In this order, "Authority" means the Fort Smith Housing Authority, continued under section 2.
The housing authority called the Fort Smith Housing Authority, incorporated to operate within the municipal limits of the Town of Fort Smith, is continued.
The Authority shall be composed of not less than five and not more than 10 members.
The members of the Authority shall manage the affairs of the Authority and conduct its business, and for this purpose every member has one vote.
A majority of the members may designate any member, other than the chairperson or vice-chairperson, as an officer of the Authority where they consider it necessary for the proper conduct of the business of the Authority.
The office of the Authority shall be in the Town of Fort Smith.
The Authority may make by-laws governing the conduct of the business of the Authority, but no such by-law is effective until it is approved by Housing Northwest Territories. R-079-2023,s.2.
The Authority shall manage, operate and administer the housing projects that are lawfully assigned to it.
The Authority may, in addition to exercising its powers under the Interpretation Act,
(a) acquire and hold, by way of lease or otherwise, such lands and buildings as may be necessary for the proper management, operation and administration of any housing project that may be lawfully assigned to it;
(b) maintain, repair and renovate the buildings comprising any housing project under its management and control;
(c) let and sublet land or premises held by it or parts of land or premises in accordance with terms of leases, the forms of which have been approved by Housing Northwest Territories; and
(d) employ, on the terms and conditions that the Authority may determine, any officer designated under section 5 and any person that the Authority considers necessary to discharge its responsibilities.
The Authority may from time to time enter into agreements assuming the management, operation and administration of such additional housing projects in the area of its authority as may be constructed under the National Housing Act (Canada).
