Interpretation

1.

(1) In these regulations,

"Act" means the Territorial Parks Act; (Loi)

"application" means an application for a park use permit made under section 11; (demande)

"camp" means to remain in a Territorial Park overnight, either with or without a tent or other temporary shelter; (camper)

"campsite" means an area in a Territorial Park developed as a powered campsite, a non-powered campsite or a walk-in tent campsite, to accommodate a party of campers; (emplacement de camping)

"extended stay campsite permit" means a permit issued to an applicant for a campsite under section 30.2; (permis de camping de long séjour)

"park use permit" includes any of those classes of park use permit established under section 10; (permis d’utilisation)

"picnic area" means a point of interest or an area designed and developed for picnickers and other daytime users in a Territorial Park that is designated by signs under section 31.1; (aire de pique-nique)

"public campground" means an area in a Territorial Park developed to accommodate campers and designated by signs as a public campground under section 28; (terrain de camping public)

"quiet time" means the time period designated as quiet time in subsection 16.1(1); (période de quiétude)

"recreational vehicle" includes a trailer, camper trailer, tent trailer, camper truck, motorhome and any other like vehicle intended for overnight accommodation but does not include an automobile, motorcycle or all-terrain vehicle as defined in the All-Terrain Vehicles Act; (Véhicule de loisir)

"season" means the period each year in which a Territorial Park is open to the public; (saison) "special all-terrain vehicle" has the same meaning as in subsection 1(1) of the All-terrain Vehicles Act. (véhicule spécial)

(2) Words and expressions used in these regulations have the same meaning as in the Act.

PART I

GENERAL

Territorial Park Signs

2.

The Superintendent may erect signs or cause signs to be erected at the main entrances of Territorial Parks that indicate the name of the park and the purposes for which it may be used. R-063-94,s.3.

Application of Regulations

3.

These regulations apply to all Territorial Parks.

Environment Protection

4.

No person shall, in a Territorial Park, deposit or leave garbage, sewage, bottles, cans, paper, plastic containers or other litter, waste or obnoxious material in a place other than in a receptacle or pit provided for that purpose.

5.

If there is no designated disposal pit, receptacle or disposal area, every person using or travelling in a Territorial Park shall remove from the park all of their garbage, bottles, cans, paper, plastic containers or other litter, waste or obnoxious material. R-013-2013,s.3; R-065-2022,s.3.

5.1.

Subject to the Forest Management Act and these regulations, no person shall cut, damage, use or transport timber that is standing or has fallen in a Territorial Park. R-050-2009,s.3.

6.

(1) The Superintendent may, at any time and for such period as the Superintendent considers necessary for the management and control of a Territorial Park, make an order temporarily prohibiting or restricting the setting and use of fires in that park or part of that park.

(2) If an order is made under subsection (1), the Superintendent shall cause signs to be erected or notices to be posted at the entrance to the Territorial Park or part of that park to which the order applies indicating the prohibition or restriction and its duration, as set out in the order.

(3) No person shall contravene an order made by the Superintendent under this section. R-050-2009,s.4; R-041-2013,s.2; R-065-2022,s.4.

6.1.

(1) Subject to the Forest Protection Act and these regulations, no person shall, in a Territorial Park

(a) set or use a fire except in a place provided or designated for that purpose;

(b) set or use a fire that is more than 0.5 m in diameter and 0.5 m in height; or

(c) leave a fire unattended or leave the area unless the fire is extinguished.

6.2.

A park officer may extinguish a fire that the officer determines has been set or is being used in contravention of the Act or these regulations, or of an order made or a park use permit issued under the Act or these regulations. R-041-2013,s.2.

7.

No person shall, in a Territorial Park,

(a) advertise by word, character, device or sign designed to advertise a business, profession, service or article or an exhibition or event; or

(b) offer for sale services, food, beverage or equipment unless the terms and conditions of a park use permit authorize the person to do so.

8.

(1) No person shall launch a boat in a Territorial Park from a boat trailer, unless it is launched from an area designated by signs as a boat launching site.

(2) No person shall park a vehicle or trailer in a Territorial Park except in a parking area designated by signs or as otherwise directed by a park officer.

