The Commissioner, on the recommendation of the Minister, under section 349 of the Motor Vehicles Act and every enabling power, makes the Large Vehicle Control Regulations.
Interpretation
(1) In these regulations,
"A train" means a combination of vehicles consisting of a tractor, a lead semitrailer, and either
(a) a semitrailer mounted on a trailer converter dolly and attached to the lead semitrailer by a single hitch assembly, or
(b) a full trailer attached to the lead semitrailer by a single hitch assembly; (train de type A)
"axle" means an assembly of two or more wheels whose centres are in one transverse plane; (essieu)
"axle spread" means the longitudinal distance between centres of each individual axle of a tandem axle or tridem axle; (écartement d’essieux)
"B train" means a combination of vehicles consisting of a tractor, a lead semitrailer, and a second semitrailer attached to the lead semitrailer by a fifth wheel mounted on the lead semitrailer; (train de type B)
"C train" means a combination of vehicles consisting of a tractor, a lead semitrailer, and
(a) a semitrailer mounted on a trailer converter dolly and attached to the lead semitrailer by a double hitch assembly, or
(b) a full trailer attached to the lead semitrailer by a double hitch assembly; (train de type C)
"fifth wheel" means a coupling device that is mounted on a vehicle chassis and that consists of a skid plate, associated mounting brackets and latching mechanism that connects to a kingpin located on another vehicle, for the purpose of supporting and pulling a semitrailer; (sellette d’attelage)
"full trailer" means a vehicle that is designed
(a) to be pulled by another vehicle, and
(b) to carry the whole of its weight, including load, on its axles; (remorque classique)
"intercity bus" means a bus designed to carry more than 15 persons and that is equipped with facilities to allow for prolonged travel without stopping; (autocar)
"overdimension permit" means an overdimension permit referred to in section 25(1); (permis de véhicule surdimensionné)
"overdimension vehicle" means a vehicle that is overdimension under subsection 6(7); (véhicule surdimensionné)
"overweight permit" means an overweight permit referred to in section 25(1); (permis de véhicule en surcharge)
"overweight vehicle" means a vehicle that is overweight under subsection 18(6); (véhicule en surcharge)
"pole trailer" means a trailer attached to another vehicle by means of a reach or pole and which is ordinarily used for transporting long or irregularly shaped loads such as logs, poles, pipes or structural members; (remorque pour charges longues)
"pony trailer" means a trailer designed
(a) to be pulled by a motor vehicle that is equipped with a drawbar that is rigidly attached to the structure of the trailer, and
(b) to be used so that the preponderance of its weight is carried on its axles; (remorque semi-portée)
"recreational vehicle" includes class A, B and C motorhomes, each as defined in section 1 of the Motor Vehicle Registration and Licence Plate Regulations; (véhicule récréatif)
"semitrailer" means a trailer that is designed
(a) to be drawn by a tractor, and
(b) so that a substantial part of its weight and load rests on and is carried by either the tractor or the trailer converter dolly to which it is attached by a fifth wheel coupler; (semi-remorque)
"single axle" means one axle supporting one or more tires on each side of the vehicle; (essieu simple) "special permit" means a special permit referred to in section 25(1); (permis spécial)
"stinger steer carrier" means a motor vehicle designed to carry automobiles or boats on a superstructure that is an integral part of the vehicle; (porte-automobiles de type "Stinger Steer")
"straight truck" means a motor vehicle, other than a bus or tractor,
(a) operated as a single unit or used to pull a trailer that is not a semitrailer, and
(b) rated by its manufacturer to be and is capable of carrying or pulling a load of at least 14,600 kg; (camion porteur)
"super single tire" means a non-steering tire that has
(a) a minimum tire width of 445 mm, and
(b) that meets the requirements of the Motor Vehicle Tire Safety Regulations 1995 (SOR/95-148); (pneu simple à bande large)
"tandem axle" means two consecutive axles, having an axle spread of between 1.2 m and 1.85 m; (essieu tandem)
"tractor" means a motor vehicle that is primarily designed for drawing another vehicle by means of a fifth wheel hitch; (tracteur)
"trailer converter dolly" means a trailer consisting of one or more axles, a fifth wheel and one or two drawbars; (diabolo convertisseur)
"tridem axle" means three equally spaced consecutive axles units, having an axle spread of between 2.4 m and 3.7 m; (essieu tridem)
"vehicle" includes a vehicle combination. (véhicule) R-061-2018,s.2.
