WHEREAS the Government of the Northwest Territories is required by the Northwest Territories Lands and Resources Devolution Agreement to substantially mirror an order of the Governor General in Council, numbered P.C. 1934-0078 and made on February 12, 1934, that establishes reservations in respect of certain land in order to protect the water power at White Eagle Falls on the Camsell river;
The Commissioner in Executive Council, under paragraph 19(a) of the Northwest Territories Lands Act and every enabling power, orders as follows:
An absolute reservation is established of all surface and mineral rights on the area in the vicinity of White Eagle Falls, Camsell river, bounded on the south by the river and on the north by the bay and the northerly limit of the draw as shown on the attached plan; also on an area extending to a depth of one-quarter of a mile from the south side of the river from the lake expansion at the foot of the falls upstream to a point 300 feet above the falls, and also on an area extending to a depth of one hundred feet from either bank of the river within the limits of the rapid about one-half mile below White Eagle Falls. All these areas to be reserved being as shown hatched on the attached plan marked "A".
A reservation is established on the area extending to a depth of one mile from either bank of the river from a point 300 feet above the head of White Eagle Falls on the south side and from the northerly limit of the draw on the north side upstream to, and including, the twelve foot fall about two and one-half miles distant upstream from White Eagle Falls, within which all mining claims or other entries are subject to the right to raise the water surface of the Camsell river through a vertical distance of twenty (20) feet above the natural high water level of that river at any time, without notice and without compensation for any actual, or alleged, loss or damages to the holder of any mining claim or other entry. The approximate area affected is shown hatched on the attached map marked "B".
A reservation is established on the area extending to a depth of one mile from either bank of the Camsell river, above the twelve foot fall referred to in section 2, and from the shores of Grouard, Clut and Hottah lakes, within which all mining claims or other entries are subject to the right to raise the water surface of that river and those lakes through a vertical distance of eight
(8) feet above their natural high water level at any time without notice and without compensation for any actual, or alleged, loss or damages to the holder of any mining claim or other entry. The approximate area affected is outlined on the attached map marked "B”.
A reservation is established, notwithstanding anything in the Mining Regulations, of all available timber on the three areas referred to in sections 1 to 3.
For greater certainty, the reservations established by sections 1 to 4 are subject to any surface and mineral rights disposed of before February 12, 1934.
This order comes into force April 1, 2014.