(3) No person shall abandon a boat, trailer, vehicle, tent or other thing or a portion of a boat, trailer, vehicle, tent or other thing in a Territorial Park. R-048-93,s.2; R-064-2004,s.2; R-044-2017,s.2.

9.

(1) The Superintendent may remove or cause to be removed to a location determined by the Superintendent to be appropriate for storage a boat, trailer, vehicle, tent or other thing that has been left unattended in a Territorial Park for a period of more than 48 hours, and is not authorized under the terms and conditions of a park use permit.

(1.1) The Superintendent may immediately remove or cause to be removed to a location determined by the Superintendent to be appropriate for storage a boat, trailer or vehicle that is stopped, parked or left on the travelled portion of a park road, or in such a manner as to impede the proper use of a park road.

(2) The Superintendent shall ensure that all reasonable care is taken in the removal of anything under subsection (1) or (1.1), but neither the Superintendent nor a person acting under the authority of the Superintendent is liable to an action or proceeding for or in respect of an act done or omitted to be done in good faith in the exercise of the powers granted by subsection (1) or (1.1).

(2.1) If the Superintendent removes or causes to be removed any item under this section, any cost associated with the removal, storage or disposal of that item

(a) is the responsibility of the owner of the item;

(b) constitutes a charge on the item, and may be recovered before the item is released to the owner or operator of the item; and

(c) may be recovered from the owner in a civil action for debt.

(3) After retaining an item removed under subsection (1) or (1.1) for a period of 90 days, the Superintendent may dispose of the item in any manner that the Superintendent considers appropriate.

(4) If, within one year after the disposal under subsection (3) of an item by public auction or sale, a person satisfies the Superintendent that the person was the lawful owner of the item, the Superintendent shall direct the payment to that person of an amount equal to the price received for that item, minus any costs associated with the removal, storage or disposal of that item. Alcohol Prohibitions or

Restrictions

9.1.

(1) The Superintendent may, at any time and for such period as the Superintendent considers necessary for the management and control of a Territorial Park, make an order temporarily prohibiting or restricting the possession or consumption of alcohol in that park or part of that park.

(2) If an order is made under subsection (1), the Superintendent shall cause signs to be erected or notices to be posted at the entrance to the Territorial Park or part of that park to which the order applies, indicating the prohibition or restriction and its duration, as set out in the order.

(3) No person shall contravene an order made by the Superintendent in accordance with this section. R-027-2012,s.3; R-013-2013,s.4; R-065-2022,s.4.

Possession of Animals in a Territorial Park

9.2.

(1) Subject to subsection (2), no person shall bring an animal into or allow an animal in the person’s possession to enter or remain in or on any of the following areas:

(a) a beach area;

(b) a public washroom, shower or change house;

(c) an area designated by a sign to be a children’s play area;

(d) a picnic shelter, concession or other public building or structure.

(2) Subsection (1) does not apply to prevent the use of a service dog in an area referred to in that subsection, if the dog is being used to provide required assistance to a person who is blind or visually impaired or a person with another medical disability. R-027-2012,s.3; R-065-2022,s.6.

9.3.

Every person in possession of an animal in a Territorial Park shall ensure that all excrement or other solid waste originating from the animal is disposed of in a receptacle or pit provided for that purpose or removed from that park. R-075-2014,s.3.

Classes of Park Use Permits R-065-2022,s.7.

PART II

PARK USE PERMITS

10.

The following classes of park use permit are established:

(a) commercial use permit;

(b) daily campsite permit;

(c) extended stay campsite permit;

(d) group camping permit;

(e) sleeping accommodation permit;

(f) special event permit;

(g) daily vehicle entrance permit;

(h) seasonal vehicle entrance permit;

(i) special all-terrain vehicle permit;

(j) picnic shelter permit.

Campsite and Picnic Shelter Online Reservations R-007-2024,s.2.

10.1.

(1) The Superintendent may establish and operate a reservation service, through a website maintained by or on behalf of the Government of the Northwest Territories, that allows a person to reserve a campsite, sleeping accommodation, picnic shelter or other area.

