The Commissioner, upon the recommendation of the Minister, under subsection 23(1) of the Fire Prevention Act and every enabling power, makes the Propane Cylinder Storage Regulations.

1.

In these regulations,

"appliance" includes a barbecue; (appareil)

"local assistant" includes members of the Royal Canadian Mounted Police while on duty in the Territories; (représentant local)

"propane cylinder" means a refillable or non-refillable container approved by the National Transportation Agency or the United States Department of Transportation for the storage and transportation of propane that has a minimum capacity of 2.7 kgs and a maximum capacity of 45.5 kgs. (bouteille de propane)

(1) Subject to subsection (2), no person shall allow a structure owned or occupied by him or her to contain a propane cylinder.

(2) The structures described in sections 10.5.3,

10.5.4.

and 10.5.5 of the CGA B 149.2-M86 Code for Propane Burning Appliances and Equipment may contain one or more propane cylinders in the circumstances and under the conditions described in those sections.

(3) For the purposes of subsection (2), sections 10.5.3, 10.5.4 and 10.5.5 of the CGA B 149.2-M86 Code for Propane Burning Appliances and Equipment are hereby adopted.

(1) A person in possession of a propane cylinder that is connected to an appliance shall ensure that the propane cylinder is locked, chained or otherwise secured to the appliance

(a) by a chain or cable secured by a padlock that may be unsecured only with a key or a cutting tool;

(b) by a chain or cable secured with a bolt that may be unsecured only with a cutting tool or a wrench or other mechanical tool; or

(c) in any other manner approved by the Fire Marshal, the Deputy Fire Marshal, an Assistant Fire Marshal or a local assistant.

(2) A person in possession of a propane cylinder that is not connected to an appliance shall ensure that the propane cylinder

(a) is locked, chained or otherwise secured to a permanent fixture or structure;

(b) is fenced or otherwise contained in a manner that deters persons other than the owner of the propane cylinder, or a person authorized by the owner, from using the propane cylinder and that is approved by the Fire Marshal, the Deputy Fire Marshal, an Assistant Fire Marshal or a local assistant; or

(c) is secured in any other manner approved by the Fire Marshal, the Deputy Fire Marshal, an Assistant Fire Marshal or a local assistant.

(3) Where the manner in which a propane cylinder is secured or contained is approved under paragraph (1)(c), (2)(b) or (2)(c), the Fire Marshal, Deputy Fire Marshal, Assistant Fire Marshal or local assistant shall issue an approval in writing to the person in possession of the propane cylinder.

(4) An approval issued under subsection (3) may be revoked on notice in writing to the person in possession of the propane cylinder, which notice may be delivered to the person by registered mail addressed to the person's latest known address.

(1) No person shall abandon or discard a propane cylinder.

(2) No person shall dispose of a propane cylinder except in accordance with this section.

(3) Every propane cylinder to be disposed of must be delivered to a local assistant or to a refilling station designated by the Chief Inspector appointed under the Gas Protection Act.

These regulations apply according to the terms set out in these regulations before they are published in the Northwest Territories Gazette.
