WHEREAS the Government of the Northwest Territories is required by the Northwest Territories Lands and Resources Devolution Agreement to substantially mirror an order of the Governor General in Council, numbered P.C. 1963-1456, that withdraws from disposal certain tracts of land for the development of hydro electric power for use at Pine Point;
The Commissioner in Executive Council, under paragraph 19(a) of the Northwest Territories Lands Act and every enabling power, orders as follows:
The tracts of land set out in the Schedule are withdrawn from disposal.
For greater certainty, section 1 does not apply to the rights of the holders of mineral claims located on the tracts of land set out in the Schedule and recorded in the office of the Mining Recorder before October 3, 1963.
This order comes into force April 1, 2014.
SCHEDULE
1. All that tract of land situated in the District of Mackenzie being bounded on the north by the parallel of latitude sixty degrees and thirty minutes; on the south by the parallel of latitude sixty degrees and twenty minutes; on the east by the meridian of longitude one hundred and eleven degrees and fifteen minutes; and on the west by the meridian of longitude one hundred and eleven degrees and twenty-eight minutes.
2. All that tract of land situated in the District of Mackenzie lying on either side of Taltson River between Nonacho and Tsu Lakes that would be covered by water were the level of that River to be raised thirty-five feet above the level of ordinary high water at any point, not including the land described in section 1.
3. All that tract of land situated in the District of Mackenzie that would be covered by water were the level of Nonacho Lake to be raised twenty-five feet above the level of ordinary high water.
The Lakes and River mentioned in items 1 to 3 are as shown on the second editions of Map Sheets numbered seventy-five, D, E and F of the National Topographic System.