(2) A person who wishes to make a reservation using the online reservation system shall submit the fee prescribed in item 11 of Schedule D through the system. R-007-2024,s.2. Applications R-065-2022,s.7.

11.

(1) Subject to these regulations, a person who wishes to obtain a commercial use permit shall complete the application in Form 1 of Schedule C, and submit it to the Superintendent together with the fee prescribed in Schedule D.

(2) Subject to these regulations, a person who wishes to obtain an extended stay campsite permit shall complete the application in Form 2 of Schedule C, and submit it to the Superintendent together with the fee prescribed in Schedule D.

(3) Subject to these regulations, a person who wishes to obtain any other type of park use permit shall make a request for the specific type of permit sought and submit the prescribed fee to the Superintendent or to a vendor appointed under section 32 of these regulations.

(4) The Superintendent may waive the requirement for the payment of a fee under subsections (1) to (3). R-065-2022,s.7.

12.

13.

If an application is refused, the Superintendent shall notify the applicant in writing and shall refund the fee in the amount paid. R-013-2013,s.3.

14.

The Superintendent may refuse to issue a park use permit if

(a) the intended use for which the application is made is not compatible with the purpose of the Territorial Park;

(b) satisfactory arrangements have not been made for the supply of water and the disposal of garbage and sewage; or

(c) the application is for a cottage or other dwelling, unless staff accommodations are required for an approved business in a Territorial Park.

15.

Terms and Conditions

16.

(1) Subject to these regulations, the Superintendent may specify in a park use permit the terms and conditions to be followed by the permit holder.

(2) No person shall contravene the terms and conditions of a park use permit. R-050-2009,s.9; R-027-2012,s.4.; R-013-2013,s.7.

16.1.

(1) The time period from 10:30 p.m. until 7:00 a.m of the following day is designated as quiet time in all Territorial Parks.

(2) No person shall, during quiet time, make or allow a noise to be made which will or could reasonably be expected to disturb the quiet and peaceful enjoyment of the park by another person. R-075-2014, s.4.

17.

Subject to these regulations, a park use permit must be issued in a form approved by the Minister. R-048-93,s.5; R-050-2009,s.10; R-025-2025,s.2.

18.

(1) Subject to subsection (2), no rebate of a park use permit fee shall be allowed to the permit holder in respect of

(a) the cancellation of the park use permit; or

(b) the non-use of the park use permit during all or part of the period in respect of which the park use permit was issued.

(2) The Superintendent may allow the rebate, in whole or part, of a park use permit fee if the Superintendent is satisfied that it is appropriate in the circumstances. R-048-2015,s.3.

19.

Subject to section 30.2, no person shall stay in any one park,

(a) if no park use permit is required, more than 14 days a year; and

(b) if a park use permit is required and the person is the holder of a park use permit,

(i) if the person fails to comply with the terms and conditions of the permit, or

(ii) if the person fails to comply with an order issued by a park officer under section 11 of the Act.

20.

(1) If a park officer is of the opinion that a person is acting in contravention of section 9.1 or 19, the park officer may order that person to leave the park within a specified time.

(2) A park officer may use such force as is reasonably necessary to remove from a park a person who fails to comply with an order given in subsection (1).

(3) No person who has been ordered to leave a park under this section is entitled to a refund of fees paid under these regulations. R-027-2012,s.5; R-013-2013,s.3.

20.1.

No person shall

(a) obstruct a park officer in the lawful exercise of a power or the lawful performance of a duty under this Act or the regulations; or

(b) provide false or misleading information to a park officer exercising a power or performing a duty under this Act.

Appeal

21.

(1) If the Superintendent

(a) refuses to issue a park use permit, or

(b) cancels a park use permit,

the applicant may appeal, in writing, to the Minister within 21 days after the day the applicant is notified of the refusal or cancellation.

(2) If the Minister is satisfied that the Superintendent was not justified in refusing the application or cancelling the park use permit, the Minister may order the Superintendent to issue or reinstate the park use permit, as the case may be. R-064-2004,s.5; R-013-2013,s.3.

PART III

COMMERCIAL USE PERMITS

22.

