Interpretation and Application R-054-2015,s.2.
In these regulations,
"Act" means the Gas Protection Act; (Loi)
"appliance" means a device to convert gas into energy and includes any component, control, wiring, piping or tubing required to be part of the device; (appareil)
"certified gas fitter" means a gas fitter who is registered as a certified gas fitter under section 22.2; (monteur d’installations de gaz qualifié)
"Code" means a code or standard adopted under section 2; (code)
"distribution line" means a pipeline in a distribution system that conveys gas to individual service lines or other distribution lines; (ligne de distribution)
"distribution system" means the distribution and service lines, and their associated control devices, through which gas is conveyed from transmission lines or from local sources of supply to a customer; (réseau de distribution)
"gas fitting work" includes the installation, repair, alteration or removal of any gas equipment or gas installation; (travaux de montage d’installations de gaz)
"gathering line" means a pipeline that conveys gas from a wellhead assembly to a treatment plant, transmission line, distribution line or service line; (réseau de collecte)
"permanent installation" means any gas equipment or gas installation installed permanently or for an indefinite period of time; (installation permanente)
"permit" or "gas permit" means a permit issued under these regulations; (permis) or (permis pour le gaz)
"prescribed" means prescribed by these regulations; (version anglaise seulement) "service line" means a pipeline that conveys gas from a gathering line, transmission line, distribution line or another service line to a customer; (conduite de branchement)
"supplier" means a person or a partnership, including the officers, employees or agents of a corporation, engaged in the commercial supply of gas; (fournisseur)
"temporary installation" means gas equipment or gas installation installed and operated for a temporary period of time; (installation temporaire)
"transmission line" means a pipeline that conveys gas from a gathering line, treatment plant, storage facility or field collection point in a gas field to a distribution line, service line, storage facility or another transmission line; (canalisation de transport)
"USWG" means United States Water Gallon. R-095-95,s.2; R-061-2025,s.2.
For the purposes of these regulations, premises that are used for both residential and non-residential purposes are deemed to be non-residential premises. RRNWT 1990,c.G-1(Supp.),s.2; R-095-95,s.3.
These regulations do not apply to a propane or natural gas prime mover for a generator installed outdoors. R-054-2015,s.3.
Codes R-061-2025,s.3.
(1) For the purposes of subsection 9(2) of the Act and subject to subsection (2), the following codes of rules or standards respecting gas fitting work, gas equipment and gas installations are adopted, as amended from time to time:
(a) CSA B51 Boiler, Pressure Vessel, and Pressure Piping Code;
(b) CSA B137.4 Polyethylene Piping Systems for Gas Service;
(c) CSA Z276 Liquefied Natural Gas (LNG) - Production, Storage and Handling;
(d) CSA Z662 Oil and Gas Pipeline Systems;
(e) CSA B149.1 Natural Gas and Propane Installation Code;
(f) CSA B149.2 Propane Storage and Handling Code;
(g) CSA B149.3 Code for the Field Approval of Fuel-Related Components on Appliances and Equipment;
(h) CSA B149.5 Installation Code for Propane Fuel Systems and Containers on Motor Vehicles.
(2) These regulations prevail in the event of a conflict with a Code, to the extent of the conflict. R-061-2025,s.3.
Gas Equipment R-061-2025,s.3.
The Chief Inspector may accept as inspected and approved, any gas equipment that has been tested and listed by a certification organization accredited by the Standards Council of Canada. R-061-2025,s.3.
Repealed, R-095-95,s.5.
Any amendment to, variation or new edition of a Code shall be of the same force and effect as the original Code.
Prohibitions
(1) No person shall perform any gas fitting work
(a) except in accordance with the applicable Code; and
(b) unless the person holds a valid permit authorizing that gas fitting work.
(2) Notwithstanding paragraph (1)(b), a person does not require a permit to install or replace a propane tank or container on residential premises if the tank or container has a volume less than 435 L (115 USWG).
(3) Notwithstanding paragraph (1)(b), a certified gas fitter does not require a permit to perform gas fitting work if
(a) the gas fitting work does not require disconnecting the supply of gas; and
(b) an inspector is satisfied that the gas fitting work is of a minor nature and has given permission to the certified gas fitter to perform the work.
