In these regulations,

"area control officer" means an officer or officers appointed under subsection 4(1) of the Act to administer and enforce the Act and these regulations within the Mackenzie Development Area or any zone of the Mackenzie Development Area; (agent de surveillance régionale)

"garbage" means any waste, surplus or unsightly material and includes the refuse of animal and vegetable matter which has been intended for use as food, ashes, tin cans, bottles, scrap metal, machinery or vehicles, wood, paper or any other rubbish; (ordures)

"Mackenzie Development Area" means the development area established under that name by the Commissioner under the Act; (région d'aménagement du Mackenzie)

"nuisance ground" means the area designated as a nuisance ground under section 4; (dépotoir)

"zone" means one of the named zones of the Mackenzie Development Area as set out in the description of the development area in Schedule A. (zone)

Except as otherwise provided in these regulations, these regulations apply to the whole of the Mackenzie Development Area.

3.

No person shall, except with the permission in writing of an area control officer,

(a) cut or remove any trees;

(b) erect, remove or alter any building or structure;

(c) make any excavation or disturb the surface of the ground; or

(d) pitch a tent or establish any camp.

4.

(1) This section applies only to that part of the Norman Wells Zone described as follows:

commencing at approximately 65°12N north latitude and 126°35N west longitude; thence due west to 127°10N west longitude;

thence due north to 65°22N north latitude;

thence due east to 126°35N west longitude;

thence to the point of commencement.

(2) An area for the deposit and disposal of garbage, to be known as the Norman Wells nuisance ground, which is described as being the area situated near Kee Scarp approximately 5.6 km northeast of the Norman Wells Ministry of Transport airstrip, is established.

(3) No person shall deposit garbage or cause or permit garbage to accumulate in any place other than in the Norman Wells nuisance ground.

(4) An area control officer may, by written order, direct the owner or occupier of land to remove any garbage from the land to the Norman Wells nuisance ground.

(5) No person shall, except with the permission in writing of an area control officer, burn or dispose of garbage in a place other that on the Norman Wells nuisance ground.

(1) In this section, the expressions "vehicle" and "highway" have the meanings assigned to them by the Motor Vehicles Act.

(2) This section applies only to the Arctic Red River, Fort McPherson and Inuvik sub-zones which are described in Schedule B and which in this section shall be cumulatively known as the Interim Dempster Highway Management Area.

(3) There shall be a committee to be known as the Interim Dempster Highway Committee comprising

(a) those persons appointed as area control officers for the Interim Dempster Highway Management Area, one of whom shall be designated by the Commissioner as chairperson;

(b) one person, not being a person in the public service of the Territories, appointed by the Commissioner on the recommendation of each of Inuvik Town Council, Arctic Red River Charter Community Council and Fort McPherson Hamlet Council from among residents of their respective sub-zone; and

(c) three persons in the public service of the Territories who are not area control officers.

(4) A majority of the members of the Interim Dempster Highway Committee shall form a quorum and in the event of a tie vote the chairperson shall have a second or casting vote.

(5) No person shall, without the written permission of an area control officer,

(a) carry out any construction, excavation, placement, repair, removal, demolition or any other operation on or under the land,

(b) make any change in the use or intensity of use of any land, building or premises,

(c) remove any surface material or topsoil,

(d) deposit any debris, waste material, garbage, litter or other refuse or material on any land or water,

(e) use any land for parking bunk houses, portable dwellings, skid shacks or any other type of portable building whether or not affixed to the land,

(f) operate any vehicle, other than a motor toboggan, except on a highway, or

(g) use or occupy any land,

within the Interim Dempster Highway Management Area, or cause any such act to be done.

(6) In exercising his or her functions under this section an area control officer shall consult with the Interim Dempster Highway Committee.

(7) Nothing in paragraph 5(f) shall be construed as itself conferring any authority to operate any vehicle on a highway. R-009-2006,s.2.

