The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows:
INTERPRETATION
AND APPLICATION
Definitions
1.(1) In this Act,
"library authority" means the council of a municipal corporation or a body that the Minister recognizes as a representative body of a community or region for the purposes of this Act; (autorité régissant les bibliothèques)
"public library" means a library designated by the Minister under section 3; (bibliothèque publique)
"Public Library Services" means the Public Library Services of the Northwest Territories continued by the Minister under section 2. (services des bibliothèques publiques)
(2) This Act applies to public libraries designated by the Minister under section 3.

Public Library Services of the Northwest Territories
2.The Minister shall continue a system of free public libraries called the Public Library Services of the Northwest Territories.
Designation of public library
3.The Minister may, by order, designate a library as a public library.
Library agreements
4.The Minister may enter into an agreement with a library authority
(a) under which
(i) the Minister agrees to provide staff and books, periodicals, films, records, materials and other objects or articles of educational or cultural value for a public library in the community, and
(ii) the library authority agrees to provide and maintain adequate premises for use as a public library in the community, or
(b) under which the responsibilities set out in subparagraphs (i) and (ii) are otherwise shared.
RIGHTS OF LIBRARY USERS
Right to use
5.Subject to paragraph 6(c), any person may
(a) reserve or borrow circulating library materials without the payment of a fee; and
(b) use library reference materials and services, and information services without the payment of a fee.
POWERS OF LIBRARY AUTHORITY
Library fees
6.(1) Subject to the regulations, a library authority may charge such fees as it considers appropriate for
(a) services not referred to in section 5;
(b) the use of parts of a building that are not being used for public library purposes; and
(c) the use of library materials or services by persons who do not reside in the Northwest Territories.
(2) Subject to the regulations, a library authority may charge such fines as it considers appropriate for a breach of its rules.
Library rules
7.(1) Subject to the regulations, a library authority may make rules
(a) respecting the use of library services;
(b) respecting the admission of the public to the library;
(c) for the exclusion from the library of persons who behave in a disruptive manner or cause damage to library property;
(d) respecting fines for breaches of the rules;
(e) respecting the suspension of library privileges of persons in breach of the rules; and
(f) respecting all other matters connected with the management of the library and library property.
(2) Rules made under subsection (1) are not statutory instruments within the meaning of the Statutory Instruments Act.
POWERS OF MINISTER
Powers of
8.The Minister may
(a) by purchase, gift or bequest, acquire for the Public Library Services books, periodicals, films, records, materials or any other objects or articles of educational or cultural value;
(b) by gift, bequest or otherwise, acquire money, securities or other property; and
(c) expend, administer or dispose of property acquired under paragraph (b) for public library purposes, subject to the terms on which the property was acquired.
REGULATIONS
Regulations
9.The Commissioner, on the recommendation of the Minister, may make regulations
(a) respecting the operation, maintenance and inspection of the Public Library Services, including library services by mail;
(b) prescribing the maximum fees that a library authority may charge public library users;
(c) prescribing the maximum fines that a library authority may impose on public library users; and
(d) for those matters respecting the Public Library Services that the Commissioner considers necessary.