(2) For greater certainty, a vehicle combination consisting of a semitrailer and converter dolly is a full trailer.
Exemptions
(1) Subject to subsections (2) and (3), a person operating a vehicle in a construction zone is exempt from these regulations if
(a) the vehicle is operated in the construction or maintenance of a highway;
(b) it is impracticable for the person to comply with the provision;
(c) the speed limit is reduced from the maximum legal limit; and
(d) warning signs are posted indicating
(i) the beginning and end of the construction zone,
(ii) the length of the construction zone, and
(iii) that construction vehicles are being operated within the construction zone.
(2) A person who is exempt from these regulations under subsection (1) shall operate the vehicle with due regard for the safety of persons using the highway.
(3) A person who is exempt from these regulations under subsection (1) shall obey the direction of an officer respecting the operation of the vehicle.
Protecting Highways and Ensuring Safety
(1) The Registrar or an officer under his or her direction may make an order in respect of a highway for the purpose of preventing serious damage to the highway or ensuring the safety of persons using the highway, by
(a) posting a copy of the order on the website of the Department; and
(b) placing signs along the affected highway.
(2) An order made under subsection (1) may, in respect of an area of the highway, require
(a) its closing;
(b) the reduction of the applicable speed limit;
(c) the limiting of dimensions of vehicles; or
(d) the reduction of the maximum weight limits applicable to any vehicle or vehicle configuration notwithstanding any such limits set out elsewhere in these regulations.
(3) A sign placed under paragraph (1)(b) must include
(a) the reduced speed limit, as applicable;
(b) the maximum allowable dimensions, as applicable; or
(c) the reduced maximum weight limits applicable to each vehicle on the highway, as applicable.
(4) An operator of a vehicle shall obey any order posted or sign placed under this section.
Identification on Vehicle
A person shall not operate a commercial vehicle that exceeds 4,500 kg unless, on each side of the vehicle, identification is displayed showing,
(a) in clear and easily read letters that are at least 5 cm in height, the name and address of the owner of that vehicle; and
(b) in a clear manner and at least 15 cm in height, the logotype, if any, of the owner of that vehicle.
PART 1
DIMENSIONS
Interpretation
In this Part,
"escort vehicle" means a vehicle that precedes or follows an overdimension vehicle to provide warning of the overdimension vehicle to oncoming or following traffic; (véhicule d’escorte)
"warning flag" means a flag that is
(a) fluorescent orange,
(b) at least 41 cm², and
(c) attached by at least two corners to its mounting; (drapeau d’avertissement)
"warning light" means a light that
(a) is red or amber,
(b) is visible from a distance of 150 m,
(c) has reflectors, and
(d) is not a flashing light. (avertisseur lumineux)
(1) Maximum and minimum dimension limits are set out for each of the following vehicles in Schedules A to K as follows:
(a) tractor and semitrailer, Part 1 of Schedule A;
(b) tractor and pole trailer, Part 1 of Schedule B;
(c) A train, Part 1 of Schedule C;
(d) B train, Part 1 of Schedule D;
(e) C train, Part 1 of Schedule E;
(f) straight truck, Part 1 of Schedule F;
(g) straight truck and pony trailer, Part 1 of Schedule G;
(h) straight truck and full trailer, Part 1 of Schedule H;
(i) intercity bus or recreational vehicle, Part 1 of Schedule I;
(j) intercity bus or recreational vehicle and trailer, Part 1 of Schedule J;
(k) stinger steer carrier, Part 1 of Schedule K.
(2) If a vehicle does not match a vehicle referred to in subsection (1), the following maximum dimension limits apply:
(a) the vehicle width must not exceed 3.2 m;
(b) the vehicle height must not exceed 4.2 m;
(c) if the vehicle is a single vehicle, its maximum length must not exceed 12.5 m;
(d) if the vehicle is a vehicle combination, the combined length of the vehicle combination must not exceed 25 m.
(3) Side mirrors, lights, reflectors, or load securement devices that protrude on each side beyond the widest part of a vehicle are not to be considered in determining the width of the vehicle for the purposes of subsections (1) and (2).
