The Commissioner, on the recommendation of the Minister, under section 41 of the Social Work Profession Act and every enabling power, makes the Social Work Profession General Regulations.

GENERAL REGULATIONS

Approval of Educational Qualifications

1.

For the purposes of subparagraph 4(a)(ii) of the Act,

(a) the Canadian Association for Social Work Education is the body designated to approve a baccalaureate, master’s or doctorate program in social work; and

(b) the Canadian Association of Social Workers is the body designated to approve a program equivalent to a baccalaureate, master’s or doctorate program in social work.

Registration

In addition to the eligibility requirements set out in sections 4 and 5 of the Act, to be eligible for registration as a registered social worker or licensed social worker as the case may be,

(a) a person must demonstrate an intention to practice social work in the Northwest Territories; and

(b) a person who is registered and authorized to engage in the practice of social work in a province or territory must prove that their registration

(i) is not limited to a temporary period of time that is less than the period for full registration, and

(ii) permits the person to engage in the practice of social work

(A) without any conditions or restrictions imposed on the person’s practice,

(B) without a requirement for supervision of the person’s practice, and

(C) without a requirement that the person complete additional training or examination prior to entitlement to exercise the entire scope of practice.

(1) On application to be registered as a registered social worker or a licensed social worker under subsection 6(1) of the Act an applicant shall, in addition to providing the information required by the Act, provide the Registrar with the following:

(a) a mailing address and telephone number for the applicant;

(b) a photograph of the applicant clearly showing the applicant’s face, taken within six months of the application;

(c) proof that the applicant is entitled to work in Canada;

(d) information about the languages written and spoken by the applicant;

(e) information in respect of the applicant’s prospective employment or practice as a registered social worker or licensed social worker in the Northwest Territories, including

(i) the planned date of commencement, and

(ii) the particulars of the prospective employer or place of practice;

(f) a resume including all employment history relevant to the practice of social work;

(g) if the applicant is registered as a registered social worker in a province or territory, or is otherwise registered and authorized to engage in the practice of social work in a province or territory, proof that the applicant’s registration is in good standing and meets the criteria referred to in subparagraphs 2(b)(i) and (ii);

(h) if the applicant is not registered in a province or territory and is applying for registration as a registered social worker,

(i) a copy of the applicant’s degree, diploma or certificate from a program referred to in subparagraph 4(a)(ii) of the Act, or

(ii) documentation proving that the applicant has completed a program approved as equivalent to a program referred to in subparagraph 4(a)(ii) of the Act;

(i) if the applicant is not registered in a province or territory and is applying for registration as a licensed social worker, a copy of the diploma or certificate from a program referred to in subparagraph 5(a)(ii) of the Act;

(j) information about each current and previous registration authorizing the applicant to engage in the practice of social work in the Northwest Territories or any other jurisdiction, including dates of registration, class of registration, periods of active practice, any restrictions in respect of practice, any periods of suspension or cancellation, and any revocations;

(k) information about each application by the applicant for registration that has been refused in the Northwest Territories or any other jurisdiction;

(l) information about a settlement or judgment in any civil law suit that relates to the applicant’s practice as a registered social worker or licensed social worker in the Northwest Territories or any other jurisdiction;

(m) the results of a criminal record check obtained from the Royal Canadian Mounted Police and dated not more than six months before the date the application is submitted;

(n) information about any conviction of the applicant for an offence under any law in any jurisdiction that may be relevant to the applicant’s practice as a registered social worker or licensed social worker;

(o) information about any physical, mental or medical condition, including an addiction, of the applicant that may affect the ability of the applicant to practice as a registered social worker or licensed social worker;

(p) a statement signed by the applicant, in a form approved by the Registrar, confirming the information provided by the applicant in the application form and supporting documentation is true.

Renewal

4.

In addition to the eligibility requirements set out in subsection 8(1) of the Act, to be eligible for renewal of a licence, a registrant must demonstrate an intention to continue to practice social work in the Northwest Territories.

(1) On application for the renewal of a licence under subsection 8(3) of the Act, the registrant shall provide the Registrar with a completed renewal application form and other supporting material, including the following:

(a) information satisfactory to the Registrar confirming the identity of the registrant;

(b) a mailing address and telephone number for the registrant;

(c) information in respect of the registrant’s employer and place of employment, or the registrant’s practice and place of practice;

(d) the registrant’s business address and business telephone number;

(e) in any year where required under subsection 8(2), a statement signed by the registrant, in a form approved by the Registrar, confirming the registrant’s compliance with continuing competency requirements;

(f) information about each finding against the registrant of unprofessional conduct, including professional misconduct, incompetence to practice, incapacity to practice, or lack of fitness to practice as a registered social worker or licensed social worker in the Northwest Territories or any other jurisdiction;

(g) information about any investigation, proceeding or finding in respect of the conduct or competence of the registrant related to the registrant’s practice as a registered social worker or licensed social worker in the Northwest Territories or any other jurisdiction;

(h) information about a settlement or judgment in any civil law suit that relates to the registrant’s practice as a registered social worker or licensed social worker in the Northwest Territories or any other jurisdiction;

(i) information about any conviction of the registrant for an offence under the Criminal Code or any other law in any jurisdiction that may be relevant to the practice of a registered social worker or licensed social worker;

(j) information about any physical, mental or medical condition, including an addiction, of the registrant that may affect the registrant’s ability to practice as a registered social worker or licensed social worker;

(k) a statement signed by the registrant, in a form approved by the Registrar, confirming the information provided by the registrant in the application form and supporting documentation is true.

(2) On application for a new registered social worker licence or licensed social worker licence under subsection 9(3) of the Act, the registrant shall provide the Registrar with a completed application form containing the information and other supporting material referred to in subsection (1). Fees

6.

(1) The fee prescribed under subsection 6(4) of the Act for registration of an applicant as a registered social worker or licensed social worker is $191.

(2) The fee prescribed under subsection 8(6) of the Act for renewal of a registered social worker licence or licensed social worker licence is $191.

(3) The fee prescribed under subsection 8(5) of the Act as a late fee to be paid in addition to the renewal fee for a renewal of a licence for a registered social worker or licensed social worker is $128.

(4) The fee prescribed under subsection 9(5) of the Act for a new registered social worker licence or licensed social worker licence is $319. R-087-2025,s.2.

Conduct and Competency

7.

(1) The Code of Ethics, established by the Canadian Association of Social Workers in 2005, as amended from time to time, is adopted.

(2) The Northwest Territories Standards of Practice for Social Workers, adopted by the Northwest Territories Social Work Regulation Subcommittee on October 21, 2011, as amended from time to time, are adopted.

(1) The Continuing Competency Program, established by the Northwest Territories Social Work Regulation Subcommittee on October 21, 2011, as amended from time to time, is adopted.

(2) The Registrar shall designate a reporting period following the completion of which a registrant shall, as part of an application to renew their licence, provide the Registrar with a statement signed by the registrant, in a form approved by the Registrar, confirming the registrant’s compliance with the requirements of the Continuing Competency Program.

(3) The Registrar may waive the requirement for a registrant to obtain the full number of credits required by the Continuing Competency Program for a reporting period if the Registrar is satisfied that a waiver is warranted in the circumstances. R-101-2024,s.5.

9.

A registrant shall

(a) keep, for a period of five years, supporting documentation respecting activities undertaken in accordance with the Continuing Competency Program adopted under subsection 8(1); and

(b) provide to the Registrar, at any time requested by the Registrar, the supporting documentation referred to in paragraph (a).

10.

These regulations come into force January 1, 2012.
