The Commissioner, on the recommendation of the Minister, under section 98 of the Wildlife Act and every enabling power, makes the Trapping Regulations.

Interpretation

1.

In these regulations,

"Aboriginal harvester" means a person harvesting wildlife in accordance with section 17 of the Act; (récoltant autochtone)

"GHL" means General Hunting Licence; (PCG)

"Gwich’in Settlement Area" means the area described in Appendix A of the Agreement referred to in the Gwich’in Land Claim Settlement Act (Canada), S.C. 1992, c.53; (région visée par le règlement avec les Gwich’in)

"IFA" means the Inuvialuit Final Agreement entered into between the Inuvialuit of the Inuvialuit Settlement Region and the Government of Canada on June 5, 1984, as amended; (CDI)

"Inuvialuit Settlement Region" means the Inuvialuit Settlement Region as described in Annex A-1 of the IFA; (région désignée des Inuvialuit)

"Nahanni National Park Reserve" means the Nahanni National Park Reserve of Canada as described in Schedule 2 of the Canada National Parks Act, S.C. 2000, c.32; (réserve à vocation de parc national Nahanni)

"Sahtu Settlement Area" means the area within the Northwest Territories as described in appendix A to the Sahtu Dene and Metis Comprehensive Land Claim Agreement entered into between Her Majesty the Queen in right of Canada and the Dene of Colville Lake, Délîne, Fort Good Hope and Fort Norman and the Metis of Fort Good Hope, Fort Norman and Norman Wells, as represented by the Sahtu Tribal Council, on September 6, 1993, as amended; (région désignée du Sahtu)

"SHL" means special harvester licence; (PSR) "trap" means a device, other than a firearm, designed and commonly used to capture or kill wildlife. (piège) R-092-2019,s.2.

1.1.

(1) A reference to regulations without a citation is a reference to regulations made under the Wildlife Act.

(2) A reference to a zone or area is a reference to that zone or area as described in the Wildlife Management Zones and Areas Regulations. R-086-97,s.2; R-008-2017,s.3.

1.2.

Sections 11 and 12 and Schedule A do not apply to Aboriginal harvesters trapping within their traditional area. R-120-2014,s.3.

General

2.

(1) In this section,

"cage" means a live hold trap set to capture an animal by enclosing it within wire or mesh walls; (cage)

"leg snare restraining trap" means a live hold trap set to catch an animal by the leg with a wire snare and equipped with a locking device that prevents the snare from loosening once the animal is caught; (lacet de patte à étreinte)

"live hold trap" means a trap set to capture an animal without killing or wounding it; (piège à rétention)

"neck snare trap" means a multiple strand wire trap set to catch an animal by the neck with a wire snare and kill it by strangulation; (collet)

"quick kill trap" means a trap set to capture and immediately kill the animal by striking it at the base of the skull; (piège mortel)

"soft catch trap" means a live hold trap set to capture an animal by grasping its leg between rubber padded jaws; (piège à prise douce)

(2) While harvesting fur-bearers, no person shall use

(a) a trap with metal teeth or serration on the jaws;

(b) a hook or sharp device;

(c) a trap on land, other than a cage, leg snare restraining trap, quick kill trap or soft catch trap for beaver, coyote, fisher, lynx, marten, mink, muskrat, otter, skunk, squirrel, weasel, wolf or wolverine;

(d) a foothold trap for beaver, mink, muskrat or otter unless the trap is set in such a manner as to drown the animal as soon as it is caught;

(e) a springpole with a foothold trap;

(f) a trap that is not maintained in a mechanically fit condition;

(g) a single strand brass or stainless steel wire snare trap, except for squirrels; or

(h) a neck snare trap, unless it is equipped with a locking device that prevents the snare from loosening once the animal is caught.

A person who holds a licence that authorizes trapping and uses live hold traps shall inspect the live hold traps at least once every 72 hours.

A person who applies for a licence to trap fur-bearers for the first time shall successfully complete a trapping education course approved by the Superintendent. R-120-2014,s.6.

Paragraph 51(a) of the Act does not apply to persons lawfully trapping fur-bearers who cause minor damage to a beaver dam or muskrat push-up in the course of setting a trap. R-120-2014,s.7; R-008-2017,s.4.

6.

Registered Trapping Areas

7.

(1) Subject to section 10.2, the holder of a registered trapping area licence is entitled exclusively to harvest fur-bearers in the wildlife management area specified in the licence.

(2) Only an Aboriginal harvester or the holder of a general hunting licence or a special harvester licence is eligible to hold a registered trapping area licence.

