Local Authorities Elections Forms Regulations

In these regulations, "Act" means the Local Authorities Elections Act.

The prescribed form of the voters’ register referred to in section 1 of the Act is set out in Form 1 of the Schedule.

The prescribed form of the oath or affirmation of an election officer referred to in subsection 29(2) of the Act is set out in Form 2 of the Schedule.

The prescribed form of the notice calling for nomination of candidates referred to in section 35 of the Act is set out in Form 3 of the Schedule.

The prescribed form of the nomination paper referred to in paragraph 38(1)(a) and the consent and declaration referred to in paragraph 38(1)(b) of the Act is set out in Form 4 of the Schedule.

The prescribed form of the certificate of election referred to in subsection 42(3) and paragraph 77(b) of the Act is set out in Form 5 of the Schedule.

The prescribed form of the notice of election referred to in subsection 45(2) of the Act is set out in Form 6 of the Schedule.

Candidates for Mayor or Councillor - Ineligibility (Local Authorities Elections Act, subsections 18(2) and (3) and sections 18.1 and 20)

A person is not eligible to be nominated or to stand as a candidate for mayor or councillor if he or she (a) is a judge, territorial judge, youth justice court judge or, subject to section 18.1 of the Local Authorities Elections Act, a justice of the peace; (b) is a member of the Legislative Assembly; (c) is a full time permanent employee of the municipal corporation in receipt of a salary; (d) is an election officer; (e) is an assessor or auditor of the municipal corporation; (f) is personally indebted to the municipal corporation for a sum exceeding $500 for more than 90 days, other than municipal taxes; (g) has a controlling interest in a private or public corporation that is indebted to the municipal corporation for a sum exceeding $500 for more than 90 days, other than municipal taxes; or (h) has not paid all municipal taxes before December 31 of the year in which the taxes were levied.

A person is also not eligible to be nominated or to stand as a candidate if he or she (a) has been convicted of a major election offence under the Local Authorities Elections Act within the three years immediately preceding election day; or (b) has been convicted of an offence punishable by imprisonment for five years or more within the three years immediately preceding election day, or if his or her imprisonment as a result of such a conviction terminates within the three years immediately preceding election day.

Candidates for a District Education Authority - Ineligibility (Local Authorities Elections Act, subsections 18(2) and (3) and section 19)

A person is not eligible to be nominated or to stand as a candidate for a District Education Authority if he or she (a) is a judge, territorial judge or youth justice court judge; (b) is a member of the Legislative Assembly; (c) is a full time permanent employee of the District Education Authority in receipt of a salary; (d) is an election officer; (e) is a member of the school staff, as defined in the Education Act, in a school in the area within the jurisdiction of the District Education Authority; (f) is a person hired for the delivery of adult education programs; or (g) is an employee of the District Education Authority.

A person is also not eligible to be nominated or to stand as a candidate if he or she (a) has been convicted of a major election offence under the Local Authorities Elections Act within the three years immediately preceding election day; or (b) has been convicted of an offence punishable by imprisonment for five years or more within the three years immediately preceding election day, or if his or her imprisonment as a result of such a conviction terminates within the three years immediately preceding election day.