(4) Antennas, aerodynamic devices or other attachments that extend above a vehicle are not to be considered in determining the height of the vehicle for the purposes of subsections (1) and (2).
(5) An aerodynamic device installed at the rear of a straight truck, full trailer or semitrailer must not be considered in determining the length of a vehicle for the purposes of subsections (1) and (2), if
(a) any portion of the device more than 1.9 m above the ground does not protrude more than 1.52 m beyond the rear of the vehicle;
(b) any portion of the device within 1.9 m of the ground does not protrude more than 0.305 m beyond the rear of the vehicle; and
(c) the aerodynamic device is not designed or used to carry cargo.
(6) In determining the dimensions of a vehicle, the dimensions of any load on the vehicle must be considered as a part of the vehicle.
(7) A vehicle that exceeds the maximum dimension limits under this section is an overdimension vehicle.
(8) A person shall not operate an overdimension vehicle on a highway, unless he or she has been issued an overdimension permit in respect of that vehicle. R-061-2018,s.3.
Widths
(1) A person shall not operate a vehicle on a highway if the vehicle has a width
(a) between 2.6 m and 3.2 m, unless the vehicle displays,
(i) mounted on the rear of the widest part of the vehicle,
(A) during darkness or adverse weather, two red warning lights, or
(B) during daylight, the warning lights referred to in clause (A) or warning flags, and
(ii) mounted on the front of the widest part of the vehicle,
(A) during darkness or adverse weather, two amber warning lights, or
(B) during daylight, the warning lights referred to in clause (A) or warning flags;
(b) between 3.2 m and 3.85 m, unless the vehicle
(i) meets the display requirements of paragraph (a),
(ii) displays, at the front of the vehicle or mounted on the cab of the vehicle, one of the following:
(A) a "D" sign that meets the specifications set out in subsection 14(3),
(B) an "Oversize Load" sign that meets the specifications set out in subsection 14(6),
(C) a "Wide Load" sign that meets the specifications set out in section 14(6),
(iii) displays, at the extreme rear of the vehicle or its load, one of the signs described in subparagraph (ii), and
(iv) is preceded by an escort vehicle;
(c) between 3.85 m and 4.45 m, unless the vehicle meets the requirements of paragraph (b) and is equipped with not more than two amber flashing lights on the top of the cab of the vehicle; and
(d) exceeding 4.45 m, unless the vehicle meets the requirements of paragraph (c) and is followed by an escort vehicle.
(2) Notwithstanding subparagraph (1)(b)(iv), a person may, without an escort vehicle, operate a vehicle on a highway if that vehicle has a width between 3.2 m and 3.85 m and
(a) is operated on a highway or portion of highway identified as an enhanced visibility highway in Schedule L; and
(b) displays not more than two amber flashing lights on the top of the vehicle.
(3) A person shall not operate a vehicle on a highway if the vehicle has a projection that is more than 15 cm from the side of the vehicle, unless the vehicle displays,
(a) during darkness or adverse weather, two red and amber warning lights mounted on the projection where
(i) the red part of the lights faces to the rear, and
(ii) the amber part of the lights faces to the front; or
(b) during daylight, the warning lights referred to in paragraph (a) or warning flags mounted on the projection.
(4) A person shall not display any flag, sign or light referred to under this section unless it is required to be displayed under this section.
Length
(1) A person shall not operate a vehicle on a highway if the vehicle has a length
(a) between 26 m and 29 m, unless the vehicle displays
(i) on its rear, one of the following:
(A) a "D" sign that meets the specifications set out in subsection 14(3),
(B) a "Long Load" sign that meets the specifications set out in subsection 14(6),
(C) an "Oversize Load" sign that meets the specifications set out in subsection 14(6), and
(ii) on the top of its cab not more than two amber flashing lights; or
(b) exceeding 29 m, unless
(i) during darkness or adverse weather, two red warning lights are mounted on the rear of the vehicle or the load,
(ii) during daylight, the warning lights referred to in subparagraph (i) or warning flags are mounted on the extremities of the vehicle or the load,
(iii) the vehicle displays those signs and lights required by paragraph (1)(a), and
(iv) the vehicle is followed by an escort vehicle.
