deal with the money of the producer board not immediately required for the purposes of the plan;

(i) within its constitutional authority, to exercise its powers beyond the boundaries of the Territories and to accept extra- territorial powers and rights;

(j) to borrow money on the credit of the producer board;

(k) to charge, mortgage, hypothecate or pledge all or any currently owned or subsequently acquired real or personal, movable or immovable property of the producer board, including book debts, rights and powers to secure any debt obligation or any money borrowed or other debt obligation of the producer board;

(l) to provide in its by-laws for the indemnification and saving harmless of its members, directors and officers to the extent those persons are not liable by reason of section 18(1) of the Act and paragraph 17(d) of the Interpretation Act;

(m) to enact by-laws providing for its organization, structure and administration.

(1) Responsibility for the administration of the plan is hereby assigned to the Northwest Territories Egg Producers.

(2) The plan must be administered in accordance with the Act and the regulations made under the Act.

The Northwest Territories Egg Producers shall be composed of no less than three and no more than seven members.

6.

Every producer and every person engaged in the marketing of eggs shall register with the Northwest Territories Egg Producers by completing a registration in the form set out in the Schedule and filing it at the office of the Northwest Territories Egg Producers on or before March 31, 1999.
