The Minister, under section 151 of the Education Act, S.N.W.T. 1995, c.28, and every enabling power, makes the Private School Regulations.
In these regulations, "Act" means the Education Act.
A person who applies to the Minister to register a private school under section 21 of the Act, shall provide to the Minister the following information:
(a) the goals and objectives of the private school;
(b) a copy of the program of education to be used in the private school, where it is different from the education program;
(c) a statement that the private school would not, in theory or in practice, promote or foster the doctrines of
(i) racial or ethnic superiority or persecution,
(ii) religious intolerance or persecution,
(iii) social change through violent action, or
(iv) sedition;
(d) grades to be taught;
(e) projected enrolment for the private school;
(f) proposed hours of instruction for the private school;
(g) proposed opening date of the private school;
(h) proposed facilities for the private school;
(i) proposed budget for the private school;
(j) proposed governance structure for the private school;
(k) plans for staffing the private school;
(l) name and address of the applicant and a telephone number at which the applicant may be reached;
(m) a $200 application fee.
(1) Within 90 days of the receipt of an application made in accordance with section 2, the Minister shall, in writing, advise the applicant
(a) whether the private school has been registered;
(b) whether further information is required and what that information is; and
(c) where the application has been refused, reasons for the refusal and the steps the applicant must take to successfully have the private school registered.
(2) Where the Minister registers a private school, he or she may issue directives to the person in charge of the private school concerning
(a) the enrolment of students;
(b) the qualifications of teachers;
(c) the administration of the private school;
(d) the reports required by the Minister;
(e) the funding that may be available for the private school; and
(f) any other matters concerning the operation of the private school.
(1) The Minister may direct a person to monitor a private school and may direct that person to report at specific times and in a specific manner.
(2) The person directed to monitor a private school under subsection (1) may, in accordance with the directions of the Minister, delegate to a person, by contract or otherwise, the powers and duties related to the monitoring of a private school and the delegate shall prepare such reports regarding the facilities used for the private school or relating to the program of education provided by the private school as are required by the Minister.
(3) The person in charge of a private school shall allow the person responsible under subsection (1) or (2), to monitor that private school to
(a) enter facilities used for private school activities for the purpose of conducting evaluations and inspections;
(b) inspect any records relating to the operation or administration of the private school;
(c) examine any reports relating to the achievement of the students;
(d) observe students and teachers during instruction; and
(e) obtain any information required to allow that person to interview students, parents of students and teachers.
(4) The person in charge of a private school shall cooperate with the person responsible to monitor the private school under subsection (1) or (2) and shall provide that person with any information he or she requires.
(1) Within a reasonable time after the completion of an evaluation or inspection of a private school, the Minister shall advise the person in charge of the private school
(a) of the result of the evaluation or inspection;
(b) of any changes that must be made to the operation of the private school; and
(c) of the time within which the changes must be made and whether the private school may continue to operate while the changes are being made.
(2) The Minister may direct the person in charge of the private school to report to the Minister concerning the changes to be made and may specify the time for the completion of the report.
(3) The person in charge of a private school shall make the changes as required by the Minister under subsection (2) and shall report as specified by the Minister.
(4) Where the person in charge of a private school does not make the changes as required by the Minister under subsection (2), the Minister may
(a) suspend the registration of the private school until the changes have been made; or
(b) if in the opinion of the Minister it is in the best interests of the students attending the private school, cancel the registration of the private school.
(5) Where the person in charge of a private school continues to operate the private school where the registration of the private school has been suspended, the Minister may, if in the opinion of the Minister it is in the best interests of the students attending the private school, cancel the registration of the private school.
(6) Where the Minister cancels the registration of a private school under paragraph (4)(b) or subsection (5), the Minister shall give notice of the cancellation of the registration of the private school to
(a) the District Education Authority within whose area of jurisdiction the private school operated; and
(b) the students and parents of the students who attended the private school.
(1) The person in charge of a private school shall provide at least 90 days notice to the Minister and to the students and parents of the students attending the private school, where the person intends to cease
(2) Where the Minister receives a notice under subsection (1), the Minister shall give notice of the closing of the private school to
(a) the District Education Authority within whose area of jurisdiction the private school operates; and
(b) the students and parents of the students attending the private school.
