(1) The minimum limits of coverage in a motor vehicle liability policy for a motor vehicle with a maximum seating capacity set by the manufacturer of 10 persons or less, including the driver’s seat, that is used as a school bus are, in respect of any one accident and exclusive of interest and costs,

(a) $1,000,000, against liability resulting from

(i) bodily injury to or the death of one or more persons, and

(ii) the loss of or damage to property; and

(b) $1,000,000, of passenger hazard coverage for liability resulting from

(i) bodily injury to or the death of one or more passengers in the motor vehicle, and

(ii) the loss of or damage to property of one or more passengers in the motor vehicle.

(1.1) The minimum limits of coverage in a motor vehicle liability policy for a motor vehicle with a maximum seating capacity set by the manufacturer of more than 10 persons, including the driver’s seat, that is used as a school bus are, in respect of any one accident and exclusive of interest and costs,

(a) $1,000,000, against liability resulting from

(i) bodily injury to or the death of one or more persons, and

(ii) the loss of or damage to property; and

(b) $2,000,000 of passenger hazard coverage for liability resulting from

(i) bodily injury to or the death of one or more passengers in the motor vehicle, and

(ii) the loss of or damage to property of one or more passengers in the motor vehicle.

(2) The contract of insurance with respect to the passenger hazard coverage must provide that

(a) claims against the insured arising out of bodily injury or death have priority to the extent of 95% of the total passenger hazard coverage over claims arising out of loss of or damage to property; and

(b) claims against the insured arising out of loss of or damage to property have priority to the extent of 5% of the total passenger hazard coverage over claims arising out of bodily injury or death.

The standard of financial responsibility with respect to the parking and operation of a motor vehicle registered under the laws of an extra-territorial jurisdiction is

(a) a motor vehicle liability policy that is in force and that evidences a contract that insures the owner of the motor vehicle against liability resulting from bodily injury to or the death of one or more persons and the loss of or damage to property at least to the limits of section 144 of the Insurance Act, in respect of any one accident involving the motor vehicle; or

(b) a compensation scheme, established by legislation of the jurisdiction in which the motor vehicle is registered, that provides, in respect of any one accident involving the motor vehicle, compensation for bodily injury to or the death of one or more persons and the loss of or damage to property

(i) at least to the limits of section 144 of the Insurance Act, and

(ii) in the circumstances provided in a motor vehicle liability policy issued in the Northwest Territories.

The standard of financial responsibility with respect to the parking and operation of a trailer that is a commercial registered under the laws of an extra-territorial jurisdiction is

(a) a motor vehicle liability policy that is in force and that evidences a contract that insures the owner of the motor vehicle that tows the trailer against liability resulting from bodily injury to or the death of one or more persons and the loss of or damage to property at least to the limits of section 144 of the Insurance Act, in respect of any one accident involving the trailer; or

(b) a compensation scheme, established by legislation of the jurisdiction in which the motor vehicle towing the trailer is registered, that provides, in respect of any one accident involving the trailer, compensation for bodily injury to or the death of one or more persons and the loss of or damage to property

(i) at least to the limits of section 144 of the Insurance Act, and

(ii) in the circumstances provided by a motor vehicle liability policy issued in the Northwest Territories.

The document to be located inside a motor vehicle registered under the laws of an extra-territorial jurisdiction under paragraph 56(1)(c) or (d) of the Act is

(a) if the motor vehicle is covered by a motor vehicle liability policy, the document issued by the insurer or the agent of the insurer setting out information about the policy required to be carried in the motor vehicle under the laws of the jurisdiction in which the motor vehicle is registered; and

(b) if the motor vehicle is covered by a compensation scheme established by legislation of the jurisdiction in which the motor vehicle is registered, the document in respect of that scheme required to be carried in the motor vehicle under the laws of that jurisdiction.

The owner of a motor vehicle applying for a registration permit may establish that he or she meets the standards of financial responsibility established by sections 2 and 3 by submitting,

(a) if the motor vehicle is covered by a motor vehicle liability policy,

(i) a document described in paragraph 4(a), or

(ii) a copy of the motor vehicle liability policy; and

(b) if the motor vehicle is covered by a compensation scheme established by legislation of the jurisdiction in which the motor vehicle is registered,

(i) the document in respect of that scheme required to be carried in the motor vehicle under the laws of that jurisdiction, and

(ii) if required by the Registrar, copies of the legislation.