(2) Notwithstanding subparagraph (1), a person may operate on a highway, without an escort vehicle, a vehicle that has a length between 29 m and 31 m, if the vehicle is operated on a highway or portion of highway identified as an enhanced visibility highway in Schedule L.
(3) A person shall not operate a vehicle on a highway if the vehicle has a projection that is more than
m from the front or rear, unless the vehicle displays
(a) during darkness or adverse weather, two red and amber warning lights mounted on the projection where
(i) the red part of the lights faces to the rear, and
(ii) the amber part of the lights faces to the front; or
(b) during daylight, the warning lights referred to in paragraph (a) or warning flags mounted on the projection.
(4) A person shall not operate a vehicle on a highway if the vehicle has a front projection exceeding
m, measured from the extreme axle centre of the most forward axle, unless he or she has been issued an overdimension permit.
(5) A person shall not operate a vehicle displaying a light, flag or sign referred to in this section unless the display is required by this section.
Tractors and Pole Trailers
(1) In this section, "bunk stakes" means vertical members mounted perpendicular to the horizontal platform of a pole trailer and designed to facilitate the securing of a load to the pole trailer.
(2) A person shall not operate a vehicle on a highway that is a tractor and pole trailer, unless the tractor and pole trailer displays
(a) not more than two amber flashing lights that are
(i) mounted on the top of the cab of the tractor, and
(ii) illuminated at all times while the tractor and pole trailer is on the highway;
(b) red or orange sheaths on the bunk stakes;
(c) during daylight, a minimum of 10 red or orange streamers that are
(i) at least 1 m in length and 2.5 cm in width, and
(ii) mounted at the rear of the load so as to be clearly visible to vehicles approaching from the rear; and
(d) during darkness, two red warning lights mounted on the rear of the load.
Trains
(1) In this section,
"extended length vehicle" means an A train or B train,
(a) that exceeds the maximum dimension limits set out in Schedule C or D respectively,
(b) where neither trailer exceeds 16.2 m, and
(c) that has an overall length between 26 m and 31 m; (véhicule à longueur accrue)
"hitch offset" means the longitudinal distance from the turn centre of a towing vehicle to the articulation point of the hitch or fifth wheel used to tow a trailer. (décalage du crochet d’attelage)
(2) Notwithstanding subsection 6(8), a person shall not operate an extended length vehicle on a highway, unless he or she
(a) has been issued a special permit in respect of that vehicle; and
(b) operates the vehicle on a highway or portion of highway identified as an enhanced visibility highway in Schedule L.
(3) A person shall not operate an A train or C train or a straight truck and trailer if the hitch offset exceeds 1.8 m.
(4) A person shall not operate a B train if the fifth wheel coupler mounted on the lead semitrailer is located forward of the lead axle on the lead semitrailer.
(5) A person shall not operate an A train, B train, or C train if the length of the lead trailer is less than the length of the other trailer, unless he or she has been issued a special permit in respect of that vehicle combination.
Mobile Homes
(1) In this section, "mobile home" means a trailer that is designed for human occupancy for other than recreational purposes.
(2) A person shall not operate a vehicle towing a mobile home or similar load, unless the vehicle displays amber flashing lights mounted at the top rear corners of the load.
Signs, Lights, Flags, Flares and Reflective Devices
A person who operates a vehicle that has a gross weight exceeding 4,500 kg shall ensure that
(a) it is equipped with two flares, lights, lanterns or reflective devices of a kind described in section 130 of the Act; and
(b) the flares, lights, lanterns or reflective devices are placed as described in section 130 of the Act.
Escort Vehicles
(1) A person shall not operate a motor vehicle as an escort vehicle, if
(a) it is an overdimension vehicle; or
(b) it has a gross weight exceeding 9,000 kg.
(2) A person operating an escort vehicle shall ensure that
(a) if the escort vehicle precedes or follows the escorted vehicle, it remains at a distance of between 100 and 800 m from the escorted vehicle; and
(b) two-way radio communication is maintained between the escort vehicle and the escorted vehicle.
(3) A person operating an escort vehicle shall ensure that
(a) a "D" sign for an escort vehicle and box are mounted on the vehicle top and the box and sign
(i) meet the specifications set out in subsections 14(4) and (5), and
(ii) are visible to oncoming and following traffic; or
(b) a "Long Load", "Oversize Load" or "Wide Load" sign for an escort vehicle and box are mounted on the vehicle top and the box and sign
(i) meet the specifications set out in subsections 14(7) and (8), and
(ii) are visible to oncoming and following traffic.