(3) No person other than the holder of a registered trapping area licence or a person acting in accordance with subsection (4) or (6) shall harvest fur-bearers in the registered trapping area specified in that licence or be in possession of fur-bearers in the area specified in that licence.

(4) Where the Superintendent is satisfied that a licence holder is temporarily unable to harvest fur-bearers in the registered trapping area, the Superintendent may authorize, in writing, another person to exercise the powers of the licence holder under the licence, and the person so authorized shall, for the duration of the authority, be deemed to be the licence holder.

(5) The authority of the authorized person expires automatically on the resumption of harvesting by the licence holder.

(6) With the approval of the Superintendent and the holder of a registered trapping area licence, the holder of a special harvester licence may assist the holder of a registered trapping area licence.

(7) A holder of a registered trapping area licence shall not harvest fur-bearers in an area not specified in the licence unless authorized in writing by the Superintendent to do so. R-087-93,s.2; R-094-98,s.3; R-120-2014,s.4,5,9,10.

8.

(1) The wildlife management areas known as registered trapping areas shall be delimited in accordance with maps which shall be available for public inspection and lodged with

(a) the Superintendent at Yellowknife, for the areas; and

(b) the regional offices of the Department of Environment and Natural Resources, for those regions in which the respective areas are located.

(2) No registered trapping area shall be delimited under subsection (1) or altered without the approval of the appropriate local harvesting committee.

(3) The registered trapping areas shall be known by the names given to them in Schedule B. R-039-93,s.4; R-094-98,s.4; R-042-2005,s.2; R-120-2014,s.11.

8.1.

(1) Repealed, R-008-2017,s.5.

(2) A registered trapping area licence expires five years after the date of its issue. R-039-93,s.4; R-055-2011,s.2; R-008-2017,s.5.

Registered Group Trapping Areas

9.

(1) Subject to section 10.2, the holder of a registered group trapping area licence is entitled exclusively to harvest fur-bearers in the wildlife management area specified on the licence, the right belonging to the group named in the licence.

(2) No person other than an Aboriginal harvester or the holder of a general hunting licence or a special harvester licence is eligible to be named on a registered group trapping area licence.

(3) Subject to subsection (4), the members of a group trapping area may apply, in writing, to the Superintendent to have the membership in a registered group trapping area licence amended.

(4) A minimum of 2/3 of the members of a group trapping area must apply in order for the membership in a registered group trapping area licence to be amended.

(5) The Superintendent shall amend the membership in a group trapping area licence on receipt of an application under subsection (3).

(6) No person, other than a group member named in a registered group trapping area licence, shall harvest fur-bearers in the registered group trapping area specified in that licence or be in possession of fur- bearers in the area specified in that licence.

(7) There shall be no fee for membership in a registered group trapping area.

(8) A member of a registered group trapping area is entitled to harvest fur-bearers in the wildlife management area known as a registered group trapping area to which the membership applies.

(9) Unless authorized in writing by the Superintendent, no member of a registered group trapping area shall harvest in an area other than the registered group trapping area to which the member-ship applies. R-087-93,s.3; R-094-98,s.3; R-120-2014,s.4,9,12.

10.

(1) The wildlife management areas known as registered group trapping areas shall be delimited in accordance with the descriptions contained in Schedule C and shall be known by the names given to them in Schedule C.

(2) No registered group trapping area shall be delimited under subsection (1) or altered without the approval of the appropriate local harvesting committee. R-039-93,s.5; R-094-98,s.4; R-120-2014,s.11.

10.1.

A registered group trapping area licence expires five years after the date of its issue. R-039-93,s.5; R-055-2011,s.3.

Special Harvester Licence

10.2.

No person who is the holder of a special harvester licence shall hunt or trap fur-bearers unless that person is authorized to do so. R-120-2014,s.13.

Seasons and Licensing

11.

The type of licence and seasons applicable to the harvesting or trapping of fur-bearers in a zone or area are set out in the applicable portion of Schedule A pertaining to the animal. R-120-2014,s.14.

12.

(1) No person shall set a net, snare, deadfall, trap or device before the first day of an open season.

(2) A person shall ensure that every net, snare, deadfall, trap or device that he or she had set is sprung, rendered harmless or removed on or before the last day of an open season. R-120-2014,s.15.

12.1.

Aboriginal harvesters harvesting lynx in Lynx Management Area 1/LX/01 shall do so in accordance with the applicable Inuvialuit Settlement Region Hunters and Trappers Committee Regulations. R-008-2017,s.6.
