The Commissioner, on the recommendation of the Minister, under section 50 of the Public Health Act and every enabling power, makes the Immunization Regulations.
In these regulations,
"health care number" means an identifying number, symbol or other particular assigned to a person in respect of health services or health information; (numéro de soins de santé)
"register" means the Notifiable Immunization Register established under section 6. (registre) R-074-2023,s.2.
Notifiable Immunizations
All vaccines, immune globulins and monoclonal antibodies administered by a health care professional are prescribed as notifiable immunizations. R-074-2023,s.3.
(1) A health care professional who administers a notifiable immunization to a person shall ensure that the following information is provided to the Chief Public Health Officer in the form and manner approved by the Chief Public Health Officer:
(a) the name, telephone number, place of residence, date of birth, sex assigned at birth and health care number of the person;
(b) in the case of a minor who is not a legally emancipated minor, the name, telephone number, place of residence, and relation to the minor, of a person who has lawful custody of or lawful authority in respect of the minor;
(c) information respecting any high-risk medical conditions, including pregnancy, that the person has at the time of immunization;
(d) information respecting whether or not the person has experienced an infection related to the disease for which the immunization is administered;
(e) any contraindications to receiving the immunization;
(f) the name and profession of, and the contact information for,
(i) the health care professional who administered the immunization, and
(ii) the person providing the information, if other than the health care professional;
(g) the date the immunization was administered and the name of the facility, as defined in subsection 1(1) of the Hospital Insurance and Health and Social Services Administration Act, responsible for the administration of the immunization;
(h) the generic name, trade name, lot number, series number, manufacturer and expiry date of the immunization, as applicable;
(i) the dose and volume of the immunization administered;
(j) the injection site and route of the immunization administered, as applicable;
(k) Repealed, R-074-2024,s.4(1);
(l) any additional information the Chief Public Health Officer requires in respect of the person or the notifiable immunization, for the purposes of public health immunization, health protection and health promotion.
(2) If a health care professional is notified that a person has experienced an adverse reaction to an immunization, the health care professional shall ensure that information as directed is provided to the Chief Public Health Officer within 24 hours, in the form and manner approved by the Chief Public Health Officer.
(3) A requirement to provide any of the information referred to in subsections (1) and (2) does not apply if the Chief Public Health Officer determines that the information is not required in respect of a particular notifiable immunization.
(4) The information referred to in subsection (1) must be provided within four weeks after the day the immunization is administered, unless the Chief Public Health Officer requests that the information be provided at an earlier date. R-076-2016,s.2; R-074-2024,s.4.
(1) If a person refuses an immunization or a person who has legal authority to make health care decisions on behalf of the person refuses an immunization on their behalf, a health care professional who would otherwise have administered the immunization shall ensure that information respecting the refusal is provided to the Chief Public Health Officer, in the form and manner approved by the Chief Public Health Officer.
(2) If a person is not immunized for reasons determined by a health care professional, the health care professional shall ensure that information respecting those reasons is provided to the Chief Public Health Officer, in the form and manner approved by the Chief Public Health Officer.
(3) A requirement to provide any of the information referred to in subsections (1) and (2) does not apply if the Chief Public Health Officer determines that the information is not required in respect of a particular notifiable immunization.
(4) The information referred to in this section must be provided within four weeks after the day an immunization is refused under subsection (1) or a health care professional determines not to immunize a person, unless the Chief Public Health Officer requests that the information be provided at an earlier date. A person in charge of a facility, as defined in subsection 1(1) of the Hospital Insurance and Health and Social Services Administration Act, that is responsible for the administration of notifiable immunizations, shall
(a) take measures to ensure that information is provided to the Chief Public Health Officer in accordance with sections 3 and 4;
(b) provide the Chief Public Health Officer with the required information if circumstances prevent a health care professional from doing so; and
(c) advise the Chief Public Health Officer of any steps being taken to address the circumstances that prevented the health care professional from providing the information.
Register
(1) The Notifiable Immunization Register, established by the Chief Public Health Officer, must be maintained in a form satisfactory to the Chief Public Health Officer.
(2) The Chief Public Health Officer shall ensure that the register is updated regularly to include information respecting notifiable immunizations provided in accordance with the Act and these regulations. R-074-2024,s.7.
