The Commissioner, on the recommendation of the Minister, under section 83 of the Judicature Act and every enabling power, makes the Fees and Allowances Regulations.

Amounts Payable to Interpreters and Translators

1.

(1) Subject to subsection (3), a person who requires an interpreter for the hearing of a civil action or proceeding in the Supreme Court or the Territorial Court shall pay the interpreter the applicable fee set out in Schedule A.

(2) Subject to subsection (3), if an interpreter is required for the hearing of a criminal action or proceeding in the Supreme Court or the Territorial Court, the court shall pay the interpreter the applicable fee set out in Schedule A.

(2.1) Notwithstanding subsection (2) but subject to subsection (3), the Director of Court Services or, if authorized by the Director, a clerk of the court may increase the amount of the fee payable to an interpreter in respect of an action or proceeding to an amount not exceeding $400 each day, if the Director or the clerk, as the case may be, considers it necessary and appropriate to increase the fee.

(3) The fees set out in Schedule A are not payable

(a) to an interpreter who is employed as an interpreter or translator by the Government of the Northwest Territories, if his or her services are provided in the course of that employment; or

(b) for services that are provided under a contract with the Government of the Northwest Territories for the provision of interpretation services.

(4) In Schedule A, “certified interpreter” means an individual who has been certified as an interpreter by the Department of Justice or has successfully completed an interpreter training course delivered by Aurora College. R-113-98,s.2,3; R-049-2012,s.2,3.

(1) A person who requires a translator in respect of a civil action or proceeding in the Supreme Court or the Territorial Court shall pay the translator the applicable fee set out in Schedule A.

(2) Subject to subsection (3), if a translator is required in respect of a criminal action or proceeding in the Supreme Court or the Territorial Court, the court shall pay the translator the applicable fee set out in Schedule A.

(3) The fees set out in Schedule A are not payable to a translator who is employed as an interpreter or translator by the Government of the Northwest Territories, if his or her services are provided in the course of that employment. R-049-2012,s.2,4.

Amounts Payable to Expert Witnesses

If a witness is qualified as an expert in a criminal action or proceeding in the Supreme Court or the Territorial Court, the court shall pay the witness the applicable fee set out in Schedule B. R-024-2000,s.2; R-049-2012,s.5.