(4) While an escort vehicle is used for purposes other than escorting another vehicle, the operator of the escort vehicle shall remove, cover, fold over or otherwise obscure any sign and box that is mounted to the escort vehicle, so it is not visible to oncoming and following traffic.
Overdimension Sign Specifications
(1) In this section,
"CGSBS 62-GP-11M" means Canadian General Standards Board Specification 62-GP-11M, Marking Material, Retroreflective Elements, Adhesive Backing; (norme 62-GP-11M de l’ONGC)
"Manual on Uniform Traffic Control Devices" means US Department of Transportation, Federal Highway Administration, The Manual on Uniform Traffic Control Devices (2009). (Manual on Uniform Traffic Control Devices)
(2) The following codes or standards, as amended from time to time, are adopted:
(a) CGSBS 62-GP-11M;
(b) Manual on Uniform Traffic Control Devices.
(3) A "D" sign used by an overdimension vehicle must
(a) consist of alternating panels of red on a white background with dimensions as illustrated in Figure 1 of Schedule M;
(b) display an upper case "D"
(i) centred in the centre red panel,
(ii) white in colour,
(iii) of a height of 20 cm, and
(iv) of Series E font;
(c) have a white background made of level II reflectance that conforms to CGSBS 62-GP-11M; and
(d) have the red panels painted with #712 Stop Sign Red (3M-Corp) paint or equivalent.
(4) A "D" sign used by an escort vehicle must
(a) consist of alternating panels of red on a white background with dimensions as illustrated in Figure 2 of Schedule M;
(b) display an upper case "D"
(i) centred in the centre red panel,
(ii) white in colour,
(iii) of a height of 20 cm, and
(iv) of Series E font;
(c) have a white background made of white translucent plexiglass; and
(d) have the red panels painted with transparent red paint.
(5) A "D" sign used by an escort vehicle must be mounted to a box on the vehicle top and the box must
(a) be durable and weather resistant;
(b) contain lights evenly spaced to give even lighting of the white background;
(c) provide shelter for wires, connectors, switches and flashers;
(d) be 180 cm by 35 cm by 10 cm; and
(e) be equipped with at least two amber flashing lights, each having a minimum diameter of 10 cm and visible at a distance of 150 m.
(6) A "Long Load", "Oversize Load" or "Wide Load" sign used by an overdimension vehicle must, as applicable,
(a) consist of a yellow background with dimensions as illustrated in Figures 3 to 5 of Schedule M; and
(b) display in uppercase letters "LONG LOAD", "OVERSIZE LOAD" or "WIDE LOAD"
(i) centred on the background,
(ii) black in colour,
(iii) of a height of 20 cm, and
(iv) of Series C font.
(7) A "Long Load", "Oversize Load" or "Wide Load" sign used by an escort vehicle must, as applicable,
(a) consist of a yellow background with dimensions illustrated in Figures 6 to 8 of Schedule M; and
(b) display in upper-case letters "LONG LOAD", "OVERSIZE LOAD" or "WIDE LOAD"
(i) centred on the background,
(ii) black in colour,
(iii) of a height of 28 cm, and
(iv) of Series C font.
(8) A "Long Load", "Oversize Load" or "Wide Load" sign used by an escort vehicle must be mounted to a box on the vehicle top and the box must
(a) be durable and weather resistant;
(b) contain lights evenly spaced to give even lighting of the yellow background;
(c) provide shelter for wires, connectors, switches and flashers;
(d) be 180 cm by 35 cm by 10 cm; and
(e) be equipped with at least two amber flashing lights, each having a minimum diameter of 10 cm and visible at a distance of 150 m.
A person operating a vehicle displaying a sign, light or flag under this Part shall keep the sign, light or flag clean and in good repair.
PART 2
WEIGHTS
Interpretation
In this Part,
"axle weight" means the total weight transmitted to a highway by each axle; (charge par essieu)
"steering axle" means an articulated axle that can be controlled by the operator for the purpose of steering the vehicle. (essieu directeur)
Application
(1) This Part applies to vehicles with a gross weight exceeding 4,500 kg that are operated on a highway.
