The Commissioner, on the recommendation of the Minister, under section 60 of the Employment Standards Act and every enabling power, makes the Employment Agencies Regulations.
General
In these regulations,
"Act" means the Employment Standards Act; (Loi)
"community" means a city, town, village, hamlet, charter community, Tłı̨chǫ community government or unincorporated community. (collectivité) R-037-2011,s.2.
These regulations do not apply to
(a) an employer maintaining an internal organization for the purpose of hiring employees for its own use;
(b) a trade union operating a hiring hall that does not receive remuneration for that service.
(1) The Minister may, in the Minister’s discretion,
(a) issue, cause to be issued or refuse to issue, a licence authorizing the applicant to operate an employment agency;
(b) suspend or cancel a licence previously issued.
(2) An application for a licence must be in Form 1 of the Schedule, and must be accompanied by the yearly licence fee of $50. R-026-2022,s.2.
A licence expires on March 31 next following its date of issue, unless it is suspended or revoked earlier.
An employment agency that maintains offices in more than one community shall obtain a separate licence in respect of each office.
A licence holder shall display the licence in a conspicuous place on the premises in which business is carried on.
An application for a licence renewal must be
(a) in Form 2 of the Schedule;
(b) made not later than March 1 next following the date of issue of the licence being renewed; and
(c) accompanied by the yearly licence fee of $50.
A licence to carry on an employment agency must be in Form 3 of the Schedule.
A licence is not transferable.
(1) An applicant for a licence or licence renewal shall maintain a permanent place of business in the Northwest Territories.
(2) An applicant that is a corporation must be incorporated or, in the case of an extra-territorial corporation, registered under the Business Corporations Act.
(3) An applicant that is a partnership must be registered under the Partnership Act.
(4) An individual applying for a licence or licence renewal must be at least 19 years of age.
(1) Notwithstanding subsection 10(1), a licence may be issued to an applicant that does not maintain a permanent place of business in the Northwest Territories, if the Minister considers that doing so is necessary to ensure public safety or the provision of health services or social services in the Northwest Territories.
(2) Notwithstanding section 4, a licence issued under subsection (1) expires on March 31 next following its date of issue or on an earlier date specified by the Minister, unless the licence is suspended or revoked earlier. R-026-2022,s.4.
A licence shall not be issued where an applicant proposes to use a trade name that is the same or similar to a name that appears on a licence that has been issued to another employment agency, but a licence shall not be refused on those grounds if the applicant, using the proposed name, has been incorporated under the Business Corporations Act.
Duties of Licence Holder
A licence holder shall immediately notify the Minister or such person as may be designated by the Minister from time to time in writing,
(a) of any proposed change in name, trade name or address;
(b) in the case of a partnership, of any proposed change in members of the partnership;
(c) of any proposed sale of the employment agency; or
(d) of the proposed termination of the employment agency.
A licence holder shall keep a record showing
(a) the name, address and qualifications of each person whose application for employment is accepted by the employment agency;
(b) the name and address of each person from whom the employment agency has received a request for employment;
(c) the name and address of each person whom the agency procures for employment, and the name and address of the employer for whom that person is procured and the amount of remuneration paid by each such employer to the employment agency.
A licence holder shall provide, at the request of the Minister or anyone designated by the Minister, copies of any records required to be kept under the Act or regulations.
A licence holder shall issue a receipt for all money received for its services showing the service for which the money was paid, and shall retain a duplicate copy of the receipt in its records.
A licence holder shall not
(a) directly or indirectly collect or receive from a person seeking employment, a fee or compensation for
(i) obtaining or endeavouring to obtain employment for the person,
(ii) introducing the person to a prospective employer,
(iii) receiving an application from the person for employment, whether for specific employment or for employment generally, or
(iv) placing the name of the person on any list of persons seeking employment; or
(b) collect or receive from a person seeking employment, directly or indirectly, a fee or compensation for providing information with respect to employers seeking workers or workers seeking employment.