No person shall connect gas to any gas equipment or gas installation which has been subject to gas fitting work under authority of a permit unless permission to do so has been given by an inspector under section 25.
No person shall install, place, erect or operate any equipment, apparatus, material, device or other thing in a manner that will interfere with the use, operation, maintenance, repair, placement or replacement of a gas installation or gas equipment.
No person shall manufacture, install, sell, display, advertise or offer for sale any new gas equipment unless
(a) it bears a label of a testing organization certifying conformance with a standard acceptable to an inspector;
(b) it is listed in the Canadian Gas Association Directory of approved gas burning appliances; or
(c) it is approved in writing by the Chief Inspector.
No supplier shall supply to a gas installation natural gas which contains heavy hydrocarbons, crude oil, water or any material which could
(a) damage pipelines;
(b) interfere with gas transmission; or
(c) create a hazard to persons or property.
(1) No person shall install an appliance having a rated input in excess of 400,000 British Thermal Units each hour without obtaining the prior approval of an inspector in addition to any permit required by these regulations.
(2) An application for approval under subsection (1) shall be in writing and include such relevant information as the inspector may require.
(3) As a condition of approval, the inspector may require the appliance to pass a performance test.
Every person who owns or controls gas equipment or a gas installation shall maintain it in a safe condition.
Permits
Every holder of a permit issued under these regulations is subject to the provisions of these regulations and to such conditions as may be endorsed on or attached to the permit.
An inpsector may, upon payment of the prescribed fee, issue a permit authorizing the permit holder to perform the gas fitting work or to operate the gas equipment endorsed on the permit. RRNWT 1990, c.G-1(Supp.),s.3; R-095-95,s.6.
A permit issued under these regulations that authorizes gas fitting work must identify the type of gas equipment or gas installation in respect of which the work is authorized to be performed. R-061-2025,s.7.
(1) Subject to section 19 and subsection (2) of this section, a permit is valid for a period of one year.
(2) An inspector may grant one or more extensions of a permit for an additional period of up to six months from the expiration date of the permit.
(3) No fee is payable for an extension of a permit under subsection (2). R-061-2025,s.7.
(1) No person shall be issued a permit unless the person is a certified gas fitter.
(2) Notwithstanding subsection (1), a person may be issued a permit to perform gas fitting work in respect of a residential premises if they satisfy an inspector that
(a) they own the premises;
(b) the premises’ only residence is one detached, single-family dwelling;
(c) the owner, or a member of the owner’s immediate family,
(i) resides in the residence or plans to reside in the residence upon completion of the work, and
(ii) plans to reside in the residence for a minimum of one year after completion of the work;
(d) no person, other than the owner or a member of the owner’s immediate family, rents or resides in any part of the premises;
(e) the owner will do the gas fitting work themselves; and
(f) the owner will assume full responsibility for safety and adherence to these regulations.
(3) An owner of a residential premises who performs gas fitting work under subsection (2) shall ensure that no person, other than the owner or a member of the owner’s immediate family, rents or resides in any part of the premises for a minimum of one year after completion of the work. An owner of a residential premises shall not hold more than one permit under subsection 14(2) at any one time. R-061-2025,s.9.
(1) An inspector may issue a permit for a temporary installation, subject to such conditions, including period of operation, as the inspector may deem necessary.
(2) No person shall operate a temporary installation for more than 90 days from the date of application for the permit, unless an inspector has granted that person an extension under subsection (3).
(3) An inspector may grant an extension to the period of operation of a temporary installation for a further period of up to 90 days.
(4) Upon the expiry of the authorized period of temporary operation, the permit holder shall be responsible for ensuring that the supply of gas to the temporary installation is disconnected.
(1) Notwithstanding subsection 14(1), in those parts of the Northwest Territories where a certified gas fitter may not be available, an inspector may issue a permit to a person demonstrating knowledge and experience in work similar to gas fitting.
(2) A permit issued under subsection (1) must be limited to gas fitting work in respect of a residential premises whose only residence is one detached, single-family dwelling. RRNWT 1990,c.G-1(Supp.), s.5; R-095-95,s.7; R-015-2013,s.2; R-061-2025,s.10(2).