SCHEDULE A (Section 1)

The Mackenzie Development Area consists of all that portion of the Northwest Territories that is comprised of the 13 zones described as follows:

KAKISA ZONE: That area that lies within 6 km of each side of the highway commonly known as the Mackenzie Highway between the Bouvier River and the junction of the said highway with the northern boundary of the Hay River-Enterprise Development Area including the area described as follows:

commencing at a point of approximately 60°55N north latitude and 117°12N west longitude;

thence due west to 117°25N west longitude;

thence due north to 61°00N north latitude;

thence due east to 117°12N west longitude;

thence due south to the point of commencement.

JEAN MARIE ZONE: That area that lies within 6 km of each side of the highway commonly known as the Mackenzie Highway between the Bouvier River and Jean Marie Creek.

FORT SIMPSON ZONE: That area consisting of (a) the area lying within 6 km or each side of the highway commonly known as the Fort Liard Highway from the Jean Marie Creek intersection to the Birch River; and (b) the area lying within 6 km of each side of the highway commonly known as the Mackenzie Highway between Jean Marie Creek and Willowlake River including the area described as follows: commencing at 61°41N north latitude and 121°05N west longitude thence due north to the middle thread of the Mackenzie River approximately 61°50N20O north latitude;

thence in a general northwesterly direction along said middle thread passing southerly by Martin Island to 121°27N west longitude at approximately 61°54N north latitude;

thence due south to 61°53N north latitude;

thence southerly in a straight line to 61°40N north latitude and 121°24N west longitude;

thence to the point of commencement, excepting thereout those lands contained within the municipal boundaries of the Village of Fort Simpson.

NAHANNI ZONE: That area that lies within 6 km of each side of the highway commonly known as the Fort Liard Highway between Birch River and Netla River.

LIARD ZONE: That area lying within 6 km of each side of the highway commonly known as the Fort Liard Highway between the Netla River and the 60th parallel of north latitude that being the Northwest Territories - British Columbia boundary including the area described as follows:

commencing at approximately 60°15N north latitude 123°20N west longitude;

thence due west to 123°30N west longitude;

thence in a northwesterly direction to 63°15N north latitude and 123°40N west longitude;

thence due north to 63°17N north latitude;

thence due east to 123°35N west longitude;

thence in a southeasterly direction to 63°15N north latitude and 123°20N west longitude;

thence to the point of commencement. WRIGLEY ZONE: That area lying within 6 km or each side of the highway commonly known as the Mackenzie Highway between the Willowlake River and the Blackwater River including the area described as follows:

commencing at approximately 63°10N north latitude and 123°20N west longitude;

thence due west to 123°30N west longitude;

thence in a northwesterly direction to 63°15N north latitude and 123°00N west longitude;

thence due north to 63°17N north latitude;

thence due west to 123°35N west longitude;

thence in a southeasterly direction to 63°15N north latitude and 123°20N west longitude;

thence due south to the point of commencement.

TULITA ZONE: That area lying within 6 km of each side of the highway commonly known as the Mackenzie Highway between the Blackwater River and Jungle Ridge Creek including the area described as follows:

commencing at approximately 64°53N north latitude and 125°25N west longitude;

thence due west to 125°40N west longitude;

thence due north to 64°55N north latitude;

thence in a northeasterly direction to 64°57N north latitude and 125°30N west longitude;

thence due east to 125°57N north latitude and 125°30N west longitude;

thence due east to 125°25N west longitude;

thence to the point of commencement. NORMAN WELLS ZONE: All topographic features referred to below being according to the first edition of the Norman Wells Map sheet number 96E of the National Topographic Series, produced at a scale of 1:250,000 by the Department of Energy, Mines and Resources or its successors, (formerly Department of Mines and Technical Surveys) at Ottawa:

commencing at Geodetic Survey Monument "Paul", being a bronze plug having an elevation of about 978 m and being located on the crest of Norman Range at approximately 65°20N26O north latitude and 126°36N46O west longitude;

thence northwesterly along the crest of Norman Range to National Topographic Survey Monument "Bev", being a rock post having an elevation of about 767 m and being located at approximately 65°24N13O north latitude and 126°56N56O west longitude;

thence southwesterly in a straight line to the westerly extremity of Rader Island, in the Mackenzie River;