No person shall establish, conduct or engage in any business, commercial enterprise, industrial activity, scientific activity, guiding services or outfitting services in a Territorial Park, unless the person first obtains a commercial use permit. 22.1.

No person shall construct, alter or move a building, structure, fixture, sign or means of access in a Territorial Park, unless the person first obtains a commercial use permit. R-050-2009,s.14; R-065-2022,s.8.

23.

If the applicant for a commercial use permit intends to construct, alter or move a building, structure, fixture, sign or means of entry, the application shall be supported by

(a) a floor plan and elevation plan drawn to a scale of not less than 1:100 showing all floors, elevations and the dimensions of the floors and elevations;

(b) a site plan drawn to a scale of not less than 1:1,200 showing the location and size of the buildings to be constructed or moved onto the site, the size and location of existing buildings and the boundaries of the site;

(c) details of water and sewage services;

(d) a specification list of materials to be used in construction or alteration of the building or structure; and

(e) in the case of a means of entry or sign, a plan showing the location of the entry or sign.

23.1.

(1) The Superintendent may include in a commercial use permit, terms and conditions respecting

(a) the methods and types of equipment used to clear land and construct a means of access;

(b) the layout of a building, structure or earth works;

(c) the size and exterior finish of a building;

(d) the period of time a park use permit is valid;

(e) the time allowed for a permit holder to commence and complete the construction or alteration of a building, structure or means of entry;

(f) the provision of water for domestic purposes;

(g) the disposal of garbage, sewage or other wastes;

(h) the maintenance and upkeep of a land surface, building or place of business;

(i) the cutting or removal of trees or shrubs;

(j) the storage and handling of petroleum products and other combustible materials;

(k) the protection of places of recreational, historical, cultural, geological, archaeological or scenic value;

(l) scientific activity necessitating excavation or other disturbance of the surface of the ground or of flora and fauna;

(l.1) the number of persons and vehicles authorized by the commercial use permit;

(l.2) the permit holder’s interaction with the holders of other park use permits; and

(m) any other matters not inconsistent with the Act and these regulations that may be necessary to preserve

(i) the natural environment, or

(ii) the right of other permit holders to quiet and peaceful enjoyment of the park.

(2) If an applicant for a commercial use permit applies for the right to occupy land in a Territorial Park for the purpose of carrying on a business, the commercial use permit shall contain provisions satisfactory to the Minister respecting terms and conditions of occupancy and removal. 24.

The owner or operator of a building or structure constructed, altered or moved into a Territorial Park shall ensure that

(a) the requirements of the National Building Code of Canada, as amended, are complied with; and

(b) all licences, permits and approvals required by the Electrical Protection Act, the Fire Prevention Act, and the regulations made under those Acts, are obtained.

25.

If the applicant for a commercial use permit intends to use premises to provide accommodation or food services to the public, the application must be accompanied by a certificate certifying that the premises comply or will comply with Public Health Act and the regulations made under that Act. Acquisition of Business or Building

26.

A person who wishes to acquire in a Territorial Park by purchase or otherwise a business or a building, structure, fixture or sign, that person shall apply to the Superintendent for a commercial use permit, notwithstanding that the intended vendor is in possession of a commercial park use permit. PART IV

CAMPING AND SLEEPING

ACCOMMODATION PERMITS

27.

(1) No person shall camp in a Territorial Park except

(a) in a place designated as a campsite in a public campground and in accordance with the terms and conditions of a daily campsite permit, extended stay campsite permit or group camping permit;

(b) in a structure designated as a sleeping accommodation and in accordance with the terms and conditions of a sleeping accommodation permit; or

(c) in an area other than a campsite where camping is permitted, as designated in writing by the Superintendent.

27.1.

No daily campsite permit, group camping permit or sleeping accommodation permit shall be issued to a person under 16 years of age. R-065-2022,s.9.

28.

Notwithstanding these regulations, no person shall camp, without written permission of a park officer, in one of the following public campgrounds for a total of more than 14 days in a 30-day period during the period beginning June 15 and ending August 15:

(a) Fort Simpson Territorial Park;

(b) Fred Henne Territorial Park.

28.1.

