The Commissioner in Executive Council, under section 90 of the Petroleum Resources Act and every enabling power, makes the Petroleum Lands Registration Regulations.

INTERPRETATION

1.

In these regulations, "representative", in respect of an interest owner, means a representative of the interest owner appointed under subsection 8(1) of the Act or designated under subsection 8(2) of the Act.

REGISTRAR

2.

The Registrar shall supervise the operation of the system of registration established under Part 8 of the Act in accordance with that Part and these regulations.

DEPUTY REGISTRAR

(1) In the absence of the Registrar, the Deputy Registrar may exercise the powers and shall perform the duties and functions of the Registrar.

(2) If, at any time, no person is designated by the Minister to be the Registrar, the Deputy Registrar may exercise the powers and shall perform the duties and functions of the Registrar.

INTERESTS

4.

(1) On registering an interest, the Registrar shall prepare an abstract of the interest and, without delay, enter the abstract in a book maintained as the register.

(2) The abstract of an interest must contain the following information:

(a) the type, effective date and term of the interest;

(b) the name of the interest owner or, if the interest owner consists of two or more interest holders, the name of each holder and the name of the representative of the interest owner;

(c) the particulars of the shares in the interest;

(d) a description of the portions of the petroleum lands, geological formations and substances to which the interest applies.

(3) The abstract of an interest referred to in section 81 of the Act must contain a notation of the registration of each instrument that applies to the interest by virtue of that section.

(4) The Registrar shall record in the abstract of an interest

(a) every change to the information recorded in the abstract, other than a correction referred to in subsection 8(2);

(b) every order or decision made or action taken by the Minister in relation to the interest that is expressly stated in the Act to be subject to section 95 of the Act;

(c) every order made under section 11 of the Act in relation to the interest;

(d) every notice given by the Minister under subsection 37(1) or 94(1) of the Act in relation to the interest; and

(e) any extension of the term of the interest under the Act.

(5) If an interest expires or is cancelled, the Registrar shall endorse a memorandum to that effect on the original copy of the interest maintained under paragraph 6(2)(a) and shall make a notation of the expiration or cancellation in the abstract of the interest.

(6) If two or more interests are consolidated under subsection 24(3) or section 40 of the Act, the Registrar shall prepare an abstract of the consolidated interest and, without delay, enter the abstract in the register.

(7) Each abstract entered in the register under subsection (6) must contain the notations made in the abstracts of the interests that have been consolidated.

DOCUMENTS

(1) The Registrar shall stamp each document submitted for registration under Part 8 of the Act with the date and time of its receipt at the office of the Registrar.

(2) The Registrar shall keep a record called the daybook and, without delay on receipt of a document submitted for registration, shall record in the daybook in chronological order

(a) the type and date of the document;

(b) the name of the person submitting the document; and

(c) the date and time of receipt of the document at the office of the Registrar.

(3) If the Registrar refuses to register a document, the Registrar shall, without delay, record the refusal with respect to the document in the daybook.

(4) If the Registrar accepts a document for registration as an instrument, the Registrar shall, without delay,

(a) register the instrument;

(b) make a notation of the registration of the instrument in the abstract of each interest to which the instrument relates; and

(c) record the registration of the instrument in the daybook.

(5) If the registration of an instrument is cancelled under the Act or these regulations, the Registrar shall make a notation of the cancellation in each abstract in which a notation of the registration of the instrument appears.

OFFICE

(1) The office of the Registrar must be in Inuvik or in any other location in the Northwest Territories that the Commissioner in Executive Council designates and must be kept open from 9:00 a.m. to 4:00 p.m. Monday to Friday, with the exception of statutory holidays and days on which members of the public service are on mandatory leave.

(2) The Registrar shall maintain at the office of the Registrar

(a) the original copies of every interest and instrument registered under Part 8 of the Act;

(b) the register; and

(c) the daybook.

SEARCHES

7.

(1) On request and payment of the appropriate fee prescribed by section 14, a person may, at the office of the Registrar, inspect the daybook, the register and a copy of any interest or instrument registered under Part 8 of the Act.

(2) On request and payment of the appropriate fee prescribed by section 14, the Registrar shall provide to the person making the request a certified exact copy of

(a) an interest or instrument registered under Part 8 of the Act; and

(b) the abstract of an interest.

(3) The Registrar may, for the purposes of subsection (2), certify that an enlarged print made from a microphotographic film or an electronic or magnetic recording of an abstract, interest or instrument is an exact copy of the abstract, interest or instrument.

CORRECTIONS

(1) The Registrar shall cancel the registration of an interest registered in error and shall, without delay, notify the interest owner, the representative of the interest owner, if any, and any other person directly affected by the cancellation.

(2) If the particulars of an interest, instrument or other matter required by these regulations to be recorded or noted in an abstract are not recorded or noted or are recorded or noted incorrectly, the Registrar shall correct the omission or error without delay after the omission or error becomes known to the Registrar.

(3) The Registrar shall send a certified exact copy of each abstract corrected under subsection (2) to

(a) the interest owner of the interest to which the corrected abstract relates or, if the interest owner has a representative, to the representative; and

(b) the secured party under each security notice registered in respect of the interest to which the corrected abstract relates if the security notice has not been fully discharged at the time of the correction.

DEMAND FOR INFORMATION

A person who has written authorization from a person referred to in paragraph 85(2)(a), (b) or (c) of the Act to serve a demand for information is a member of a prescribed class for the purposes of paragraph 85(2)(d) of the Act.

NOTICE

10.

Unless otherwise specified in the Act, a notice that is required to be given to a person by the Minister or the Registrar under the Act must be given by personal service or by registered mail sent to the latest address for the person that is filed with the Registrar.

SURRENDER OF INTERESTS

11.

(1) An interest may be surrendered with respect to all or any portion of the petroleum lands subject to the interest by sending a notice of surrender to the Registrar describing the petroleum lands in respect of which the interest is surrendered.

(2) A surrender of an interest in respect of all of the petroleum lands subject to the interest must be executed by the interest owner or, if the interest owner consists of more than one interest holder, by each holder.

(3) A surrender of an interest in respect of a portion of the petroleum lands subject to the interest must be executed by the interest owner or by the holder of each share in the interest held in respect of the portion.

If an interest is surrendered, the Registrar shall endorse a memorandum to that effect on the original copy of the interest maintained under paragraph 6(2)(a) and shall make a notation of the surrender in the abstract of the interest.

APPOINTMENT OF A REPRESENTATIVE

13.

(1) For the purposes of subsection 8(1) of the Act, interest holders shall appoint a representative by sending a notice of appointment executed by each interest holder to the Registrar.

(2) A representative referred to in subsection (1) shall, without delay, notify the Registrar of any change in his or her name or address.

(3) Interest holders who terminate the appointment of a representative shall, without delay, provide the Registrar with a notice of termination, and the termination is effective when the notice is received by the Registrar.

FEES

14.

(1) The fee for a service set out in column I of an item of the Schedule is the fee set out in column II of that item and is payable at the time the service is rendered.

(2) A fee is payable to the Government of the Northwest Territories.

COMMENCEMENT

15.

These regulations come into force April 1, 2014.