thence southerly in a straight line to the point where the left bank of the Mackenzie River meets the right bank of Ray Creek;

thence in a general southerly, westerly, southerly, southeasterly and southerly direction along the right bank of Ray Creek to a point due west of National Topographic Survey Monument "Canol", being a rock post having an elevation of about 141 m and being located at approximately 65°12N52O north latitude and 127°01N14O west longitude;

thence easterly in a straight line to the last aforesaid monument;

thence due east to the left bank of the Mackenzie River;

thence northeasterly in a straight line to a point on the right bank of the Mackenzie River due south of the point of commencement;

thence due north to the point of commencement;

said parcel containing about 453 km2. FORT GOOD HOPE ZONE: That area lying within 6 km of each side of the highway commonly known as the Mackenzie Highway between the Hanna River and Travaillant River including the area described as follows:

commencing at approximately 66°14N north latitude and 128°30N west longitude;

thence due west to the intersection with the right bank of the Mackenzie River to its intersection with the Hare Indian River to 128°30N west longitude;

thence to the point of commencement.

ARCTIC RED RIVER ZONE: That area lying within 6 km of each side of the highway commonly known as the Dempster Highway from Frog Creek to the Rengleng River including the area described as follows:

commencing at the middle thread of the Mackenzie River at 67°21N north latitude and 133°28N west longitude;

thence due west to 133°52N west longitude;

thence due north to the middle thread of the Mackenzie River at approximately 67°31N north latitude;

thence in a southeasterly direction following the middle thread of the Mackenzie River to the point of commencement.

FORT McPHERSON ZONE: That area lying within 6 km of each side of the highway commonly known as the Dempster Highway from the Northwest Territories - Yukon boundary to Frog Creek including the area described as follows:

commencing at the intersection of the east bank of Peel River with the northerly bank of an unnamed stream forming part of a chain of lakes and streams flowing from Dark Water Lake to Peel River, said intersection being at approximately 67°28N15O north latitude;

thence in a general easterly direction along the northerly bank of said chain of lakes and streams to 134°46N00O west longitude;

thence due south to 67°26N10O north latitude;

thence southerly in a straight line to the most easterly extremity of the shore of an unnamed lake at approximately 67°23N10O north latitude and 134°46N30O west longitude;

thence in a general southerly direction along the easterly bank of a chain of lakes and streams to the point where it meets the northerly bank of an unnamed stream at approximately 67°22N05O north latitude;

thence in a general southerly direction along the easterly bank of the last aforesaid stream to the point where it meets the southerly bank of an unnamed river at approximately 67°20N30O north latitude;

thence in a general westerly direction along the southerly bank of the last aforesaid river to intersect with said east bank of Peel River;

thence west in a straight line to the middle thread of Peel River at approximately 67°19N55O north latitude and 134°52N00O west longitude;

thence northerly, along said middle thread, on the westerly side of four unnamed islands to approximately 67°28N15O north latitude;

thence east in a straight line to the point of commencement.

INUVIK ZONE: Those portions of the Territories consisting of (a) that area lying within 6 km on each side of the highway commonly known as the Mackenzie Highway between the Travaillant River and the junction of the Mackenzie and Dempster Highways; (b) that area lying with 6 km on each side of the highway commonly known as the Dempster Highway between Rengleng River and 69°00N north latitude including the area described as follows:

commencing at Geodetic Survey Monument "Inuvik", being a brass plug stamped 699028, located at approximately 68°21N03O north latitude and 133°23N59O west longitude on the most southerly of two peaks shown on Inuvik map sheet number 107B7 produced in 1967 at a scale of 1:50,000 by the Department of Energy, Mines and Resources, or its successors, and having an elevation of about 244 m;

thence southerly in a straight line to a point on the northerly production of the easterly boundary of Lot 3, Group 1355, as said lot is shown on Plan 43574 in the Canada Land Surveys Records at Ottawa, a copy of which is filed in the Land Titles Office at Yellowknife as 218, said point being distant 305 m northerly from the northeasterly corner of said lot and being located at approximately 68°19N10O north latitude and 133°22N50O west longitude;