Notwithstanding these regulations, no person shall camp, other than for recreational purposes, without written permission of a park officer, in one of the following public campgrounds for a total of more than 14 days in a 30-day period during the period beginning June 15 and ending August 15:

(a) Fort Providence Territorial Park;

(b) Fort Smith/Queen Elizabeth Territorial Park;

(c) Hay River Territorial Park;

30.

(1) Notwithstanding any other provision of these regulations, the Superintendent may designate in writing certain campsites, at certain public campgrounds, as campsites for which an extended stay campsite permit may be issued.

(2) No later than April 30, the Superintendent shall publicly advertise campsites designated under subsection (1). R-058-96,s.4; R-050-2009,s.18.

Terms and Conditions

30.1.

The Superintendent may include in a daily campsite permit, extended stay campsite permit, group camping permit or sleeping accommodation permit, terms and conditions respecting

(a) the permitted uses of the campsite, group camping area or sleeping accommodation site for recreational purposes;

(b) any restriction on starting or maintaining a fire at the campsite, group camping area or sleeping accommodation site;

(c) the number of persons and vehicles authorized at the campsite, group camping area or sleeping accommodation site;

(d) the protection of the right of others to the quiet and peaceful enjoyment of the Territorial Park; and

(e) such other matters not inconsistent with the Act and these regulations as may be necessary for the preservation, control and management of the Territorial Park.

30.11.

No person shall, except with the permission of the Superintendent, park or allow to be parked more than one recreational vehicle at a campsite or extended stay campsite. R-075-2014,s.5.

30.2.

Extended Stay Campsite Permits

30.2.

(1) Each year, the following extended stay campsite permits shall be available to applicants by draw:

(a) 20 extended stay campsite permits for Prelude Lake Territorial Park, for the period May 15 to July 15;

(b) 20 extended stay campsite permits for Prelude Lake Territorial Park, for the period July 16 to September 15;

(c) 20 extended stay campsite permits for Reid Lake Territorial Park, for the period May 15 to July 15;

(d) 20 extended stay campsite permits for Reid Lake Territorial Park, for the period July 16 to September 15;

(e) 10 extended stay campsite permits for Reid Lake Territorial Park, for the period May 15 to September 15.

(2) The draw for extended stay campsite permits is subject to the following conditions:

(a) the draw must be held on a date established by the Superintendent each year;

(b) an applicant may submit only one application per family for each draw;

(c) an application may only be made for an extended stay campsite permit in the name of the applicant and not on behalf of any other person;

(d) an applicant shall provide proof of registration in the name of the applicant, of the recreational vehicle, if any, to be used on the campsite;

(e) proof of registration of a particular recreational vehicle may not be provided for more than one application.

(2.1) Notwithstanding subsections (1) and (2), the Superintendent may cancel a draw for extended stay campsite permits in one or more parks, if the Superintendent considers that it is advisable to do so due to special circumstances.

(3) The use of an extended stay campsite permit is subject to the following conditions:

(a) the permit holder shall provide proof of registration in the name of the permit holder, of the recreational vehicle, if any, at the time of entry of that recreational vehicle into the Territorial Park;

(b) the permit holder may not transfer the permit to any other person;

(c) all guests of the permit holder must register before entering the Territorial Park;

(d) a particular recreational vehicle may only be used in respect of one extended stay campsite permit.

Group Camping Permits

30.3.

(1) In this section and in section 30.4, "unit" means an individual recreational vehicle or tent or other temporary structure used for overnight accommodation.

(2) The Superintendent may designate, in writing, certain areas in public campgrounds as group camping areas to accommodate parties camping together in four or more units.

(3) The Superintendent may designate a maximum number of units that may be located in a group camping area at any particular time.

(4) A request by a party of campers to obtain a group camping permit must be accompanied by

(a) a list of the names of all adults in the party; and

(b) the type and number of units to be located in the group camping area.

30.4.

Sleeping Accommodation Permits

30.5.

(1) The Superintendent may designate, in writing, certain structures in certain Territorial Parks that may be used as sleeping accommodations.

(2) No person shall occupy a sleeping accommodation structure without a sleeping accommodation permit. R-043-2011,s.6.