(2) Nothing in this Part authorizes the operator of a vehicle to exceed the maximum load that the manufacturer has rated the vehicle capable of carrying or pulling.
(3) A person shall not operate a vehicle with a load that exceeds the maximum load that the manufacturer has rated the vehicle capable of carrying or pulling.
Vehicle Weight Limits
(1) In this section, "interaxle spacing" means the shortest longitudinal distance between the centre of one axle in a single axle, tandem axle or tridem axle and the centre of an axle in a single axle, tandem axle or tridem axle, but excludes such a distance if it is in respect of axles that are on a tractor, tractor portion of a stinger steer carrier or straight truck.
(2) Maximum weight limits are set out for each of the following vehicles in Schedules A to K as follows:
(a) tractor and semitrailer, Part 2 of Schedule A;
(b) tractor and pole trailer, Part 2 of Schedule B;
(c) A train, Part 2 of Schedule C;
(d) B train, Part 2 of Schedule D;
(e) C train, Part 2 of Schedule E;
(f) straight truck, Part 2 of Schedule F;
(g) straight truck and pony trailer, Part 2 of Schedule G;
(h) straight truck and full trailer, Part 2 of Schedule H;
(i) intercity bus or recreational vehicle, Part 2 of Schedule I;
(j) intercity bus or recreational vehicle with trailer, Part 2 of Schedule J;
(k) stinger steer carrier, Part 2 of Schedule K.
(3) The weight limits across interaxle spacings of any two axles on vehicles referred to in subsection (2) are set out in Schedule N.
(4) If an interaxle spacing of a vehicle is not set out in Schedule N, a person shall not operate such a vehicle on a highway unless he or she has been issued a special permit in respect of that vehicle.
(5) Subject to subsection (6) and section 24, a vehicle that exceeds the maximum weight limits under this section is an overweight vehicle.
(6) Notwithstanding subsection (5), if a tractor, straight truck, inner city bus or recreational vehicle that is equipped with one or more stand-alone devices used to provide an alternative source of power to keep the engine of the vehicle warm while it is turned off, the axle weight and gross weight of the vehicle may exceed the maximum weight for that vehicle under this section by not more than 225 kg.
(7) Subject to subsection (8), a person who operates an overweight vehicle on a highway commits an offence if the vehicle is operated
(a) in excess of the maximum weight limits under this section; or
(b) in excess of the maximum weight limits authorized in any overweight permit issued for that vehicle.
(8) In the case where subsection (7) is contravened, a further offence occurs
(a) for each 100 kg that the vehicle is in excess of the maximum weight limits under paragraph (7)(a); or
(b) for each 100 kg that the vehicle is in excess of the maximum weight limits authorized in any overweight permit issued for that vehicle.
Pole Trailer Restrictions
A person shall not operate a vehicle that includes a pole trailer on a highway if the vehicle has super single tires. R-061-2018,s.5.
Extended Length Vehicle Restrictions
A person shall not operate a vehicle on a highway if the vehicle is an extended length vehicle as defined in subsection 10(1), if the total axle weight of the second trailer exceeds the total axle weight of the lead trailer.
Tire Restrictions
(1) A person shall not operate a vehicle on a highway if the vehicle has a distributed gross weight
(a) on a steering tire that exceeds 100 kg per cm of tire width; or
(b) on a tire other than a steering tire that exceeds the rated capacity of the tire as rated by the manufacturer.
(2) A person may operate an intercity bus on a highway, if the bus has a drive axle that is a tandem axle and that tandem axle consists of
(a) single tires at the end of the rear axle of the tandem axle; and
(b) dual tires at the end of the front axle of the tandem axle.
(3) A person shall not operate an intercity bus or recreational vehicle on a highway if that vehicle has super single tires.