Every person who undertakes gas fitting work and becomes aware of a violation of a Code shall promptly report the violation to an inspector.
(1) Unless the work as listed on a permit is commenced within six months from the date of issue, the permit will expire.
(2) An inspector may, on the request of a permit holder, delay the expiry of the permit for up to six months.
All plans and specifications for a gas installation in proposed multi-family or non-residential premises shall be reviewed and approved by an inspector before the issue of the permit. R-095-95,s.8.
A permit shall not be transferred from one person to another without the prior written authorization of an inspector.
An inspector may refuse to issue a permit to an applicant if
(a) the applicant has not, in the opinion of the inspector, satisfactorily completed gas fitting work that is authorized under an existing permit; or
(b) the applicant has failed to pay a fee required under the Act or these regulations.

Registration of Certified
Gas Fitters
A gas fitter may apply to the Chief Inspector for registration as a certified gas fitter by submitting an application in the approved form together with the prescribed fee. RRNWT 1990,c.G-1(Supp.),s.7.
(1) The Chief Inspector shall register a gas fitter as a certified gas fitter if
(a) the gas fitter has submitted an application in accordance with section 22.1; and
(b) the gas fitter holds
(i) a certificate of qualification for gas fitting issued under the Apprenticeship and Trade Certification Act, or
(ii) a certificate of qualification for gas fitting from a jurisdiction outside the Northwest Territories that the Chief Inspector considers equivalent to the certificate referred to in sub- paragraph (i).
(2) The Chief Inspector may register a gas fitter as a certified gas fitter on the terms and conditions the Chief Inspector considers appropriate. RRNWT 1990, c.G-1(Supp.),s.7; R-015-2013,s.4.
(3) Repealed, R-105-95,s.3.
The Chief Inspector shall keep a register in which shall be entered the names and addresses of gas fitters who are registered under section 22.2 and other information that the Chief Inspector considers appropriate. RRNWT 1990,c.G-1(Supp.),s.7.
(1) The Chief Inspector shall issue a certificate of registration to a gas fitter registered under section 22.2.
(2) The Chief Inspector shall endorse on a certificate of registration the date of expiry and the terms and conditions of registration.
(3) A certificate of registration expires three years from the day on which it is issued.
(4) A certificate of registration is not transferable. RRNWT 1990,c.G-1(Supp.),s.7; R-105-95,s.4.
Inspection
(1) Every permit holder shall give sufficient notice to an inspector when the gas equipment or gas installation may be conveniently inspected before rendered inaccessible, or if it will not be rendered inaccessible, at the completion of the gas fitting work.
(2) No permit holder shall render gas equipment or a gas installation inaccessible before an inspection unless permission to do so has been given by an inspector.
An inspector may
(a) carry out an inspection of any gas fitting work or gas equipment or gas installation upon being given notice under section 23;
(b) carry out an inspection of any gas fitting work or gas equipment or gas installation at any reasonable time after giving adequate notice;
(c) carry out a performance test, or cause a performance test to be made, of any gas fitting work, gas equipment or gas installation; or
(d) in the event it is impractical to carry out an inspection personally, use any other reasonable means to determine the condition of any gas fitting work, gas equipment or gas installation.
If an inspector is satisfied that any gas fitting work, gas equipment or gas installation conforms to the provisions of these regulations, the inspector shall give permission to the permit holder, the owner of the equipment or installation, or the supplier, as the case may be, to connect gas to the equipment or installation. If an inspector is of the opinion that any gas fitting work, gas equipment or gas installation is not in a safe condition or does not conform to any provision of these regulations, the inspector shall
(a) notify the owner of the equipment or installation to put it in a safe condition within such time as the inspector allows;
(b) order the owner not to use gas in the equipment or installation;
(c) disconnect the supply of gas to the equipment or installation;
(d) order the adoption of such practices as will in the opinion of the inspector make the equipment or installation safe for use;
(e) instruct the supplier to withhold the supply of gas to the premises in or upon which the equipment or installation is found until it is put in a condition satisfactory to the inspector; or
(f) require the gas fitter or owner of the premises where the equipment or installation is located to make any changes necessary to bring them into conformity with the Act or these regulations.
