The Commissioner, on the recommendation of the Minister, under section 83 of the Judicature Act and every enabling power, makes the Examination Fees Regulations.
In these regulations, "examiner" means a person who
(a) is an examiner as defined in rule 234 of the Rules of the Supreme Court of the Northwest Territories; or
(b) is a court reporter authorized to perform the duties of an examiner under rule 722 of the Rules of the Supreme Court of the Northwest Territories.
These regulations apply where the examiner is acting in the context of his or her employment as a member of the public service.
A person who books an appointment for an examiner to attend on and take down an oral examination made under oath pursuant to rules in respect of civil matters that are made by the Supreme Court shall pay to the Government of the Northwest Territories the following fees:
(a) $200 for the first half-day, or portion of a half-day, during which attendance is required or the examination is taken down and $50 for each hour, or portion of an hour, after the first half-day; or
(b) if the appointment is cancelled 48 hours or less before the appointment and no evidence has been taken, a cancellation fee of $200.