Axle Restrictions
(1) In this section,
"16-wheeler" means a semitrailer equipped with a tandem axle consisting of 16 tires; (remorque à 16 roues)
"24-wheeler" means a semitrailer equipped with a tridem axle consisting of 24 tires; (remorque à 24 roues)
"automatic axle lift device" means a device that is designed
(a) to lift or otherwise remove the tires of a trailer’s axle from contact with the surface of a highway, and
(b) to automatically lower the tires of a trailer’s axle to the surface of a highway; (dispositif de levage d’essieux automatique)
"drive axle" means the axle that
(a) is or may be connected to the power source of a motor vehicle, and
(b) transmits power to the wheels; (essieu moteur)
"lift axle" means an axle that
(a) is normally locked in a raised position above the surface of a highway, and
(b) may be lowered and locked so that its wheels are in contact with the surface of a highway and the adjacent axle weights of the vehicle are shared by those axles comprising the lift axle; (essieu relevable)
"twin steer axle" means two steering axles. (essieu directeur double)
(2) Repealed, R-061-2018,s.6(2).
(3) If the gross weight on a twin steer axle is greater than 13,600 kg, the vehicle is an overweight vehicle.
(4) A person shall not operate a vehicle on a highway without an overweight permit if the vehicle
(a) includes a 16-wheeler; and
(b) has an axle weight exceeding 17,000 kg and an axle spread greater than or equal to 1.20 m and less than 1.85 m.
(4.1) A person shall not operate a vehicle on a highway without an overweight permit if the vehicle
(a) includes a 24-wheeler; and
(b) has an axle weight
(i) exceeding 21,000 kg and an axle spread greater than or equal to 2.40 m and less than 3.00 m, or
(ii) exceeding 24,000 kg and an axle spread greater than or equal to 3.00 m and less than 3.70 m.
(5) A person shall not operate a vehicle on a highway if that vehicle has a device installed for varying axle weight unless he or she has been issued a special permit in respect of that vehicle.
(6) Notwithstanding subsection (5), a person may, without a special permit, operate a vehicle on a highway if that vehicle has a device installed for varying axle weight, if
(a) the control locks or unlocks a sliding fifth wheel coupler;
(b) the vehicle is a ready mix concrete truck and the control is manually operated and located outside the driver compartment and immediately adjacent to the single axle, tandem axle or tridem axle being affected; or
(c) the control on a trailer is an automatic axle lift device
(i) installed by the original trailer manufacturer, or an installer working under the supervision of, and according to an installation plan developed by, a professional engineer,
(ii) that is equipped with tamper resistant features to prevent unintended field adjustments,
(iii) that has affixed on each side, near the affected axles, a unique logo indicating that an automatic axle lift device is installed on the trailer, and
(iv) that is equipped with an on and off control to operate the automatic axle lift device and with a status light visible from the cab to indicate to the driver when the device is activated.
(7) If a lift axle is lowered and locked, the weight on the lift axle must equal the adjacent axle weights. R-061-2018,s.6.
Cargo Securement
(1) In this section, "NSC 10" means the Canadian Council of Motor Transport Administrators, National Safety Code 10: Cargo Securement (September 2004).
(2) NSC 10, as amended from time to time, is adopted by these regulations.
(3) An operator of a vehicle shall make reasonable efforts, in respect of a load carried on the vehicle,
(a) to secure the load in accordance with NSC 10;
(b) to make the centre of gravity of the load as low as possible to minimize the risk of the vehicle overturning;
(c) to distribute the load over the vehicle as much as possible to minimize structural stresses on the vehicle; and
(d) to ensure that the vehicle is structurally sound and capable of carrying the load without the load or any portion of it falling off or leaking from the vehicle.
Increases to Vehicle Weight Limits
(1) The Registrar may, in respect of a vehicle, increase the maximum weight limits set out in Schedules A to K by posting a notice of the increased weight limits on the website of the Department.
(2) A notice of increased weight limits posted under this section must include
(a) the date of issue of the increase;
(b) the date that the increase takes effect;
(c) the date that the increase ceases;
(d) those areas of highways on which the increase applies;
(e) the vehicles to which the increase applies; and
(f) the amount of the increase.
(3) If a vehicle is determined to be an overweight vehicle and an increase under this section is in effect, the amount that the vehicle is overweight must be calculated as though no increase were in effect.
PART 3
PERMITS
Issue
(1) The following permits are established:
(a) an overdimension permit;
(b) Repealed, R-061-2018,s.7;
(c) an overweight permit;
(d) a special permit.
(2) A person may apply for a permit or replacement permit to the Registrar or an officer acting under the Registrar’s direction, by
(a) completing an application in a form approved by the Registrar; and
(b) subject to subsection (2.1), submitting the application form and the applicable fee set out in Schedule O to the Registrar or officer, in a manner approved by the Registrar.
