Whereas the Commissioner in Executive Council wishes to establish the Thaidene Nëné Territorial Protected Area, to give it the status and protection of a protected area under the Protected Areas Act;
And whereas section 17 of the Protected Areas Act requires that a protected area be established by regulation and that the establishing regulations set out particulars with respect to the protected area;
And whereas the Commissioner in Executive Council wishes to enact regulations meeting the required content, while regulations are in development to provide for the comprehensive management structure for the area consistent with the establishment agreements for the protected area;
The Commissioner in Executive Council, under section 17 of the Protected Areas Act and every enabling power, makes the Thaidene Nëné Territorial Protected Area Regulations.
In these regulations,
"extractive use" means any process that involves the extraction of surface or subsurface resources occurring within or flowing through the Thaidene Nëné Territorial Protected Area, including timber and non- timber forest resources, minerals, energy and water, but does not include the extraction of resources required for the operation and management of the Thaidene Nëné Territorial Protected Area; (utilisation extractive)
"Thaidene Nëné Territorial Protected Area" means the Thaidene Nëné Territorial Protected Area established under section 2. (aire protégée territoriale Thaidene Nëné)
Establishment
(1) The Thaidene Nëné candidate protected area, approved under section 11 of the Protected Areas Act, is established as the Thaidene Nëné Territorial
(2) The boundaries of the Thaidene Nëné Territorial Protected Area are set out in the Schedule.
Activities Within the Protected Area
(1) No person shall engage in any of the following activities within the Thaidene Nëné Territorial Protected Area unless authorized by a valid protected area permit:
(a) extractive uses necessary for the community purposes of Łutsel K’e;
(b) artisanal extractive uses by individuals.
(2) No person shall construct a permanent structure in the Thaidene Nëné Territorial Protected Area.
(1) A person may apply for a protected area permit to engage in an activity referred to in paragraph 3(1)(a) or (b).
(2) An application for a protected area permit must be in a form approved by the Minister and must contain the following information:
(a) the name, address and contact information of the applicant;
(b) the name and contact information of the project manager for the proposed activity;
(c) the purpose of the activity;
(d) a description of the proposed activity, including, as applicable,
(i) the volume and type of material proposed to be extracted,
(ii) the work required to access the material,
(iii) the equipment proposed to be used for the activity, and
(iv) the proposed method of transportation to and from the site of the proposed activity;
(e) the proposed general location of the work and specific work sites, as demonstrated on a map;
(f) the dates that the activity is proposed to take place;
(g) the date of application and signature of the applicant.
(3) The Minister may
(a) issue to an applicant a permit to engage in the activity specified in the application for a duration of not more than 12 months; and
(b) impose any terms and conditions on the permit that the Minister considers appropriate.
Transportation or Transmission Corridors
A transportation or transmission corridor within Thaidene Nëné Territorial Protected Area may only be approved by the Minister under section 36 of the Act if it is consistent with the terms and conditions set out in the establishment agreements for the area.
Aboriginal and Treaty Rights
For greater certainty, a use or activity prohibited within the Thaidene Nëné Territorial Protected Area under the Protected Areas Act or these regulations does not affect the exercise of an Aboriginal or treaty right in respect of that use or activity, and a person who has an Aboriginal or treaty right within the Thaidene Nëné Territorial Protected Area does not require a permit to exercise that right in the Thaidene Nëné Territorial Protected Area and is not required to pay a fee to do so.
The Government of the Northwest Territories may not charge any fees or taxes for cabins within the Thaidene Nëné Territorial Protected Area that are necessarily incidental to the exercise of any asserted or established Aboriginal or treaty rights to harvest.
