The Commissioner, on the recommendation of the Minister, under section 92 of the Public Utilities Act and every enabling power, makes the Public Utilities Regulations.
REGULATIONS
In these regulations, "Act" means the Public Utilities Act.
The following information is to be included in an application for a franchise under subsection 41(1) of the Act:
(a) the name of the public utility;
(b) a statement that the application is made under subsection 41(1) of the Act;
(c) the name of the community or a description of the area in which the public utility wishes to operate;
(d) the date on which the utility proposes to commence operating and the term for which the public utility wishes to operate;
(e) the type of energy the public utility proposes to provide;
(f) the type and purpose of the franchise the utility is applying for;
(g) the proposed terms and conditions of service;
(h) the proposed rights and obligations of the public utility under the franchise;
(i) the proposed rights and obligations of the community under the franchise;
(j) any proposed terms for renewal of the franchise.
The following information is to be included in an application for an amendment to a franchise under subsection 41(1) of the Act:
(a) the name of the public utility;
(b) a statement that the application is made under subsection 41(1) of the Act;
(c) the name of the community or a description of the area with respect to which the franchise was granted under subsection 41(2) of the Act;
(d) the date on which the amendment is to take effect and the term for which the amendment is to be effective;
(e) the type of energy the public utility is providing under the franchise;
(f) the amendment the public utility is seeking to the franchise and the reason for that amendment;
(g) any terms for renewal of the amendment of the franchise.
