The Commissioner, on the recommendation of the Minister, under sections 32 and 39 of the Public Trustee Act and every enabling power, makes the Public Trustee Regulations.
In these regulations, "common fund" means the common fund referred to in the Act. (fonds commun de placement)
Interest
The rate of interest payable in respect of estates that have money in the common fund is determined by
(a) calculating the average of the rates of interest earned in respect of the common fund for each of the last four complete weeks before commencement of the month for which the interest is to be paid;
(b) subtracting 0.2% from the rate calculated under paragraph (a); and
(c) rounding the rate calculated under paragraph (b) to the nearest one hundredth of a percent.
Audit
The annual audit referred to in section 38 of the Act must be prepared by March 31 of each year.
Financial Statements
The annual financial statements of the Public Trustee must be in a form satisfactory to the Minister.
Fees
(1) The fees referred to in subsection (2) are prescribed as fees that, for the management of the common fund, may be charged against the common fund and against the persons entitled to the common fund.
(2) Fees for the management of the common fund must, subject to any deduction under subsection (3), be paid to the Public Trustee out of the excess interest earned by the investments in the common fund as follows:
(a) on April 30 of each year, a fee shall be paid in an amount equal to 0.1% of the value of the common fund on that day;
(b) on October 31 of each year, a fee shall be paid in an amount equal to 0.1% of the value of the common fund on that day.
(3) The costs incurred in respect of the annual audit referred to in section 38 of the Act may be deducted from the fees determined under subsection (2).
(1) For the services set out in Schedule A, the Public Trustee may charge fees in the manner and amounts set out in that Schedule.
(2) The person or entity specified in Column 5 of Schedule A shall pay the fee charged by the Public Trustee under subsection (1) at the time specified in Column 6 of that Schedule.
Public Trustee
(1) For legal services provided by the Public Trustee, the Public Trustee may estimate and charge an hourly rate equivalent to that charged by a lawyer in Yellowknife in private general practice with five years experience.
(2) For the preparation of income tax returns and trust returns, the Public Trustee may estimate and charge a rate equivalent to the rate, for similar work, charged by an accountant in private practice in Yellowknife.
(1) The Public Trustee may take funds from a trust or estate under the control or administration of the Public Trustee to pay the fees charged under these regulations.
(2) A person applying for an order confirming settlement under section 52 of the Children’s Law Act shall pay the prescribed fees at the time notice is given to the Public Trustee.
Fees and disbursements payable under these regulations must be paid directly to the Consolidated Revenue Fund of the Government of the Northwest Territories.
Forms
(1) For the purpose of subsection 23.1(2) of the Act, the form of prescribed form is set out in Form 1 of Schedule B.
(2) For the purpose of subsection 26(2) of the Act, the form of election is set out in Form 2 of Schedule B.
(3) When a form from this section is filed with the Court, the form must include a backer in the form set out in Form 3 of Schedule B.
The Public Trustee Regulations, established by regulation numbered R-069-2009, are repealed.
The Public Trustee Fee Regulations, established by instrument numbered R-102-94, are repealed.

NOTICE OF ADMINISTRATION OF SMALL ESTATE
1. In accordance with section 23.1 of the Public Trustee Act, I hereby advise that the Public Trustee is administering, without a grant of administration, the estate of , a deceased person who resided in , Northwest Territories and died on .
2. The deceased’s personal property in the Northwest Territories has an estimated value not exceeding $35,000.
3. In accordance with that section of the Act, the Public Trustee may (a) take possession of the deceased person’s property; (b) dispose of articles of personal use in any manner the Public Trustee considers appropriate; (c) sell property not disposed of under paragraph (b), and apply the proceeds toward payment of amounts due and debts incurred for the burial of the deceased; and (d) do any other thing necessary to complete the administration of the estate.
4. In accordance with subsection 23.1(2) of the Public Trustee Act, this document is conclusive proof that the Public Trustee is the administrator of this estate.

2. The deceased’s personal property in the Northwest Territories has an estimated value not exceeding $75,000 and no grant of probate or administration has been issued in the Northwest Territories.
3. In accordance with subsection 26(3) of the Act, upon the filing of this Notice, the Public Trustee becomes the administrator of the deceased person’s estate and the filed Notice is conclusive proof of the Public Trustee’s right to administer the estate.
4. In accordance with subsection 26(5) the Act, a copy of this Notice that is certified by the Clerk is equivalent to a certified copy of a grant of administration for all purposes.
