The Commissioner, on the recommendation of the Minister, under section 349 of the Motor Vehicles Act and every enabling power, makes the Motorcycle Helmet Regulations.
HELMET REGULATIONS
(1) The following standards are adopted in respect of helmets to be worn during the operation of a motorcycle:
(a) Canadian Standards Association CAN3-D230-M85, Protective Headgear in Motor Vehicle Applications;
(b) United Nations Economic Commission for Europe Regulation No. 22, Uniform Provisions Concerning the Approval of Protective Helmets and of their Visors for Drivers and Passengers of Motor Cycles and Mopeds (September 24, 2002);
(c) British Standards Institute BS 6658:1985, Specification for Protective Helmets for Vehicle Users;
(d) United States of America Federal Motor Vehicle Safety Standard No. 218 (DOT FMVSS218), Motorcycle Helmets, 49 C.F.R. 571.218;
(e) American National Standards Institute ANSI Z90.1, Protective Headgear for Vehicular User;
(f) Snell Memorial Foundation M2010, 2010 Standard for Protective Headgear for Use with Motorcycles and other Motorized Vehicles.
(2) A prescribed helmet referred to in section 243 of the Act is a helmet that
(a) complies with one of the standards referred to in subsection (1); and
(b) has a label approved by the standards issuing body that is attached to the helmet indicating compliance with the standard.
(3) The prescribed manner of wearing a helmet referred to in section 243 of the Act is
(a) as recommended by the standards issuing body; and
(b) includes the use of a strap that is strongly attached to the helmet and is securely fastened under the chin.
The Motorcycle Helmet Regulations, R.R.N.W.T. 1990, c.M-31, are repealed.