thence southerly along said production and boundary to the southeasterly corner of said lot, at approximately 68°18N00O north latitude and 133°22N30O west longitude;

thence southwesterly in a straight line to a peak having an elevation of about 152 m, at approximately 68°16N10O north latitude and 133°24N50O west longitude;

thence westerly in a straight line to a peak having an elevation of about 168 m, at approximately 68°16N00O north latitude and 133°31N00O west longitude;

thence westerly in a straight line to a peak having an elevation of about 61 m, at approximately 68°16N50O north latitude and 133°37N50O west longitude;

thence northwesterly in a straight line to grid reference point 548 000 m E. and 758 5000 m N.;

thence northerly in a straight line to grid reference point 548 000 m E. and 759 3000 m N., said reference points being in accordance with the Universal Transvers Mercator System and being located approximately as shown on the said Inuvik map sheet;

thence easterly in a straight line to a peak having an elevation of about 152 m, at approximately 68°26N40O north latitude and 133°39N30O west longitude; thence southeasterly in a straight line to the point of commencement;

excepting thereout any land within the area described in federal Order in Council numbered PC 1979 - 1153 dated 4th April, 1979 and also excepting thereout the municipality of Inuvik.

TUKTOYAKTUK ZONE: That area lying within 6 km of each side of the highway commonly known as the Dempster Highway from 69°00N north latitude to its termination at Tuktoyaktuk including the area described a follows:

commencing at approximately 69°22N north latitude and 132°45N west longitude;

thence due west to 133°05N west longitude;

thence due north to 69°30N north latitude;

thence due east to 132°45N west longitude;

thence due south to the point of commencement, excepting thereout the municipality of Tuktoyaktuk. R-009-2006,s.3.

SCHEDULE B (Subsection 5(2))

ARCTIC RED RIVER SUB-ZONE: That area lying within 6 km of each side of the highway commonly known as the Dempster Highway from Frog Creek to the Rengleng River excepting any part of that area that lies within the area described as follows:

commencing at the middle thread of the Mackenzie River at 67°21N north latitude and 133°28N west longitude;

thence due west to 133°52N west longitude;

thence due north to the middle thread of the Mackenzie River at approximately 67°31N north latitude;

thence in a southeasterly direction following the middle thread of the Mackenzie River to the point of commencement.

FORT McPHERSON SUB-ZONE: That area lying within 6 km of each side of the highway commonly known as the Dempster Highway from the Northwest Territories - Yukon boundary to Frog Creek excepting any part of that area that lies within the area described as follows:

commencing at the intersection of the east bank of Peel River with the northerly bank of an unnamed steam forming part of a chain of lakes and streams flowing from Dark Water Lake to Peel River, said intersection being at approximately 67°28N15O north latitude;

thence in a general easterly direction along the northerly bank of said chain of lakes and streams to 134°46N00O west longitude;

thence due south to 67°26N10O north latitude;

thence southerly in a straight line to the most easterly extremity of the shore of an unnamed lake at approximately 67°23N10O north latitude and 134°46N30O west longitude;

thence in a general southerly direction along the easterly bank of a chain of lakes and streams to the point where it meets the northerly bank of an unnamed stream at approximately 67°22N05O north latitude;

thence in a general southerly direction along the easterly bank of the last aforesaid stream to the point where it meets the southerly bank of an unnamed river at approximately 67°20N30O north latitude;

thence in a general westerly direction along the southerly bank of the last aforesaid river to intersect with said east bank of Peel River;

thence west in a straight line to the middle thread of Peel River at approximately 67°19N55O north latitude and 134°52N00O west longitude;

thence northerly, along said middle thread, on the westerly side of four unnamed islands to approximately 67°28N15O north latitude;

thence east in a straight line to the point of commencement.

INUVIK SUB-ZONE: That area lying within 6 km of each side of the highway commonly known as the Dempster Highway between Rengleng River and 68°25N north latitude excepting any portion of that area lying within the boundaries of the municipality of Inuvik. R-009-2006,s.4.