PART IV.1

SPECIAL EVENT PERMITS

30.6.

(1) In this Part, "special event" means an event or organized activity that is likely to affect the public’s normal use and enjoyment of the park due to

(a) the nature of the event,

(b) the number of people attending the event, or

(c) the event’s location in the park.

(2) For greater certainty, a "special event" under subsection (1) does not include an activity for which a commercial use permit or a picnic shelter permit is required.

(3) No person shall conduct a special event in a Territorial Park without a special event permit. R-065-2022,s.11.

PART V

VEHICLE ENTRANCE AND SPECIAL

ALL-TERRAIN VEHICLE PERMITS

31.

(1) For the purposes of this section, "vehicle" includes an automobile, motorcycle and recreational vehicle.

(2) The Superintendent may designate, in writing, any area of a Territorial Park, other than a Wayside Park, as an area for which a daily or seasonal vehicle entrance permit is required for the entry of a vehicle.

(3) If an area of a Territorial Park is designated by the Superintendent under subsection (2) as an area for which a daily or seasonal vehicle entrance permit is required, the Superintendent shall cause signs indicating that designation to be erected at the entrances to the designated area.

(4) Subject to section 31.04, no person shall bring a vehicle into a designated area of a Territorial Park for which a vehicle entrance permit is required unless the person displays a daily or seasonal vehicle entrance permit in or on the vehicle as required by the permit.

(5) A daily vehicle entrance permit is valid only for the Territorial Park in which it is issued, and for any entry made to that park during the day for which it is issued.

(6) A seasonal vehicle entrance permit is valid only for the Territorial Park or Parks in respect of which it is issued, and for any entry into the park or parks during the period for which it is issued. R-048-93,s.8; R-058-96,s.5; R-050-2009,s.20; R-027-2012,s.7; R-013-2013,s.3.

31.01.

(1) The Superintendent may designate, in writing, any Territorial Park as a park for which a special all-terrain vehicle permit is required for the operation of a special all-terrain vehicle within that park.

(2) If a Territorial Park is designated by the Superintendent under subsection (1) as a park for which a special all-terrain vehicle permit is required, the Superintendent shall cause signs indicating that designation to be erected at the entrances to the park. R-027-2012,s.8; R-013-2013,s.3.

31.02.

(1) A person may obtain a special all-terrain vehicle permit for a special all-terrain vehicle that

(a) is covered by a motor vehicle liability policy that complies with the Insurance Act;

(b) is registered under the All-terrain Vehicles Act, an Act of another jurisdiction, or under a municipal bylaw; and

(c) bears a licence plate.

(2) A request for a special all-terrain vehicle permit must be accompanied by

(a) information respecting the insurance coverage for and registration of the special all-terrain vehicle and its make, model, colour and year; and

(b) a list of the names and ages of all users authorized to operate the special all-terrain vehicle.

(3) A special all-terrain vehicle permit

(a) must be issued in Form 4 of Schedule C;

(b) is subject to the terms and conditions set out on the form; and

(c) is valid only for the Territorial Park in respect of which it is issued, and for any entry made to that park during the period for which it is issued.

31.03.

(1) Subject to section 31.04, no person shall operate a special all-terrain vehicle within a Territorial Park designated under section 31.01 unless the person

(a) is authorized to do so under a special all-terrain vehicle permit; and

(b) complies with the terms and conditions of that permit.

(2) The holder of a special all-terrain vehicle permit shall ensure that only authorized persons named on the permit operate the special all-terrain vehicle and that they do so in accordance with the terms and conditions of that permit. R-027-2012,s.8; R-065-2022,s.8.

31.04.

The following persons are exempt from the requirement to obtain a vehicle entrance permit or a special all-terrain vehicle permit for a Territorial Park, if they require the use of a vehicle or special all-terrain vehicle within that park to carry out their duties as set out in the Act and these regulations or as required by a contract:

(a) park officers;

(b) vendors authorized by the Superintendent under section 32 and employees of vendors;

(c) contractors of the Superintendent, or of a vendor, who are providing services in respect of a Territorial Park.

PICNIC SHELTER PERMITS

31.1.

