The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows:
INTERPRETATION
Definition: "reindeer"
1.In this Act, "reindeer" has the meaning assigned by the regulations.
Conflict or inconsistency
2.This Act and the regulations prevail over other enactments to the extent of any inconsistency unless specifically stated otherwise.
SEIZURE AND FORFEITURE
Seizure
3.If a peace officer or an officer within the meaning of the Wildlife Act believes on reasonable grounds that a reindeer has been killed, that a reindeer or part of a reindeer has been taken, transferred, shipped or had in possession in contravention of the regulations or that a vessel, vehicle, airplane, firearm, trap or other article or thing has been used in contravention of the regulations, he or she may, without a warrant, effect seizure of that reindeer, reindeer part or article or thing.
Forfeiture
4.Every seizure made under section 3 shall be reported as soon as practicable to a justice of the peace who may, on satisfying himself or herself that the reindeer or reindeer part or the vessel, vehicle, airplane, firearm, trap or other article or thing has been taken, dealt with or used in contravention of the regulations, declare it to be forfeited to the Government of the Northwest Territories and on that declaration, it is forfeited.
OFFENCE AND PUNISHMENT
Offence and punishment
5.Every person who contravenes a provision of this Act or the regulations is guilty of an offence and liable on summary conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding one year or to both.
REGULATIONS
Regulations
6.The Commissioner in Executive Council may make regulations
(a) providing for a definition of reindeer for the purposes of this Act and the regulations;
(b) authorizing the Minister to enter into agreements with Indians or Inuit or persons with Indian or Inuit blood living the life or an Indian or Inuk, for the herding of reindeer that are the property of the Commissioner, which agreements, if considered advisable by the Minister, shall include provisions for the transfer of such portions of the herds as may be therein specified to the herders on satisfactory completion of the agreements;
(c) for the control, management, administration and protection of reindeer in the Northwest Territories whether they are the property of the Commissioner or otherwise;
(d) for the sale of reindeer and the slaughter or other disposal of surplus reindeer and the carcasses of those reindeer;
(e) controlling or prohibiting the transfer or shipment by any means of reindeer or their carcasses or parts of reindeer or their carcasses, whether they are the property of the Commissioner or otherwise, from any place in the Northwest Territories to any place within or outside the Territories;
(f) respecting any matters the Commissioner in Executive Council considers necessary to carry out the purposes and provisions of this Act.
TRANSITIONAL
Matters governed by Northwest Territories Act
7.This Act applies to all matters in respect of reindeer that were governed by the Northwest Territories Act (Canada) and the Northwest Territories Reindeer Regulations (Canada) before the coming into force of this Act.
Rights and duties continued
8.All rights and duties accrued or accruing under or matters in respect of reindeer governed by the Northwest Territories Act (Canada) and the Northwest Territories Reindeer Regulations (Canada) before this Act comes into force, are continued under and subject to this Act.
