Definitions

1.

In this Act,

"Board" means the Board of Trustees appointed under section 3; (conseil)

"Fund" means the Natural Resources Conservation Trust Fund. (Fonds)

Special purpose fund established

2.

(1) The Natural Resources Conservation Trust Fund, a special purpose fund as defined in the Financial Administration Act, is established by this Act.

Purpose of Fund

(2) The purpose of the Fund is to promote, through education, research and demonstration, the

(a) wise use of renewable resources;

(b) awareness, enhancement and protection of the environment; and

(c) use of the most efficient and most effective methods of trapping wildlife.

Existing board

3.

(1) The Minister may appoint an existing board to act as the Board under this Act.

Board of Trustees

(2) Where the Minister does not make an appointment under subsection (1), there shall be a Board of Trustees composed of not fewer than three and not more than five Board members, appointed by the Minister.

Term

(3) A Board member shall be appointed to hold office for a term of two years for the first term held by that member and may be reappointed every two years as the Minister considers appropriate.

(4) Each Board member, who is not a member of the public service, shall receive an honorarium as fixed by the Minister and shall be reimbursed for reasonable expenses.

(5) Each Board member who is a member of the public service shall be reimbursed for reasonable expenses.

Chairperson

(6) The Minister shall designate one of the members of the Board as Chairperson of the Board.

Honorarium of Chairperson

(7) The Chairperson shall receive an honorarium and shall be reimbursed for reasonable expenses whether or not the Chairperson is a member of the public service.

Quorum

(8) Three members of the Board constitute a quorum.

Meetings

(9) The Board shall meet at least once during each year.

Function of the Board

4.

(1) The Board shall administer the Fund in accordance with the purpose of the Fund, established in subsection 2(2).

Capital of Fund

(2) The Board may accept donations, bequests and payments for deposit to the capital portion of the Fund.

Interest rate

(3) The Fund shall earn interest at a rate to be fixed by the Financial Management Board.

Interest portion

(4) Interest earned by the Fund shall form the interest portion of the Fund.

Conditions

(5) The Board may accept donations, bequests or payments that are subject to conditions if the conditions are, in the opinion of the Board, appropriate to the purposes of the Fund.

Board bound by conditions

(6) Where the Board accepts donations, bequests or payments that are subject to conditions, the Board is bound to comply with those conditions.

Refusal of funds

(7) The Board may refuse to accept donations, bequests or payments.

Payments from the interest portion

5.

(1) The Board may make payments from the interest portion of the Fund to persons, groups and programs.

Payments from the capital portion

(2) Except with the prior approval of the Minister and subject to subsection (3), the Board may not make payments from the capital portion of the Fund.

Conditional payments

(3) Where the Board has accepted funds under subsection 4(5), the Board may make payments from those funds.

By-laws

6.

(1) The Board shall make by-laws governing its proceedings.

Application

(2) The Board may establish criteria and procedures for submissions to the Board for funding.

By-laws to Minister

7.

(1) The Board shall submit to the Minister, for approval, all by-laws established under section 6.

(2) The Minister may approve or reject by-laws submitted under subsection (1).

Rejection of by-laws

(3) Where the Minister rejects by-laws submitted under subsection (1), the Minister shall provide reasons for the rejection.

Assistance

8.

The Minister may provide such employees of the public service as the Board considers necessary to assist the Board.

Application of Public Service Act

9.

The members of the Board are not members of the public service by virtue of their appointment to the Board.

Liability

10.

Subject to section 139 of the Financial Administration Act, no proceedings lie against a board member acting for or on behalf of the Board under this Act for any act or omission that he or she, acting in good faith, reasonably believes was required or authorized by this Act. Application of Conflict of Interest Act

11.

The Conflict of Interest Act applies to the members of the Board.

Fiscal year

12.

(1) The fiscal year of the Board is the period beginning on the 1st day of April in one year and ending the 31st day of March in the next year.

Accounts

(2) The Board shall keep accounts for each fiscal year.

Auditor

(3) The Board shall appoint an auditor.

Annual audit

(4) The accounts of the Board shall be audited annually.

Report Contents (2)

13.

(1) The Board shall provide an annual report to the Legislative Assembly. The annual report shall contain the following:

(a) the annual audit;

(b) the source and amount of each contribution to the Fund;

(c) the recipient and amount of each payment made from the Fund;

(d) a description of the purpose for which each payment was made from the Fund.