The Superintendent may cause signs designating picnic areas to be erected. R-050-2009,s.21.

31.2.

No person shall use or occupy a picnic shelter without a picnic shelter permit. R-050-2009,s.21.

31.21.

The Superintendent may include in a picnic shelter permit terms and conditions respecting

(a) the permitted uses of the picnic shelter for recreational purposes;

(b) any restriction on starting or maintaining a fire at the picnic shelter;

(c) the number of persons and vehicles authorized at the picnic shelter;

(d) the protection of the right of others to the quiet and peaceful enjoyment of the Territorial Park; and

(e) such other matters not inconsistent with the Act and these regulations as may be necessary for the preservation, control and management of the Territorial Park.

PART V.2

PROHIBITION ORDERS

31.3.

(1) A person who is the subject of a prohibition order issued by the Superintendent under section 9.1 of the Act may appeal, in writing, to the Minister within 21 days after the day the person receives a copy of the order.

(2) The Minister may make any inquiries the Minister considers necessary to decide the appeal.

(3) The Minister may confirm, vary or set aside the prohibition order made by the Superintendent.

(4) A decision of the Minister on an appeal under this section is final. R-027-2012,s.9; R-065-2022,s.12.

31.4.

A park officer may

(a) order a person to leave a Territorial Park if the person is prohibited from being within the park under an order made by the Superintendent under section 9.1 of the Act or by a court under section 14.1 of the Act; and

(b) use such force as is reasonably necessary to remove from a park a person who fails to comply with an order given by the park officer under paragraph (a).

PART VI

SALE OF PERMITS

32.

The Superintendent may, in writing, authorize

(a) an employee of the Government of the Northwest Territories, or

(b) another person,

to act as vendor for the purpose of collecting fees and issuing park use permits other than commercial use permits.

(2) The authorization of a vendor is subject to such terms and conditions as the Superintendent may consider necessary.

(3) The authorization of a vender expires on October 30 of the year in which the vendor is authorized under subsection (1), or sooner on

(a) the resignation of the vendor; or

(b) the revocation of the authorization by the Superintendent for a breach of the terms and conditions of the authorization.

33.

Heritage Parks shall be designated, developed and maintained if they

(a) have the support of the neighbouring communities as to their designation;

(b) promote the cultural heritage of the Northwest Territories;

(c) are attractive to and accessible to tourists and visitors;

(d) are able to tolerate the influx of visitors and tourists; and

(e) lend themselves to on-site interpretation and explanation.

35.

(1) An operator of a Territorial Park under an agreement under section 6 of the Act,

(a) shall maintain standards of operation determined by the Superintendent for parks operated directly by the Government of the Northwest Territories;

(b) may adopt a system of campsite permits and their form subject to the prior approval of the Superintendent; and

(c) may only undertake capital improvements with the prior approval of the Superintendent.

(2) The ownership of capital improvements shall be determined by agreement between the Government of the Northwest Territories and the operator.

SPECIAL ALL-TERRAIN VEHICLE USE TERMS AND CONDITIONS

Subject to the reservations and exceptions of the Territorial Parks Act and the Territorial Parks Regulations, this permit is issued subject to the following terms and conditions:

1. The operator shall be at least 14 years of age.

2. The operator shall (a) hold a valid driver's licence issued under the Motor Vehicles Act or under the laws of another jurisdiction; or (b) be under the immediate supervision of the holder of a valid driver’s licence.

3. An operator is under immediate supervision when, at all times, (a) the operator is able to see the supervisor; (b) the supervisor is able to see the operator; and (c) the supervisor is able to provide immediate verbal or visual direction to the operator.

4. The operator shall wear a helmet while operating the special all-terrain vehicle.

5. The operator shall operate the special all-terrain vehicle with due care and attention and shall not drive recklessly.

6. The operator shall not operate the special all-terrain vehicle between 10:30 p.m. and 7:30 a.m.

7. The operator shall only operate the special all-terrain vehicle on a park road.

8. The special all-terrain vehicle must be covered by a motor vehicle liability policy that complies with the Insurance Act.

9. A special all-terrain vehicle permit is required for the operation of a special all-terrain vehicle in any designated Territorial Park.