If an inspector requires a deficiency in gas equipment or a gas installation to be corrected under paragraph 26(a) or (f), the inspector may later re- inspect the equipment or installation, and the gas fitter responsible for the deficiency shall, if required by the inspector, pay the prescribed fee for the re-inspection. Appeal
(1) A person aggrieved by a decision or order of an inspector may appeal to the Chief Inspector by serving a written notice of appeal on the Chief Inspector within 30 days of receiving notice of the decision or order or within such further period of time as the Chief Inspector may allow.
(2) The notice of appeal must
(a) state the grounds of appeal; and
(b) provide the appellant’s address for service. RRNWT 1990,c.G-1(Supp.),s.8.
(1) The Chief Inspector shall, within 30 days of being served with a notice of appeal under subsection 26.2(1),
(a) make investigations and hear evidence that the Chief Inspector considers necessary to review and consider the appeal;
(b) vary, revoke or confirm the decision or order under appeal; and
(c) cause a copy of their decision to be served on the appellant.
(2) Pending disposition of an appeal under this section, the order or decision of the inspector continues to apply. RRNWT 1990,c.G-1(Supp.),s.8; R-061-2025,s.14.
(1) A person aggrieved by a decision or order of the Chief Inspector may appeal to the Supreme Court.
(2) A person who appeals a decision or order of the Chief Inspector shall, within 30 days of receiving notice of the decision or order,
(a) file a notice of appeal with the Supreme Court; and
(b) serve a copy of the notice of appeal on the Chief Inspector.
(3) Subject to these regulations, an appeal to the Supreme Court shall be made in the same manner as an appeal from a decision of the Territorial Court in a civil matter, with such modifications as the Supreme Court considers necessary.
(4) Pending disposition of an appeal under this section, the decision or order of the Chief Inspector continues to apply. RRNWT 1990, c.G-1(Supp.),s.8.
(1) After hearing an appeal, the Supreme Court may vary, revoke or confirm the decision or order of the Chief Inspector.
(2) The decision of the Supreme Court on appeal is final and binding on all parties. RRNWT 1990, c.G-1(Supp.),s.8.
(1) A document that is required to be served under these regulations may be served by registered mail addressed to,
(a) the Chief Inspector at their business address, in the case of a notice of appeal served under subsection 26.2(1) or 26.4(2); or
(b) the appellant at the address for service provided in the appellant’s notice of appeal, in the case of a copy of a decision of the Chief Inspector served under paragraph 26.3(1)(c).
(2) In the absence of evidence to the contrary, a document referred to in subsection (1) that is served by registered mail is deemed to have been received by the person to whom it is addressed on the fifteenth day following the day on which it was mailed.
(3) If a document referred to in subsection (1) is served by registered mail, the date appearing on the postal receipt is deemed to be the date of mailing. RRNWT 1990,c.G-1(Supp.),s.8; R-015-2013,s.7; R-061-2025,s.14.
General
(1) If an accident occurs which was caused or appears to have been caused, directly or indirectly by gas fitting work, gas equipment or a gas installation, and the accident results in
(a) a fire or explosion causing property damage,
(b) injury to a person, or
(c) a fatality,
the supplier, installer, or person in charge of the gas equipment or gas installation shall, on becoming aware of the accident, notify an inspector of the circumstances and details of the accident within 24 hours of learning of the accident and provide the inspector with any other relevant information the inspector may require.

Fees and Expenses
Subject to section 29, fees shall be paid in accordance with the Schedule. RRNWT 1990, c.G-1(Supp.),s.9.
The fee payable for a re-inspection under paragraph 21(a) or (b) of the Schedule is based on, in addition to the inspector’s time on the job, the time necessary for the inspector to travel to and from their office and the inspection site. (1) The travelling and living expenses incurred by an inspector in the performance of their duties may be charged, at the discretion of the inspector, in addition to the fee payable for re-inspection under paragraph 21(a) or (b) of the Schedule.
(2) The travelling and living expenses payable under subsection (1) are to be determined according to the criteria that govern their payment to members of the public service of the Northwest Territories.