(2.1) During the period of March 20, 2020 to October 31, 2020, the applicable fee that must be submitted under paragraph (2)(b) for any permit other than a replacement permit is $0.
(3) The Registrar or an officer acting under the Registrar’s direction may issue a permit to a person who submits an application under subsection (2).
(4) The Registrar or an officer acting under the Registrar’s direction may refuse to issue a permit if there is a reasonable belief that
(a) an unreasonable risk to the safety of the driver, other drivers or the public, exists;
(b) an unreasonable risk of damage to a highway exists; or
(c) the applicant is unlikely to comply with these regulations or with any term or condition of the permit.
(5) If the Registrar or an officer refuses to issue a permit under subsection (4), written reasons must be provided to the applicant and the applicable fee submitted under subsection (2) must be refunded.
(6) The Registrar or an officer acting under the Registrar’s direction may impose terms and conditions on a permit for the purposes of
(a) enhancing the safety of the driver, other drivers and the public; and
(b) minimizing any wear or damage to public highways that the vehicle may cause.
(7) If the Registrar or an officer acting under the Registrar’s direction cancels, amends or varies a permit, the permit holder must be informed of the reasons for the cancellation, amendment or variation in writing.
(8) For greater clarity, a permit issued under this section must not be issued with retroactive effect. R-061-2018,s.7; R-026-2020,s.2; R-102-2020,s.2; R-122-2020,s.2.
Single and Multiple Trips
(1) A single trip overdimension permit or overweight permit is valid in respect of one trip by the vehicle.
(2) An annual overdimension permit, pole trailer permit or special permit is valid in respect of any number of trips by the vehicle for the duration that the permit is valid.
Overweight Permit Fees
Subject to subsection 25(2.1), if an overweight permit is issued under these regulations, the amount of the overweight permit fee is determined by the formula

(a) A is an amount of $10;
(b) B is equal to the amount that the vehicle is overweight in kilograms, divided by 1,000;
(c) C is equal to the distance in kilometres that the vehicle is to travel in a trip divided by 100; and
(d) D is an amount of $20.
A × B × C + D
Possession of Permit
(1) A permit holder may request to have a permit issued by mail or electronic means.
(2) If a permit has been issued, the permit holder shall
(a) comply with any terms or conditions of the permit; and
(b) produce the permit or the permit number on the demand of an officer.
(3) A permit is not transferrable.
PART 4
ENFORCEMENT
Interpretation
In this Part,
"portable scale" means a portable device approved by the Registrar for the purposes of measuring the dimensions of and weighing of a vehicle; (balance portative)
"weigh scale" means a static device approved by the Registrar for the purposes of measuring the dimensions of and weighing of a vehicle. (bascule)
Weigh Scales
(1) The Registrar may establish weigh scales at such locations as he or she considers necessary.
(2) The Registrar or an officer acting under the Registrar’s direction may position portable scales at such locations the Registrar or officer consider necessary.
(3) The Registrar or an officer acting under the Registrar’s direction may authorize the placement of signs, signals or markings along a highway directing a vehicle to stop at a portable scale or weigh scale.
(4) If an operator of a vehicle does not accept the results of a portable scale, the operator shall, under the direction of an officer, proceed to the nearest weigh scale for inspection.
(5) An officer may, following an inspection, direct an operator of a vehicle to
(a) rearrange or secure the load being carried before proceeding; or
(b) remove the whole or part of the load being carried in order to comply with the Act and regulations before proceeding.
(6) If an operator of a vehicle is required by an officer to remove part of a load, that operator remains responsible for
(a) the safe handling and storage of the goods; and
(b) the security of the goods.
(7) An operator of a vehicle may appeal to the Registrar a decision made by an officer under subsection (4) or (5), within 30 days of the decision.
(8) A decision by the Registrar on appeal under subsection (7) is final.
(9) An operator of a vehicle that is required by an officer or a traffic control device to report to a weigh scales shall report to the weigh scales as directed by the officer or the traffic control device. R-061-2018,s.8.
REPEAL
The Large Vehicle Control Regulations, R.R.N.W.T. 1990, c.M-30, are repealed.
